RESOLUTION
AUTHORIZING EXECUTION OF CONTRACT AMENDMENT #6
WITH WASTE MANAGEMENT - WEST
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Richard B. Helwig, City Manager, and Dolonna
Mecum, City Clerk, be and are hereby authorized and directed
to execute Contract Amendment #6 on behalf of the City of
Elgin with Waste Management - West for solid waste collection
services, a copy of which is attached hereto and made a part
hereof by reference.

COLLECTION AND DISPOSAL OF GARBAGE AND REFUSE
CURBSIDE RECYCLING COLLECTION PROGRAM
This contract amendment (hereinafter referred to as "Sixth
Amendment" ) agreement is made and entered into this 87 t day of
A/A-1( 1996 by and between the City of Elgin, Illinois, a
municipal corporation, (hereinafter referred to as "City" ) and
Waste Management-West, a Division of Waste Management of Illi-
nois, Inc. , a Delaware Corporation formerly known as Elgin
Wayne Disposal (hereinafter referred to as "WMW" ) .
WITNESSETH, THAT WHEREAS, the CITY and WMW have previously
entered into a Solid Waste Collection Services Contract dated
the 14th day of February, 1990 for Collection and Disposal of
Garbage and Refuse and Curbside Recycling Collection Program,
(hereinafter referred to as the "CONTRACT" ) .
WHEREAS, the terms of said CONTRACT currently extend until
December 31, 1998; and
WHEREAS, the present terms of the CONTRACT do not accurate-
ly reflect changed economic conditions and current municipal
refuse needs of the CITY; and
WHEREAS, the circumstances making this change necessary
were not reasonably foreseeable at the time the contract was
signed; and
NOW THEREFORE, in consideration of the mutual promises and
covenants contained herein, the sufficiency and receipt of
which are hereby acknowledged, the CITY and WMW agree that:
Additional Scope of Services
A. The charge for curbside yard debris collection will in-
crease during 1996, 1997 and 1998 (eight months per
year) . The unit price for curbside collection will be as
follows :

Therefore, the City of Elgin and WMW mutually agree to modify

MENT to be executed as of the day and year hereinabove set
forth.

Yardwaste and Grass Clippings
PURPOSE
The purpose of this memorandum is to provide the Mayor and
members of the City Council with information to consider
amending the rates for yardwaste and grass clippings under
the existing contract with Waste Management-West (WMW) .
BACKGROUND
The City and WMW entered into a solid waste collection con-
tract on February 14, 1990. Contract Amendment #3 dated
March 31, 1993 (copy attached) extended the overall contract
to December 31 . 1998 .
There also was a provision in Amendment #3 (Item #9) to re-
evaluate grass sticker charges and curbside yardwaste collec-
tion costs in 1995 . However, the City and WMW mutually
agreed last year to continue with the original rates through
1995.
Residents have paid a fee of $1 .00 per sticker for grass
clipping disposal since 1992. This fee was implemented in an
effort to discourage the bagging of grass. It had been esti-
mated the volume of grass dropped by 50% with the implementa-
tion of the grass sticker requirement. The average has been
61,400 stickers sold per year over a four-year period
( '92- '95) . Last year, 65,500 stickers were purchased.
The City has been paying the same curbside rate of
790/stop/month since the inception of the yardwaste collec-
e" tion program in 1990. The City agreed to evaluate these
charges per Contract Amendment #3. The adjusted rates are
required to accommodate increased costs for the disposal of
yardwaste materials. WMW responded with their proposal dated
February 12, 1996 (copy attached) . Three options were of-
fered as follows:

A) Retain the existing yardwaste curbside rate ($0.79 per
stop) and increase the grass clippings sticker fee.
B) Retain the existing grass clippings sticker fee ($1 . 00
per bag) and increase the yardwaste curbside rate.
C) Delete the existing yardwaste curbside rate ($0.79 per
stop) and institute a sticker fee system for yardwastes
and grass clippings .

