Miller who may be contacted at ( 708) 931- 5975 The Sponsoring Jurisdiction agrees to abide with all of the requirements of the Illinois Adopt-A-Highway Act and to ensure that participating groups likewise abide with the requirements of the Act. Further, the Sponsoring Jurisdiction agrees to abide with the Adopt-A-Highway Sign Standards printed on the reverse side of this sheet. The Sponsoring Jurisdiction also agrees to secure written commitments from participating groups to hold the State and the State's agents or employees harmless from any and all claims or action resulting from the program. Date: 4;',04C District Engineer • a . r AGREEMENT The City of Elgin (Sponsoring Jurisdiction) and 33rd Senate District Officd Group) , recognize the need for litter free highways and are entering into this Agreement in an effort to contribute toward maintaining litter free highways. By signature below, the Group acknowledges the hazardous nature of the work and agrees to the terms and conditions set by the Sponsoring Jurisdiction and the Illinois Adopt-A-Highway Act. The Group and its volunteers and agents shall assume all responsibility for, and hold the State of Illinois and the Sponsoring Jurisdiction (including their officials, employees and agents) harmless from, any and all claims or actions resulting from the Group's volunteers' or agents' work in the program, except for the negligent acts of the State of Illinois and the Sponsoring Jurisdiction (including their agents or employees) . Members of the Group are jointly and severally bound by the terms and conditions of this Agreement. The Group and the Sponsoring Jurisdiction will fulfill their respective responsibili- ties as set forth in Sections 25 and 30 of the Illinois Adopt-A- Highway Act. A copy of those sections is attached as an appendix and is expressly incorporated by reference. Helwig, City Manager SUBJECT: Adopt-A-Highway Agreements with IDOT, City of Elgin and 33rd Senate District Office PURPOSE The purpose of this memorandum is to provide the Mayor and members of the City Council with information to consider authorizing the 33rd Senate District Office to adopt a sec- tion of state highway in Elgin, under the sponsoring jurisdic- tion of the City of Elgin. BACKGROUND The State of Illinois passed legislation dated September 16, 1992 cited as the Illinois Adopt-A-Highway Act. This program allows private citizens to support local anti-litter efforts by allowing groups to adopt a section of highway for the purpose of litter collection. The City was contacted by State Senator Rauschenberger's office. They proposed adopting Route 31 from the northerly I-90 Tollway ramps to the northern City limits (north of Tollgate Road) , per the attached sketch. An agreement with IDOT is required and a copy is attached for your consideration. The Mayor's signature is required on behalf of the City. An agreement between the City and the Senator's office is also attached for your consideration. This agreement requires the signature of the City Manager. The Adopt-A-Highway program has been successful in Illinois, as well as throughout many states in the nation. We believe this program greatly improves the quality of life in our community. This is the eighth agreement to be processed, per eft the attached summary sheet which provides a status report on the overall program in Elgin. Adopt-A-Highway Agreements April 17, 1996 Page 2 rft The City will be obligated to install signs at each end of the adopted section with the name of the group displayed. The City will provide trash bags, safety vests and safety training. The City will collect the bags of trash a minimum of four times each year. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED 33rd Senate District Office. FINANCIAL IMPACT The estimated cost is $500 per year. Funds are available and would be charged to Account Numbers 010-3321-753. 19-08 (Traf- fic Control Materials) for two signs and 010-3331-754 . 33-02 (Refuse Services) for disposal. LEGAL IMPACT None. ALTERNATIVES None. RECOMMENDATION It is recommended that the City Council authorize the Mayor to execute the Adopt-A-Highway agreement between the City and IDOT, as well as for the City Manager to execute the agree- ment between the City and the 33r9-,Senate District Office.
