95-176 Resolution No. 95-176 RESOLUTION ACCEPTING INTEREST ARBITRATION OPINION AND AWARD AND AUTHORIZING CITY MANAGER TO PREPARE AND EXECUTE AGREEMENT WITH METROPOLITAN POLICE ASSOCIATION UNIT NO. 54 WHEREAS, representatives of the City of Elgin and representatives of the Metropolitan Police Association Unit No. 54 have met and discussed wages, fringe benefits and other working conditions; and WHEREAS, the parties submitted certain unresolved issues to binding arbitration for resolution; and WHEREAS, the arbitrator has issued an interest arbitration opinion and award dated June 27, 1995; and WHEREAS, the City Council has determined to accept said interest arbitration opinion and award and to proceed with the completion and execution of an agreement with the Metropolitan Police Association Unit No. 54 . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, the City Council of the City of Elgin hereby accepts the interest arbitration opinion and award dated June 27, 1995, and the City Manager is hereby directed and authorized to cause an agreement to be prepared and executed by the City Manager and the City Clerk with such agreement to provide for the terms as set forth in the interest arbitration opinion and award of June 27, 1995 and as set forth in the summary of agreement attached hereto. s/ Kevin Kelly Kevin Kelly, Mayor Presented: August 9, 1995 Adopted: August 9, 1995 Omnibus Vote: Yeas 7 Nays 0 Attest: s/ Dolonna Mecum Dolonna Mecum, City Clerk Summary of Agreement Between City of Elgin and Unit #54 Metropolitan Police Association Economic: 1 . Wages Effective December 26, 1993 = 3% Effective December 25, 1994 = 3% Effective December 24 , 1995 = 3% 2 . Full retroactivity back to December December 26 , 1993 . 3 . Health Insurance Increase Deductible to $200/$600 and Life Time Maximum to $500,000 . Language: 1 . Provide for Pick-up of Employee Pension contribution if Union obtains IRS approval . 2 . Formalize Department' s practice reference: a) Compensatory Time b) Split Shift 3 . Tighten up Sick Leave Language. 4 . Limit Maximum Hours - Worked to Eighteen Hours in any twenty-four hours . 5 . Provide for Fitness for Duty Test. 6 . Provide for Progressive Discipline and Opportunity to expunge records of oral reprimand in three years and written reprimand in four years . 7 . Residency required in the City of Elgin corporate limits within 18 months of hire. 8 . Provision for Association bulletin boards and designation of Stewards for each shift and special divisions . 9 . Modify grievance procedure. 10 . Modify Board of Fire and Police Commissioner' s clause to comply with State Statutes . The City succeeded in getting all the key issues that went into arbitration. . Issues City Union Award 2i 21 IL 1. Wages 3% 3% 3% 3%, 3%, Open City 2 . Retroactivity Not to Include Full Retroactivity Union Overtime Hours 3. Health Insurance Increase Deductible Maintain Deductible City from $100 Family to at $100 Family $600 Family. 4 . Off Duty Calls Delete contract Maintain Status Union provision providing Quo for one-half hour pay at time and a half for all duty, duty related, telephone calls. 5. Call Outs Exempt voluntary Maintain Status Union participation in Quo either meetings or training from call out pay. 6 . Sick Leave Retain current All unused sick City Conversion practice. time paid at final hourly rate per accelerating schedule. 7. Holidays Retain current Add one additional City number ( 11) of holiday. holidays. 8. Legislative Mandates not No Union Mandate covered by agree- ment shall be subject to bargaining before implementation, It is interesting to note that the parties had reached and understanding on item 5 and that despite the City' s offer to drop items 2, 4 and 8 to avoid arbitration, the Union insisted on their position nn wages and health insurance.
