97-273 Resolution No. 97-273 RESOLUTION AUTHORIZING EXECUTION OF A SOLID WASTE COLLECTION SERVICES CONTRACT AMENDMENT #8 WITH WASTE MANAGEMENT WEST BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Robert O. Malm, Interim City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute a Solid Waste Collection Services Contract Amendment #8 on behalf of the City of Elgin with Waste Management West for the collection and disposal of garbage and refuse under the curbside recycling collection program, a copy of which is attached hereto and made a part hereof by reference. s/ Kevin Kelly Kevin Kelly, Mayor Presented: November 19 , 1997 Adopted: November 19 , 1997 Omnibus Vote: Yeas 7 Nays 0 Attest: s/ Dolonna Mecum Dolonna Mecum, City Clerk . • 11 SOLID WASTE COLLECTION SERVICES CONTRACT AMENDMENT #8 CITY OF ELGIN COLLECTION AND DISPOSAL OF GARBAGE AND REFUSE CURBSIDE RECYCLING COLLECTION PROGRAM This contract amendment (hereinafter referred to as "Eighth Amendment" ) agreement is made and entered into this ;42F',¢�day of /VCL', , 1997 by and between the City of Elgin, Illinois, a municipal corporation, (hereinafter referred to as "City" ) and Waste Management-West, a Division of Waste Management of Illi- nois, Inc . , a Delaware Corporation formerly known as Elgin Wayne Disposal (hereinafter referred to as "WMW" ) . WITNESSETH, THAT WHEREAS, the CITY and WMW have previously entered into a Solid Waste Collection Services Contract dated the 14th day of February, 1990 for Collection and Disposal of Garbage and Refuse and Curbside Recycling Collection Program, (hereinafter referred to as the "CONTRACT" ) . WHEREAS, the terms of said CONTRACT currently extend until December 31, 1998; and WHEREAS, the present terms of the CONTRACT do not accurate- ly reflect changed economic conditions and current municipal refuse needs of the CITY; and WHEREAS, the circumstances making this change necessary were not reasonably foreseeable at the time the contract was signed; and NOW THEREFORE, in consideration of the mutual promises and covenants contained herein, the sufficiency and receipt of which are hereby acknowledged, the CITY and WMW agree that: Additional Scope of Services The contract is hereby amended such that bagged leaves will again be picked up at curbside by WMW at a cost of $28, 781 ($4 .25/Stop X 6, 772 Stops) from the following subdivisions : Century Oaks Country Trails Summerhill/ Century Oaks West Highland Glen Parkwood Farms Cobbler' s Crossing, N&S Morningside Valley Creek College Green Parkwood Woodbridge North College Park Randall Ridge Woodbridge South Country Brook Riverside Manor Woodland . 11 Disposal of all the bagged leaves will be accomplished by WMW at the City' s compost facility with no additional hauling or tipping fees involved. WMW will provide a tub grinder for use by the City at the compost site. WMW will deduct the present curbside yardwaste charge of $5, 688 .48 ( $0 . 84/Stop/Month X 6, 772 Stops) from the monthly bill during leaf collection. WMW will also provide a 30% reduction on the curbside charge in exchange for tipping all yardwaste at our compost facility. ( 19, 989 Stops-6, 772 Stops = 13,217 Stops X 840 = $11, 102 .28 X 30% = $3, 330 . 68) . WMW will provide a 6 C.Y. dumpster at the compost site for the disposal of any grass hauled to the facility. WMW will provide roll-off trucks with a 30 C.Y. receiving container and a driver at the rate of $80 . 00 per hour. Therefore, the City of Elgin and WMW mutually agree to modify the yardwaste collection program as outlined herein at a cost as outlined above to the City of Elgin. Malm, Interim City Manager SUBJECT: 1997 Leaf Collection Contract Amendment No. 8 (Revised) with Waste Management-West (WMW) PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with a revised Contract Amendment No. 8 with WMW for the 1997 leaf collection program following City Council action on October 22 , 1997 . BACKGROUND Following the October 22, 1997 City Council meeting staff met with WMW and discussed the revised leaf bagging program. WMW eft. has already committed specific equipment to another community, so they are unable to help provide bulk leaf collection from City streets in Elgin at this late date. WMW will collect bags of leaves from the entire City with reimbursement only for the original 17 outer-periphery subdi- visions as completed the past several years . 55, 000 bags have been handed out and we expect more people will bag their leaves. WMW has agreed to pick up those "additional" bags of leaves without additional compensation. Therefore, this revised Contract Amendment No. 8 is basically structured the same as last year. WMW will make roll-off vehicles available to a greater degree as compared to the previously approved plan. Disposal of leaves will take place at the City's compost facility and, consequently, no additional landfill tipping fees will be incurred. A tub grinder will be provided by WMW at no charge in order to break down and shred the paper bags before the leaves can be composted. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None. 4'1997 Leaf Collection Contract Amendment No. 8 October 30, 1997 Page?6,4 _FINANCIAL IMPACT Revised Contract Amendment No. 8 increases the cost of the City' s refuse contract with WMW by $19,761 . 84 . Sufficient funds are available in account number 010-3331-754 . 33-02 (Refuse Services - Disposal) . Leasing WMW roll-off trucks (with driver) will be paid from account number 601-4701-796 .43-04 (Equipment Rental) and is estimated at $25,000 . Sufficient funds currently remain in this account to pay for truck rentals . LEGAL IMPACT None. ALTERNATIVES Previously discussed. RECOMMENDATION it is recommended City Council direct staff to proceed with revised Contract Amendment No. 8 to the scavenger agreement with Waste Management-West for the pick up and transport of bagged leaves to the City of Elgin's leaf compost facility.
