AGREEMENT THIS AGREEMENT entered into this duo( day of MA1 , 1996, by and between the CITY OF ELGIN, a municipal corporation (hereinafter referred to as the "City" ) , KANE COUNTY (hereinafter referred to as the "County" ) and R & S USED OIL, an Illinois corporation (hereinafter referred to as "R & S" ) . WITNESSETH WHEREAS, the City and the County are public agencies within the meaning of the Intergovernmental Cooperation Act; and WHEREAS, the City and the County are also units of local government within the meaning of Section 10 of Article 7 of the Constitution of the State of Illinois; and WHEREAS, the City and the County are authorized to contract among themselves to obtain or share services, or exercise, combine or transfer any power or function in any manner not prohibited by law; and WHEREAS, the County has requested the City host a one-day used motor oil collection event; and WHEREAS, the collection of used motor oil so as to protect the environment is a matter within the government and affairs of the parties; and WHEREAS, the County has contracted with R & S to service used motor oil collection events throughout the county. t NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the City, County and R & S agree as follows : 1 . That the foregoing recitals are hereby incorporated into this agreement in their entirety. 2 . That the City agrees to host a one-day used motor oil collection event on Saturday, September 14, 1996, from 9 : 00 a.m. to 1 : 00 p.m. The event will be conducted adjacent to the City Salt Storage Facility (north of the public works complex) located at Grove and McBride Street, Elgin, Illinois . 3 . R & S will provide a tanker truck at the collection site and will accept oil at no charge. Participants will bring used oil to the collection point where it will be emptied into 55 gallon drums by County staff. Empty containers will then be immediately returned to the participants . The City will provide a staff member to supervise the activities . 4 . R & S personnel will pump the oil from the drums into the R & S tanker. R & S will clean up any and all spills . 5 . R & S and the County represent and warrant to the City that they each have general liability insurance to cover any and all claims and damages which may result from the used motor oil collection event as described herein. R & S and the County agree to indemnify and hold the City harmless from any and all claims, damages or causes of action which may result from said event. 2 t ' IN WITNESS WHEREOF, the parties have executed this agreement on the date and year first written above. Helwig, City Manager SUBJECT: Third Used Motor Oil Collection Event PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council information whereby the City Council may authorize participation in a used motor oil col- lection program. BACKGROUND The Solid Waste Division for Kane County has proposed a Coun- ty-wide used motor oil collection event similar to last year. Kane County and the Kane-DuPage Soil and Water Conser- vation District will coordinate the program. They have again requested that the City of Elgin serve as a host site. Attached is a summary sheet from Kane County for oil collec- tion events in 1995. Elgin was one of eight sites which altogether collected 25,650 gallons of oil . During 1994, a total of 11,945 gallons were collected at five sites. Staff is suggesting Saturday, September 14th, as the date for a collection program in Elgin. The used oil collection site would be at the Public Works Complex, adjacent to the salt dome. An agreement with Kane County patterned after the previous years is attached. There is no direct cost to the City for this event, except for one staff person from the City to be involved on overtime from 9 A.M. to 1 P.M. This would amount to a maximum of $145 of overtime pay (not including benefits) , charged to Account Number 010-3343-755.01-02, Overtime Earnings, in the Street Division. Also, a notice in the Spirit and press releases are requested to help publicize the event. Paid advertise- ments by the City are not mandatory. LEGAL IMPACT None. An estimated 100 cans of non—latex or unusable paint was also brought in. Batteries: 65 vehicles (21% of attendees) (125 batteries) Clothing: 58 vehicles (19% of attendees) Food: 104 vehicles (33% of attendees) Total vehicles: 311 The South Elgin IEPA Household Hazardous Waste collection on 10x1 attracted 975 vehicles,bring materials from 1,245 households.