FINANCIAL IMPACT
Option A would result in no increased cost to the City.
Option B would result in a 1996 increase of approximately
$4,750 ( 19,792 stops/avg. @ 3¢ each for 8 months) . Option C
results in a $125,085 decrease in City expenditures for 1996 .
The additional cost for Option B would be charged to Public
Works Refuse Services, Account No. 010-3331-754 . 33-02, Dispos-
al, where adequate funds exist.
LEGAL IMPACT
None.
ALTERNATIVES
The following rates escalate at the same approximate infla-
tion percentage already established for garbage and recycling
charges through the term of the contract (December 31,
1998) . The proposed alternative rates are as follows:

RECOMMENDATION
It is recommended that City Council authorize the City Manag-
er and City Clerk to execute Contract Amendment #6 which
amends the charges for curbside yardwaste collection for the
next three years through the term of the contract (December
31, 1998) per Alternative B above. Alternative B does not in-
crease the sticker price for Elgin residents.

This contract amendment (hereinafter referred to as "Third
Amendment") agreement is made and entered into this 3/57- day of

municipal corporation, (hereinafter referred to as "City") and
Waste Management-West, a Division of Waste Management of Illi-
nois, Inc. , a Delaware Corporation formerly known as Elgin
Wayne Disposal (hereinafter referred to as "WMW") .
WITNESSETH, THAT WHEREAS, the CITY and WMW have previously
entered into a Solid Waste Collection Services Contract dated
the 14th day of February, 1990 for Collection and Disposal of
Garbage and Refuse and Curbside Recycling Collection Program,
(hereinafter referred to as the "CONTRACT") .
WHEREAS, the terms of said CONTRACT currently extend until
March 31, 1993; and
WHEREAS, the present terms of the CONTRACT do not accurate-
ly reflect changed economic conditions and current municipal
refuse needs of the CITY; and
WHEREAS, the CITY has determined that it is in the best
interests of the City to amend the contract with WMW to provide
municipal refuse collection on a more cost effective basis to
the residents of Elgin; and
WHEREAS, the amendment to the CONTRACT will also reflect
the impact of the CITY's recycling program on municipal refuse
collection; and
WHEREAS, the CITY desires to extend the CONTRACT with WMW
to procure future municipal refuse collection for the residents
of Elgin at a determined rate;
NOW THEREFORE, in consideration of the mutual promises and
covenants contained herein, the sufficiency and receipt of
which are hereby acknowledged, the CITY and WMW agree that:
1) The CONTRACT shall remain in full force and effect
except to the extent that provisions of the THIRD AMENDMENT
rm. conflict with the terms of the CONTRACT, in which case the
provisions of this THIRD AMENDMENT shall control .
2 ) The term of the CONTRACT shall be extended from March
31, 1993 until December 31, 1998 .
3) For the garbage collection service described in the
CONTRACT, the following charge will be made on a per stop per
month basis :
$7 .75/stop/month April 1, 1993 - December 31, 1994
$7 .98/stop/month January 1, 1995 - December 31, 1995
$8 .20/stop/month January 1, 1996 - December 31, 1996
$8.45/stop/month January 1, 1997 - December 31, 1997
$8: 70/stop/month January 1, 1998 - December 31, 1998
4) For the curbside recycling collection service, the
following charge will be made on a per stop per month basis:
$2 .45/stop/month April 1, 1993 - December 31, 1995
$2.50/stop/month January 1, 1996 - December 31, 1997
$2 .55/stop/month January 1, 1998 - December 31, 1998
5) The curbside recycling program shall be expanded on
April 5, 1993 by adding the following items to the list of
recyclables to be collected:

