97-162 Resolution No. 97-162 RESOLUTION ESTABLISHING PREVAILING WAGE RATES ON PUBLIC WORKS CONTRACTS WHEREAS, 820 ILCS 130/1 , et seq. entitled "AN ACT regulating wages of laborers, mechanics, and other workers employed in any public works by the State, county, city or any public body or any political subdivision or by any one under contract for public works . " requires that any public body awarding any contract for public work, or otherwise undertaking any public works as defined herein, shall ascertain the general prevailing hourly rate of wages for employees engaged in such work; and WHEREAS, said Act further provides that if the public body desires that the Department of Labor ascertain the prevailing rate of wages, it shall notify the Department of Labor to ascertain the general prevailing wage rate; and WHEREAS, at the request of the City of Elgin the Department of Labor has determined the prevailing rate of wages for construction work in Cook and Kane Counties in the State of Illinois . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that the determination of the prevailing wages as made by the Department of Labor, copies of which are attached hereto and made a part hereof by reference, are adopted by the City of Elgin. BE IT FURTHER RESOLVED that all contracts for public work of the City of Elgin shall include a stipulation to the effect that not less than the prevailing rate of wages as found by the Department of Labor shall be paid to all laborers, workers and mechanics performing work under the contract . BE IT FURTHER RESOLVED that all contract bonds for public works shall include a provision to guarantee the faithful performance of the prevailing wage clause as provided by contract . BE IT FURTHER RESOLVED that a copy of the prevailing wage rate as established by the Department of Labor shall be publicly posted and kept available for inspection by any interested party. COOK COUNTY TRUCK DRIVERS (WEST) - That part of the county West of Barrington Road. The following list is considered as those days for which holiday rates of wages for work performed apply: New Years Day, Memorial/Decoration Day, Fourth of July, Labor Day, Veterans Day, Thanksgiving Day, Christmas Day. Generally, any of these holidays which fall on a Sunday is celebrated on the following Monday. This then makes work performed on that Monday payable at the . appropriate overtime rate for holiday pay. Common practice in a given local may alter certain days of celebration such as the day after Thanksgiving for Veterans Day. If in doubt, please check with IDOL. EXPLANATION OF CLASSES ASBESTOS - GENERAL - removal of asbestos material from any place in a building, including mechanical systems where those mechanical systems are to be removed. This includes the removal of asbestos materials from ductwork or pipes in a building when the building is to be demolished at the time or at some clone future date. If there is no such definition on file, the Bureau of Labor Statistics SIC list will be used. If a task to be performed is not subject to one of the classifications of pay set out, the Department will upon being contacted state which neighboring county has such a classification and provide such rate, such rate being deemed to exist by reference in this document. Further, if no such neighboring county rate applies to the task, the Department shall undertake a special determination, such special determination being then deemed to have existed under this determination. LANDSCAPING Landscaping work falls under the existing classifications for laborer, operating engineer and truck driver. The work performed by landscape plantaman and landscape laborer is covered by the existing classification of laborer. The work performed by landscape operators (regardless of equipment used or its size) is covered by the classifications of operating engineer. LANDSCAPING Landscaping work falls under the existing classifications for laborer, operating engineer and truck driver. The work performed by landscape plantsman and landscape laborer is covered by the existing classification of laborer. The work performed by landscape operators (regardless of equipment used or its size) is covered by the classifications of operating engineer. The work performed by landscape truck drivers (regardless of size of truck driven) is covered by the classifications of truck driver. By law, this is to occur during the month of June. Often the wage rates established by the Illinois Department of Labor(IDOL) are automatically adopted by munici- palities_ but there is no legal requirert.en,that your otT.anization do this, and there are several good rea- sons why it should not. Landscape industry wage classifications are not recognized in the IDOL rates. And, those rates are not those that prevail in the landscape industry. What this means is that you, your taxpayers and your con- tractors spend thousands of unnecessary dollars on landscape projects. The IDOL prevailing wage rate reflects a misclassification of our work as"laborer" at $22 plus nearly $5 in fringe benefits. On March 19, 1993, the U.S. Department of Labor (USDOL) re-established the enclosed landscape classifications in ten northern Illinois counties based on the results of a lengthy wage survey of building, residential, heavy and highway projects. These classifications further prove that the rates used by the State of Illinois are not those that prevail in the industry. In addition, there are in effect bargaining agree- ments with both the Production Workers Union and Operating Engineers for landscape work. Today, everyone faces both budget constraints and greater needs for spending. The Prevailing Wage Act and Davis-Bacon were established to ensure that the proper wage that prevailed in an industry was paid to those performing the work. This isn't happening. The IDOL rates are almost two to three times those set by the USDOL. We encourage you to exercise your prerogative and responsibility to establish fair and representative wage rates for your construction roiects 'icing th` wages that prevail in industry. `r ie know this is ....