WHEREAS, City has determined that compulsive gambling is a serious social problem which is destructive not only to the individuals directly • ifected by such behavior, but which is also generally detrimental to the general safety and welf• e of the citizens of City; and WHEREAS,Provider provides prevention,outreac and treatment services for compulsive gambling; NOW, THEREFORE, in consideration of the mu • promises and covenants contained herein, the sufficiency of which is hereby acknowledg- 11, the parties hereto hereby agree as follows: 1. Provider shall furnish City reasonably •mpetent professional treatment and educational services for a period beginning on the date o' the agreement and ending December 31, 1996, which services are more particularly described in Appendix "A", which is attached hereto and made a part hereof. 1 2. City shall pay to Provider the sum of $49,111 on or before February 28, 1996. Provider shall not be entitled to any payment in ex -.s of said $49,100 pursuant to this Agreement. 3. Provider shall maintain detailed records an' receipts of all services and other expenditures provided directly and solely pursuant to �ty's fulfillment of the terms of this Agreement, and shall make such records and receipts av.• .ble to City for inspection and copying upon reasonable notice. 4. The Provider shall report program activities to ity on a quarterly basis, to the extent possible without violating the confidentiality of the clien •. 5. The Provider shall provide appropriate case anagement services including but not limited to the continuous evaluation of client progress hich leads to re-assessment and the development of new service plans, coordination of servi s, or other disposition. 6. The Provider shall comply with any and all ap a i'cable labor standards imposed by all Local, State, and Federal regulatory authorities. 7. Provider agrees that no person shall, on the g rounds of race, color, national origin, sex, age, disability, or handicapped status or religion be -xcluded from participating in, or be denied the benefits of, or be subjected to discrimination un'er any service, program, or activities funded with any portion of the funds received by the Pro 'der under this Agreement. 8. City shall have the right to cancel this Agreem-nt by written notice to the Provider, at any time, in City's sole and absolute judgment that e Provider has failed to perform, in City's sole judgment, in a timely fashion, any obligation •f the Provider under this Agreement. Such written notice from City to the Provider shall be e;fective on the first day of the month 2 immediately following the mailing of the written notice as provided hereafter, as of which first of the month, in such event, City shall have no further obli:ation under this Agreement, whether for the payment of money or otherwise. Provider sh. have the same right to cancel this contract by the giving of such written notice, to be effectiv- in the same fashion, on the first day of the month immediately following the mailing of the no ce. 9. This Agreement shall terminate on December 1, 1996, unless otherwise terminated as provided herein. 10. The Provider expressly agrees to defend, inde 0 .fy and hold City, as well as City's agents, employees, and assigns, harmless against any •r all claims (1) for bodily injuries (including mental health injuries or emotional distress) . d property damage, or any claim, whatsoever arising out of any services provided by Provi• -r under this Contract and any action taken by Provider pursuant to this Contract; (2) for viola ons of rights of privacy; (3) for any liability alleged to have resulted from negligence of Pro i'der; (4) willful acts of omissions of Provider in providing or failing to provide services on be alf of City, whether pursuant to this Contract or otherwise; (5) for contractual liability; and (61 workman's compensation claims of Provider's employees. The Provider shall procure and maintain at all tim s during the term of this Agreement insurance for comprehensive general liability insurance and •odily injury liability limits(including coverage for mental injury and emotional distress), of less than One Million Dollars ($1,000,000) per occurrence and Two Million Dollars $2,000,000) aggregate insuring the Provider and City, and their officers,'employees, and any olunteer while acting on behalf of the same, against any liability set forth in paragraph A, with •mpanies having at least an "A" rating 3 in the Best Guide. Provider shall provide certificates of• surance to City for all policies. Such certificates shall state, specifically, that 10 days advance n•tice shall be given to City in the event of cancellation, for whatever reason, of said policies. 