94-19 Resolution No. 94-19 RESOLUTION AUTHORIZING EXECUTION OF AN EMPLOYMENT AGREEMENT WITH NASAKHOUNE SIPHENGPHONE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Robert 0. Malm, Interim City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an Employment Agreement on behalf of the City of Elgin with Nasakhoune Siphengphone for her services as a community outreach worker, a copy of which is attached hereto and made a part hereof by reference. s/ George VanDeVoorde George VanDeVoorde, Mayor Presented: January 26, 1994 Adopted: January 26, 1994 Vote.: Yeas 6 Nays 0 Attest: s/ Dolonna Mecum Dolonna Mecum, City Clerk EMPLOYMENT AGREEMENT WHEREAS, the City Council of the City of Elgin, Illinois, a municipal corporation (hereinafter referred to as "City" ) desires to employ Nasakhoune Siphengphone as a Community Outreach Worker for the City pursuant to an agreement between the City and the Elgin YWCA; and WHEREAS, Nasakhoune Siphengphone is willing to accept appointment as a Community Outreach Worker for the City upon certain terms and conditions; and WHEREAS, the employment of Nasakhoune Siphengphone, as a Community Outreach Worker for the City upon the terms and conditions recited herein, is in the best interests of the City. NOW, THEREFORE, for and in consideration of the mutual covenants contained herein, the City, and Nasakhoune Siphengphone agree as follows : 1 . That for and in consideration of the salary established by the City as it may be amended from time to time, and the other terms and conditions contained herein, Nasakhoune Siphengphone agrees to act as a Community Outreach Worker for the City and to exercise all the powers and to carry out to the best of her ability all the duties imposed upon her as a Community Outreach Worker. The Community Outreach Worker shall : a. Provide social services to residents of the City of Elgin with emphasis on those requiring bilingual Lao assistance. b. Provide translation/interpretation for Southeast Asian victims, families and offenders as assigned. c. Inform Elgin Southeast Asian refugee community of victim and witness rights and victim compensation programs . d. Assist with domestic violence and child abuse cases . e. Provide liaison and referral service with other community agencies . f. Conduct youth outreach and provide criminal justice system diversion through intervention, counseling and education. g. Provide intercultural awareness and educa- tion activities . h. Maintain detailed files and records. i . Submit monthly, quarterly and annual reports . j . Perform other duties as assigned. k. Begin providing services on December 6, 1993. 2 . The City shall provide the following: a. A monthly salary in the amount of $1,814 .80 to be paid in equal biweekly installments . Page 2 of 3 b. All benefits currently provided to Elgin Management Group "C" employees, except that the Community Outreach Worker shall not be provided a 401A plan. 3. Further, the Community Outreach Worker shall be governed by the City's Personnel Manual, except that the benefits received shall be those herein identified. 4 . This agreement shall terminate at 5:00 p.m. on June 30, 1994, commencing December 6, 1993; provided, however, that this agreement shall be terminable at will upon written notice by either party. Malm, Interim City Manager SUBJECT: Laotian Outreach Worker Employment Agreement PURPOSE This is to execute a new employment agreement for Nasakhoune Siphengphone, the new Community Outreach Worker. BACKGROUND In December of 1993, the City of Elgin and the Young Women's Christian Association (YWCA) entered into an agreement con- cerning the Refugee Targeted Assistance Grant, whereby the City of Elgin became a subprovider to the YWCA concerning this grant. At that time, the city had a Laotian Outreach Worker who was working in that capacity from the previous contractual agreement. The Laotian Outreach Worker who was fulfilling the contract tendered his resignation, and a new Outreach Worker has filled the position, thereby necessitat- ing the execution of a new employment agreement. FINANCIAL IMPACT The contract period for which the YWCA Refugee Crime Preven- tion Project Agreement with the City of Elgin have entered into is from October 1, 1993, to June 30, 1994. For that time period, the following monies have been budgeted in the Police MID/Juvenile Division (2304) : Community Outreach Worker Salary $16,263.00 Fringe Benefits 7,014.00 Total Agreement Costs $23,277.00 LEGAL IMPACT The Legal Department has reviewed the attached agreement.