` _ � J..v..,by'icing . _ the not an easy task and the State is not eager to accept new classifications, i.e., landscape classifications. Malm, Interim City Manager SUBJECT: Prevailing Wage Rates PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information in establishing prevailing wages for public works contracts . BACKGROUND By law, Illinois municipalities are required to annually establish the prevailing rate of wages for employees engaged e'' in work on public work projects . Contractors entering into public works projects are required to pay employees not less than the prevailing wage established. Municipalities may hold public hearings to determine prevail- ing wages or may rely upon the Illinois Department of Labor to ascertain them. Historically, the City Council has elected to accept the Illinois Department of Labor's prevailing rate determination. The Illinois Department of Labor has forwarded a schedule of prevailing wages, which is an exhibit to the attached resolution submitted for council action. The U.S. Department of Labor and Kane County have each established schedules of prevailing wages which are also attached hereto. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None. FINANCIAL IMPACT In the event the city elects to independently establish wage rates, the city will incur the costs of conducting the public hearing required to ascertain such rates, and will be required to bear the cost of hearing any objections and of defending such rates in the event they are legally challenged. rm. Challenges to wage rates which are based on the determination of the Illinois Department of Labor' s findings are typically defended by the Illinois Department of Labor. The adoption of independently established wage rates is likely to result in a reduction in the costs of certain public works projects using landscape services . Mayor and Members of the City Council Page 2 June 4, 1997 LEGAL IMPACT In previous years the wage rate classifications determined by the Illinois Department of Labor did not include a separate, specific determination for landscaping workers . This past year, the Illinois Department of Labor conducted' a hearing on the specific issue of wage rate classifications for landscaping workers . Pursuant to this hearing, the Illinois Department of Labor included landscaping workers within one of three preexisting categories of workers, based upon the type of landscape labor being performed. The U.S. Department of Labor and Kane County have each ascertained locally applicable wage rates for landscaping workers . The U.S . Department of Labor' s ascertained rates and Kane County' s ascertained rates are different from those ascertained by the Illinois Department of Labor. The Prevailing Wage Act (820 ILCS 130/0 .01 et seq. ) requires any public body not intending to adopt the findings of the Illinois Department of Labor as to wage rates to investigate and ascertain the prevailing rate of wages during the month of June. In the event the city wishes to independently ascertain wage rates, it therefore must immediately authorize and direct the scheduling of a public hearing to investigate and ascertain such rates . low ALTERNATIVES The city may adopt the wage rates certified by the Illinois Department of Labor or it may conduct an independent public hearing to establish wage rates . RECOMMENDATION It is recommended that the City Council either pass a resolution establishing prevailing wages on public works projects in accordance with the Illinois Department of Labor's rate schedule or set a date for a public hearing to investigate and ascertain the prevailing wage rate. The IDOL prevailing wage rate reflects a misclassification of our work as"laborer" at $22 plus nearly $5 in fringe benefits. rib On March 19, 1993, the U.S. Department of Labor (USDOL) re-established the enclosed landscape classifications in ten northern Illinois counties based on the results of a lengthy wage survey of building, residential, heavy and highway projects. These classifications further prove that the rates used by the State of Illinois arc not those that prevail in the industry. In addition, there are in effect bargaining agree- merLts with both the Production Workers Union and Operating Engineers for landscape work. Today, everyone faces both budget constraints and greater needs for spending. The Prevailing Wage Act and Davis-Bacon were established to ensure that the proper wage that prevailed in an industry was paid to those performing the work. This isn't happening. The IDOL rates are almost two to three times those set by the USDOL. We encourage you to exercise your prerogative and responsibility to establish fair and representative wage rates for your:ur:struction projects by using the wages that prevail in the industry. We know this is not an easy task and the State is not eager to accept new classifications, i.e., landscape classifications. But a survey of all landscape work in your area would reveal the rates that prevail in the landscape indus- try to be far different from those for laborer. Other Classifications of Work: For definitions of classifications not otherwise set out, the Department generally has on file such definitions which are available. If there is no such definition on file, the Bureau of Labor Statistics SIC list will be used. If a task to be performed is not subject to one of the classifications of pay set out, the Department will upon being contacted state which neighboring county has such a classification and provide such rate, such rate being deemed to exist by reference in this document. Further, if no such neighboring county rata applies to the task, the Department shall undertake a special determination, such special determination being then deemed to have existed under this determination. LANDSCAPING Landscaping work falls under the existing classifications for laborer, operating engineer and truck driver. The work performed by landscape plantsman and landscape laborer is covered by the existing classification of laborer. The work performed by landscape operators (regardless of equipment used or its size) is covered by the classifications of operating engineer.
