95-151 Resolution No. 95-151 RESOLUTION APPROVING CHANGE ORDER NO. 1 IN THE CONTRACT WITH ATEC ASSOCIATES, INC. FOR ENVIRONMENTAL SERVICES FOR 280 SOUTH GROVE AVENUE WHEREAS, the City of Elgin has heretofore entered into a contract with ATEC Associates, Inc. for environmental services. for 280 South Grove Avenue; and WHEREAS, it is necessary and desirable to modify the terms of the contract as is described in Change Order No. 1, attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,- ILLINOIS, that Richard B. Helwig, City Manager, be and is hereby authorized and directed to execute Change Order No. 1, a copy of which is attached hereto and made a part hereof by reference. sl Kevin Kelly Kevin Kelly, Mayor Presented: July 12, 1995 Adopted: July 12, 1995 Vote: Yeas 7 Nays 0 Attest: sl Dolonna Mecum Dolonna Mecum, City Clerk ELGIN, ILLINOIS ADDITIONAL SERVICES FOR 280 SOUTH GROVE AVENUE CHANGE ORDER NO. 1 - SCOPE: This Change Order No. 1 covers additional services required at the former Bunge Tire site located at 280 South Grove Avenue under a contract awarded on December 18, 1993 . The Contractor for this project is ATEC Associates, Inc. of Downers Grove, Illinois . REASONS FOR CHANGE: This Change Order is required for the additional costs associated with the items requested of ATEC to complete the following work. The additional work was required due to IEPA regulation and information requirements . 1. Additional work associated with the removal of the under- ground storage tanks (USTs) at 280 South Grove Avenue. This element of the project included the proper removal and off-site disposal of the 5 USTs . The disposal of 60 cubic yards of contaminated soil and 5 drums of sludge was also part of the scope of work. It was necessary to remove a total of 450 cubic yards of contaminated soil, 2 additional drums of sludge and 1 additional UST. The total of these changes resulted in an addition of $15,498. 30 to this task. 2. Additional work associated with the management and over- sight of the underground storage tank removals at 280 South Grove Avenue. ATEC original estimate of 20 hours was exceeded by 79 .75 hours (for a total of 99 .75 hours) . This time was exceeded due to additional time to perform oversight of the excavation and removal of addition- al soils at the site, the removal of an additional UST, free product removal oversight and free product sampling. The total of these changes resulted in an addition of $2,986 .75 to this task. 3. Additional work associated with the installation of groundwater monitoring wells at 280 South Grove Avenue. The Illinois Environmental Protection Agency ( IEPA) required that a total of four groundwater monitoring wells be installed at 280 South Grove Avenue. ATEC's original contract included the installation of two groundwater monitoring wells . In addition, the groundwater monitoring wells were subsequently resampled due to the discovery of an additional UST. The total of these changes in material and labor ( 33 hours) resulted in an addition of $3,400.84 to this task. 4. Additional work associated with the reporting require- . ments to the IEPA. ATEC's contract included the completion of the 45-day report and a final report. ATEC 's original estimate of 64 hours was exceeded by 60.5 hours ( for a total of 124 .5 hours) . This time was exceeded due to the preparation of an extensive site classifica- tion plan and performance of the activities required by the site classification plan. ATEC required additional time to complete the activities and submit these reports to the IEPA and discuss the reports with the IEPA to expedite the site classifi- cation process. The total of these changes resulted in an addition of $3,871.05 to this task. S. Additional work associated with site preparation. ATEC performed work associated with site preparation which included material, analytical costs, and a total of 237 .5 hours . These hours were utilized on the following activities . Due to groundwater contamination in the four shallow groundwater monitoring wells, IEPA required the installation of a fifth groundwater monitoring well at a depth of 30 feet. In addition, due to con- struction activities on the site, one damaged well was abandoned and replaced. Charges included ma- terial and labor for installation, purging and sampling of wells. As part of the preparation of the CAP, slug tests were performed on two wells at the site. ATEC performed an electronic geophysical survey to locate any additional USTs at the property. In addition to the geophysical survey costs, additional time was spent by ATEC to determine the source of the anomalies located during the geophysical survey. ATEC also incurred labor costs and analytical costs during the removal of the UST located during the survey. ATEC required labor time to complete and submit the necessary information to the IEPA regarding the site investigation plan, free product report, Correction Action Plan, and Early Action Update Report for the site. In addition, costs were incurred for the preparation of the reimbursement package for the site. Labor costs also included discussions with the IEPA to expedite the Corrective Action process . A new task was opened for the above-referenced activities resulting in a cost of $30, 180 .40 . 