Telephone Books
Catalogs
Aluminum Trays/Foil Products
Kraft Paper Bags
6) As secure markets for other types of recyclable materi-
als (such as, but not limited to, #4 plastic, #6 plastic, high
grade paper) become available, WMW will add those items to the
curbside program at no additional cost to the City. WMW shall
provide the City with a statement every 6 months (beginning on
January 1, 1994 ) relative to the market availability of other
recyclable items for consideration by the City.
7) For the curbside yard debris (yardwaste) collection
service (excluding grass clippings) , the following charge (no
increase) will be made on a per stop per month basis :
$0.79/stop/month April 1, 1993 - November 30, 1994
(Collections performed April thru November each year. )
8) For the curbside grass clipping collection service,
the following charge (no increase) will apply to the homeown-
er/resident on a per sticker basis as set forth in Amendment
#1, approved by City Council action on March 25, 1992:
$1.00 each sticker April 1, 1993 - November 30, 1994
(Collections performed April thru November each year. )
9 ) The overall city-wide yard debris (yardwaste) collec-
tion program, including daily curbside service, grass stickers
and city-wide leaf collection (October & November) shall be
reviewed and negotiated by both parties prior to February 1,
1995.
10) WMW shall perform two "pilot" leaf removal programs as
outlined in the WMW letter dated January 19, 1993 and as
approved by the City in two neighborhoods in 1993 and 1994 at
no charge to the City to serve as a basis for a comprehensive
leaf pickup program in 1995 which is to be negotiated with the
City.
11) Collection of white goods shall continue by WMW as set
forth in Amendment #2, approved by City Council action on Octo-
ber 28, 1992, through July 1, 1994 . Prior to May 1, 1994 ,
white goods and tire disposal shall be reviewed and negotiated
with the City pending requirements of new legislation.
12) Unit prices for service on dumpsters, trash cans and
recycling bins supplied to the City shall be frozen at current
prices (as listed below) thru December 31, 1998:
Dumpsters $ 4 .25/C.Y.
Trash Cans $19 .50 Each/month
Recycling Bins $ 6 .50 Each
eft 13) For the previously implemented office paper recycling
program, WMW shall expand the number of items to be collected
in all City offices, conduct a refresher course and instruct
new employees as to proper recycling procedures at . no charge to
the City by September 1, 1993.
14) For the previously implemented multi-family recycling
program, WMW shall continue to implement additional programs in
private developments per the existing contract through 1998 .
15) The number of Stops will be re-calculated every six
months, with the next adjustment to be made on July 1, 1993,
and every six months thereafter. The method to determine the
number of stops assigned to each building shall continue per
previous agreement.
16) WMW will respond to any future request from the City
for a proposal for solid waste volume-based billing.
17) The term of this CONTRACT for the Collection and
Disposal of Garbage and Refuse and Curbside Recycling Collec-
tion Program shall remain in full force and effect through the
31st day of December, 1998.
Therefore, the City and WMW mutually agree to modify the CON-
eilk TRACT as outlined herein.

Per our discussion, a plan for collection of yardwaste for the City has been reviewed with
recommendations outlined below.
Grass clippings and loose yard debris have been banned from Illinois landfills since July of 1990. Since '
that time, Waste Management has worked closely with the communities we service to develop
alternatives for the disposal of these materials.

in the Spring of 1990,the Elgin City Council approved a three year contract with Elgin Wayne/Waste
Management-West for the collection of yard debris. In March of 1993, the City prepared Contract
Amendment #3 to extend the terms of the yardwaste collection contract until November 30, 1994.
The cost for yardwaste collection in subsequent years will be determined by an additional contract
extension providing mutually agreeable terms for the services provided.
The yardwaste collection program consists of two parts. The City opted to provide services to all
City residents during the 8-month yardwaste season at a cost of$.79 per month per stop. This
monthly fee provides a weekly pickup of brush, twigs, and leaves at no cost to the resident. Waste
Management-West has provided this service at the same rate since the inception of the program in
1990. The second phase of the program provides weekly collection of grass clippings for those
residents that choose to bag their grass. Since 1992, Elgin residents have paid a fee of$1.00 per
sticker to dispose of grass clippings only.
In order to keep up with increased costs to dispose of this material, we request consideration of the
City to determine the preferred yardwaste program with related fees.
Options are as follows:
A) Should the City choose to continue the program as it is, Waste Management-West would
continue to hold the monthly rate of$.79 per stop firm through the remainder of the contract.
This would guarantee there would be no additional cost to the City. For residents that do not
wish to manage their grass clippings on their own, the sticker price would be $1.06 per bag.

p' B) If the City would like the cost to the resident to remain the same at $1.00 per sticker, the
monthly fee would increase to $.82 per month per stop.
C) Some communities have gone to a user-pay system whereby the entire cost of the yardwaste
and grass clipping services is incorporated into one sticker price. This option would eliminate
any cost to the City entirely and the sticker cost to residents would increase to $1.54 per bag
or bundle.
We propose that the contract for yardwaste services be extended to coincide with the expiration of
the solid waste and recycling contracts. The annual rate would escalate at the same rate as the solid
waste and recycling contracts to allow for an inflationary increase only. A review of these rates is
attached. Implementation of the new yardwaste agreement would be accomplished in conjunction
with the City by notifying the residents and retail vendors of the date of the sticker price change. The
change would be effective April 1, 1996.
The above rate does not address fall leaf pickup which is handled under a separate program which
occurs over a six week period in the fall of each year in place of the grass and brush pick up.
