RESOLUTION
AUTHORIZING EXECUTION OF CONTRACT AMENDMENT #4 FOR
SOLID WASTE COLLECTION SERVICES WITH WASTE MANAGEMENT - WEST
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Richard B. Helwig, City Manager, and Dolonna
Mecum, City Clerk, be and are hereby authorized and directed
to execute Contract Amendment #4 on behalf of the City of
Elgin with Waste Management - West for solid waste collection
services, a copy of which is attached hereto and made a part
hereof by reference.

CONTRACT AMENDMENT #4
CITY OF ELGIN
COLLECTION AND DISPOSAL OF GARBAGE AND REFUSE
CURBSIDE RECYCLING COLLECTION PROGRAM
This contract amendment (hereinafter referred to as "Fourth
Amendment" ) agreement is made and entered into this Aa1vvt) day of
, 1994 by and between the City of Elgin, Illinois, a
municipal corporation, (hereinafter referred to as "City" ) and
Waste Management-West, a Division of Waste Management of Illi-
nois, Inc. , a Delaware Corporation formerly known as Elgin
Wayne Disposal (hereinafter referred to as "WMW" ) .
WITNESSETH, THAT WHEREAS, the CITY and WMW have previously
entered into a Solid Waste Collection Services Contract dated
the 14th day of February, 1990 for Collection and Disposal of
Garbage and Refuse and Curbside Recycling Collection Program,
(hereinafter referred to as the "CONTRACT" ) .
WHEREAS, the terms of said CONTRACT currently extend until
December 31, 1998; and
WHEREAS, the present terms of the CONTRACT do not accurate-
ly reflect changed economic conditions and current municipal
refuse needs of the CITY; and
WHEREAS, the circumstances making this change necessary
were not reasonably foreseeable at the time the contract was
signed; and
NOW THEREFORE, in consideration of the mutual promises and
covenants contained herein, the sufficiency and receipt of
which are hereby acknowledged, the CITY and WMW agree that:
Additional Scope of Services
The contract is hereby amended such that tires are deleted
from the list of items WMW may haul to the landfill due to
recently enacted legislation. Tires shall be collected
from those residents covered by the City garbage collec-
tion policy separately by WMW. The City shall pay WMW for
each tire so collected as follows :
$15 . 00 per automobile tire ( $20 . 00 w/rim)
$ 5 . 00 for each additional tire (per location)
$40 . 00 per overside truck or tractor tire
$10 . 00 for each additional truck tire (per location)
Therefore, the City of Elgin and WMW mutually agree to modify
the tire collection program as outlined herein at a cost as
outlined above to the City of Elgin.
In witness whereof, the parties hereto have caused this AMEND-
MENT to be executed as of the day and year hereinabove set
forth.

SUBJECT: Solid Waste Collection Services Tire Disposal
PURPOSE
The purpose of this memorandum is to outline legislative
changes relative to tire disposal and to provide a proposal
to accommodate those requirements as part of the City' s Solid
Waste Collection Program.
BACKGROUND
Section 53 of the Illinois Environmental Protection Act
states that it shall be the policy of the State of Illinois
to require the recovery, recycling and reuse of materials
from scrap vehicle tires . Therefore, effective July 1st,
1994, waste tires cannot knowingly be mixed with municipal
waste. Sanitary landfills cannot accept such tires for dis-
posal .
The General Assembly was considering legislation whereby the
July 1, 1994 deadline was to be extended to March 1, 1995 .
It is now apparent this legislation will not be adopted and
we must comply with the July 1st date. Both appliances and
tires are encompassed in this landfill ban.
The contract with Waste Management West (WMW) (Paragraph 00 .
Change in Service) authorizes WMW to negotiate a price adjust-
ment when changes are made to the method of handling materi-
als to be collected. The change imposed by the IEPA consti-
tutes a major change in the method of handling tires .
Per the letter from WMW dated June 20, 1994, three options
have been identified for tire disposal that will comply with
Section 53 of the IEPA Act:

Option A: Exchange old tires for new at the dealer or retail-
er.
Option B: Return tires to an existing retailer in town.
There will be a small charge and they will include
the tires with their scrap tires .
Option C: Waste Management-West will be collecting scrap
tires for subsequent shipment to a tire shredding
and recycling company. Shredded tires can then be
used in asphalt roadways and various other recy-
cling opportunities .
Residents will be required to contact Waste Management-West
in advance to arrange for a special pickup of their tires .
The cost for collection of scrap tires is proposed as follows :
$15 . 00 per automobile tire ( $20 . 00 w/rim)
$ 5 . 00 for each additional tire (per location)
$40 . 00 per oversize truck or tractor tire
$10 . 00 for each additional truck tire (per location)
Contract Amendment #3 (copy attached) dated March 31, 1993
states in Item 11 . that tire disposal would be reviewed and
negotiated pending requirements of new legislation. Attached
is a proposed Contract Amendment #4 which summarizes the plan
outlined above.

FINANCIAL IMPACT
It is estimated there would be 75 tires per month, or a cost
of $9, 000 for the balance of this year. Funding would be
from the Refuse Services Collection Account No.
010-3331-754 . 33-02 .

RECOMMENDATION
It is recommended that the City Council approve the plan
proposed by WMW for the special collection of tires and au-
thorize the City Manager and City Clerk to execute Contract
Amendment #4 .

The State of Illinois has banned the disposal of scrap tires in
Illinois landfills. The new legislation takes effect on July 1 ,
1994 . There had been speculation that both acts may be postponed
until more markets were available for these products. It now
appears we will need to cumply with the July 1st, 1994 , effective
date.
Specifically, Section 53 of the Illinois Environmental Protection
Act states that. . .

We have identified the following methods of tire disposal that will
comply with Section 53 of the IEPA Act.

their scrap tires.
Option C: Waste Management-West will be collecting scrap tires for