6. Free product evaluation During groundwater sampling activities, free product was encountered in one of the monitoring wells . The monitoring well was bailed on three occasions to remove the free product from the monitoring well (a total of 16 hours) . A new task was opened resulting in a cost of $1, 121 . 45. By reason of Change Order No. 1 the contract for the additional services will be increased in the amount of Fifty-Six Thousand Nine Hundred Ninety-Two and 79/100 Dollars ($56,992 .79) . The new revised contract total will be Eighty-Three Thousand Five Hundred Eighty-Seven and 75/100 Dollars ($83,587 . 75) . .s 1 OTHER CONTRACT PROVISIONS: All other contract provisions shall remain the same. Helwig, City Manager SUBJECT: Change Order No. 1 for Additional Services at 280 South Grove Avenue (Former Bunge's Tire) PURPOSE The purpose of this memorandum is to forward to the Mayor and members of the City Council Change Order No. 1 for additional services at the City of Elgin property located at 280 South Grove Avenue. BACKGROUND ATEC Associates, Inc. (ATEC) was awarded a project which included the proper removal and off-site disposal of five underground storage tanks (USTs) "and 60 cubic yards of contam- inated soil, the installation of two groundwater monitoring wells, and staff oversight of the remediation efforts. The project also involved the preparation of a 45-day report. Additional work was authorized by the City of Elgin to be performed to allow for this parcel to be included under the Corrective Action Plan (CAP) that was being developed for the adjoining riverboat properties (206-240 South Grove Avenue) . This additional work was required by the Illinois Environmen- tal Protection Agency (IEPA) . It was imperative that the work at this property be completed to allow for inclusion of the Bunge's site under the lease with Elgin Riverboat Resort. ATEC, under the direction of the City of Elgin, completed the IEPA requirements and the property was included in the lease contract. The majority of the cost increase within Task 1 related to the increase in the amount of contaminated soil that had to be taken off site. The increases in Tasks 4 and 5 are the result of changed IEPA reporting standards for the Bunge's site. The contamination at the Bunge's site was discovered after changes in IEPA site investigation and reporting requirements Change Order No. 1/280 South Grove June 13, 1995 Page 2 were adopted in September of 1993. A very detailed site classification reporting procedure was required. Also, addi- tional consulting time was required to coordinate the inclu- sion of the Bunge's site into the Corrective Action Plan for the riverboat project. Attached is Change Order No. 1 from ATEC regarding additional services. The change order includes six items with a total net cost of $56,992.79. This is the final change order for this contract. ATEC will be present at the meeting of July 12, 1995 to an- swer any questions you may have regarding the change order. COMMUNIff GROUPS/INTERESTED PERSONS CONTACTED None. FINANCIAL IMPACT The change will result in a $56,992.79 increase in the con- tract with ATEC from $26,594 .96 to $83,587.75. The activities described in Items 1 through 6 should be eligible for reim- bursement from the Illinois Leaking Underground Storage Tank Fund. Submittal for reimbursement have been prepared and sent to the IEPA in the amount of $500,587 .32 for the South Grove project area. However, the submittal of the cancelled check verifying payment to ATEC for work performed is necessary prior to the IEPA processing payment to the City of Elgin. The expenses related to this change order will be charged to the Capital Improvement Fund #385, project number 039501. Any reimbursement received from IEPA will be credited to Fund 385. LEGAL IMPACT None. RECOMMENDATION it is recommended that staff be directed to execute Change Order No. 1 for the additional services. Respectfully submitted, Raymond H.