11. The Provider shall promptly refund to the Puri haser: a. Any payments received by the Pr•vider as a result of any material misrepresentation or fraud contained in any s .tements, written or oral, made by the Provider or any of its agents, employees, o subcontractors to City. Provider acknowledges that payment is made under this Contract dependent also upon the proper qualifications of Provider's staf and employees. Material misrepresentation shall include, but not be limited to, the qualifications of Provider, employees, staff, and their a:ents. In addition, material misrepresentation shall also include the failure 'y Provider to perform reasonable quality of service which is determined subseq ent to payment of Provider's fee. b. If at any time, pursuant to this p. .graph, Provider owes a refund to City, City may set off same from any mo 'es otherwise due from City to Provider hereunder, in City's sole judgment. c. City shall be entitled to all other re edies which may be available by - law. 4 12. The terms of this agreement shall be severable. In the event any of the terms or provisions of this agreement are found to be void or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect. This training is given in two phases consisting of thirty ours a phase and takes place in St. Paul, Minnesota. Our Associate Director/Clinical Director has comple ed the first phase and will attend the second phase in June, 1995. She will provi.e supervision as well as direct service to gamblers. It will be necessary for the fu I time counselor to complete this training as well. As with all other addictions, any activity that is pleas rable will become uncontrollable for some percentage of the participating population Gambling activities include the lottery, bingo, parimutuel betting (horse and dog r.cing), sports betting, stock and bond speculation, and games of chance such as hose found on riverboats or in taverns. Estimates of addiction among gamblers range rom two to ten percent of those who gamble. Estimates vary by type of gambling, .nd the age or ethnic make-up of the gambler. For example, adolescents become co pulsive gamblers at three times the rate of adults. One thinks of debt as the primary problem associated with problem and compulsive gambling. Additional problems include criminal activity, failed marriages, stress related health problems for both the gambler and the gambler's ,family, and suicide which is 100 times the national average. Gambling, like all addictions, is a treatable iilness. Treatment consists of overcoming denial, establishing abstinence, identify ng and alleviating the factors in a patient's life that predispose him/her to problem g:mbling, restoring normal family functioning if possible, re-establishing a budget and paying off outstanding debts, and preventing relapse. The Renz Center intends to engage in the fo lowing activities as a means of addressing problem and compulsive gambling on m Itiple fronts. Treatment will be our primary activity. Treatment will consist of individual, group, and didactic interventions. Group therapy has traditionally been the most effective means of reducing a patient's denial. Group members model acceptance of the addiction for new members, and provide lessons on living an ab-tinent lifestyle. The group also provides emotional support as the consequences o a patient's negative behaviors resolve themselves; ie. legal entanglements, martal fallout, or debt reduction. Individual therapy focuses on the underlying issues ithin a patient's personality that predispose the patient to seek relief in gambling. The didactic portions of the program provide an additional intervention to lessen clients de ial, and to introduce living skills that will enhance recovery such as budgeting or i•entifying alternative (positive) behaviors. Our second activity will be public educatio and outreach designed move potential patients into treatment. Public education ill include lectures on the signs • and symptoms of compulsive gambling, and intervent on techniques for those who are concerned about a gambler's behavior. Intervention echniques will focus on moving the gambler into treatment, and/or enabling those wh s care about the gambler to take positive steps for themselves should the gambler resi.t entering treatment. Outreach will also be conducted to the gamblers themselves th ough public notices in gambling establishments and through gatekeepers such a . consumer credit counseling programs, employee assistance programs, the 1-801-GAMBLER Hotline (already in existence), and the court system. Our third area of effort will be general corn unity education and prevention. Much of the current prevention activity undertaken .y the Renz Center is designed to prevent all negative compulsive behaviors. The efore, the gambling treatment counselor will work in conjunction with our existin. prevention staff. For example, information about compulsive gambling will be distri•uted through current prevention activities. It is important to note that the Renz I enter takes no moral stand on gambling. It is our goal to disseminate accurate information so that our society as a whole can make informed decisions relative to gam'ling. Based on the number of calls we have recei ed to date, we feel that there is an immediate need for these types of services. It is unfortunate that an activity that is entertaining for the majority of people has a devast:ting effect on others. However, this has always been the case. Fortunately proolem or compulsive gambling is treatable, and the negative effects of gambling beh.:vior can be reversed over time. The City of Elgin deserves tremendous credit for ad o ressing this issue through funds generated by the riverboat. We look forward to providing these much needed services. Helwig, City Manager SUBJECT: Purchase of Service Agreement with Renz Center for Problem and Compulsive Gambling Program PURPOSE The purpose of this memorandum is to present a Purchase of Service Agreement with the Renz