96-170 Resolution No. 96-170 RESOLUTION APPROVING CHANGE ORDER NO 1 IN THE CONTRACT WITH MICHELS PIPELINE CONSTRUCTION, INC. FOR THE SANITARY SEWER SYSTEM IMPROVEMENTS FOR THE NORTHWEST INTERCEPTOR SEWER WHEREAS, the City of Elgin has heretofore entered into a contract with Michels Pipeline Construction, Inc. for the sanitary sewer systems improvements for the Northwest Interceptor Sewer; and WHEREAS, it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 1, attached hereto. CONTRACTOR: Michels Pipeline ENGINEER' s Project No. 930471/ Construction, Inc. 930248 You are directed to make the following changes in the Contract Documents : DESCRIPTION: The Contractor shall delete manhole Nos. 4, 6, and 11 from the project. The sanitary sewer in these areas will be constructed in tunnels constructed from manhole Nos . 3 to 5, 5 to 7, and 10 to 12 . As a result of these changes the Contractor will be allowed an adjustment in their unit prices for 48-inch PCPP tunnel excavation and pipe installation and grouting (Item No. 1 ) to compensate them for the increased costs for the longer runs between manhole shafts . All parties have mutually agreed to the following provisions as part of this change order: 1. The soil investigation completed by Michels Pipeline Construction, Inc. between Manhole Nos . 5 to 7 provides additional information of the soil and groundwater conditions along the revised route. The soil investigation results shall be submitted to the Owner and • Engineer and made part of the Contract Documents. 2 . The testing requirements for the sanitary sewer outlined in the specifications will be adhered to. 3 . The quantities for work completed will be measured in accordance with the specifications for this project. 4. Additional soil borings will be made by Michels Pipeline Construction, Inc. along the sewer route between Manhole Nos . 10-12 . The soil boring results shall be submitted to the Owner and Engineer and made part of the Contract Documents . 5 . Michels Pipeline Construction, Inc. agrees the change of the sewer route does not constitute a differing site condition. • PURPOSE OF CHANGE ORDER: Change in Contract Price. Helwig, City Manager SUBJECT: Change Order No. 1 for the Northwest Interceptor Sewer (NWIS) Phase I Construction Contract PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider approving Change Order No. 1 deducting $225, 069 from the contract with Michels Pipeline Construction, Inc. eft. BACKGROUND On April 26, 1995 the City Council authorized the Mayor to enter into a contract with Michels Pipeline Construction, Inc. to construct the subject interceptor sewer. During pre-construction discussions with Michels Pipeline, they proposed the elimination of several deep manholes with longer sewer lines between manholes . Since the construction of the deep manhole shafts is costly, substantial savings to the project would be realized if the manholes were eliminated. As the initial design met Illinois Environmental Protection Agency ( IEPA) requirements, a revised plan was submitted to IEPA illustrating the proposed changes . IEPA accepted the change and issued a revised construction permit. Change Order No. 1, attached, details the adjustments to the contract with Michels Pipeline. Michels Pipeline has agreed to the terms of the change order and has signed the Change Order. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED None. C.O. No. 1 NWIS May 16 , 1996 Page 2 FINANCIAL IMPACT Acceptance of Change Order No. 1 will reduces the current contract with Michels Pipeline $225, 069 . 00, from $4,089,359 . 50 to $3,864 ,290 . 50. The sewer portion of the 1995 bond sale was used to fund these expenditures . Any savings from this project could be utilized to fund other sewer capital expenditures . LEGAL IMPACT None. ALTERNATIVES There is no alternative to this deduct change order. After the alternate was approved by IEPA and FRWRD, Michels Pipeline was authorized to proceed with the new alignment at their risk. The work has been substantially completed.