Center for a problem and compulsive gambling program. flok BACKGROUND In the 1995 Budget, the City Council identified the need for counseling services for individuals with addictive gambling problems. It is estimated by the Renz Center that three percent of people using regular gambling activities have a destructive need for gambling. They Renz Center has treated gamblers throughout its existence but- as part of treatment for alcohol and/or drug addiction. The treatment of gambling addiction is said to be similar to the treatment of other addictions. Education will be a sec- -ond main component to the effort along with counseling. Renz • will inform the public that help is available and alert peo- ple to symptoms of gambling addiction. Under the proposed PSA, Renz will hire one additional full-time counselor. COMMUNITY GROUPS/INTERESTED PERSONS CONTACTED The United Way of Elgin has been consulted and confirms Renz has a proven track record in the community and is capable of providing the services. FINANCIAL IMPACT The PSA for $49, 100 is within the budgeted $50,000 in the General Fund's Non-Departmental budget (010-6902-719 .89-02) . Provider agrees that no person sh• 11, on the grounds of race, color, national origin, sex, •a•e, disability, or handicapped status or religion be excluded from participating in, or be denied the benefits of, or be subjected to discrimination under any service, progr-m, or activities funded with any portion of the funds recei ed by the Provider under this Agreement. -2- 8. City shall have the right to ca cel this Agreement by written notice to the Provider, at any t me, in City's sole and absolute judgment that the Provider has failed to perform, in City's sole judgment, in a timely fash on, any obligation of the Provider under this Agreement. S ch written notice from City to the Provider shall be effecti e on the first day of the month immediately following the mai ing of the written notice as provided hereafter, as of which .irst of the month, in such event, City shall have no furthe obligation under this Agreement, whether for the payor.nt of money or otherwise. This Agreement shall terminate •n April 30, 1996, unless otherwise terminated as provided here n. :.' 10. The Provider expressly agrees to defend, indemnify and hold City, as well as City's their age ts, employees, and Assigns, harmless against any . or all clams ( 1) for bodily injuries (including mental health injuries or emotional distress) and property damage, or any laim, whatsoever, arising out of any services provided by •rovider under this Contract and any action taken by Provide . pursuant to this Contract; (2) for violations of rights of p ivacy; (3) for any liability alleged to have resulted f om negligence of Provider; (4) willful acts of omission- of Provider in providing or failing to provide service an behalf of City, -3- whether pursuant to this Contract or o , herwise; (5) . for contractual liability; and (6) workman's com!ensation claims of Provider's employees. The Provider shall procure and main ain at all times during the term of this Agreement insurance for comprehensive general liability insurance and bodily inju • liability limits (including coverage for mental injury and e ,otional distress) , not less than One Million Dollars ($1,000,010) per occurrence and Two Million Dollars ($2,000,000) aggr=gate insuring the Provider and City, and their officers, e ployees, and any volunteer while acting on behalf of the same, against any liability set forth in paragraph A, with c.mpanies having at least an "A" rating in the Best Guide. Pro ider shall provide certificates of insurance to City for al policies. Such certificates shall state, specifically, th-t 10 days advance notice shall be given to City in the even of cancellation, 4'4' for whatever reason, of said policies. ' ' - ' 11. The Provider shall promptly refund to the Purchaser: a. Any payments received by the Provider as a result of any material misrepresenta .ion or fraud contained in any statements, written •r oral, made by the Provider or any of its agents, employees, or subcontractors to City. Provider ack owledges that payment is made under this Contract •ependent also upon the proper qualifications of Pr•vider's staff and employees . Material misrepresentation shall include, but not be limited to, the "ualifications -4- of Provider, employees, staff, and their agents. In addition, material misrepresentation shall also include the failure by Provider to perform reasonable quality of service which . s determined subsequent to payment of Provider's fee b. If at any time, pursuant to t is paragraph, Provider owes a refund to City, Cit may set off same from any monies otherwise due from City to Provider hereunder, in City's sole judg ent. c. City shall be entitled t. all other remedies which may be available by law. 12. The terms of this agreement shall be severable. In the event any of the terms or provisions of this agreement are found to be void or otherwise unenforceable, the remainder of this agreement shall remain in full force an. effect. This training is given in two phases consisting of thirty hours a phase and takes place in St. Paul, Minnesota. Our Associate Director/Clinical Director has completed the irst phase and will attend the second phase in June, 1995. She will provide sup-rvision as well as direct service to gamblers.
