BACKGROUND: Based on the recommendations of the 1992 Comprehensive Water Master Plan, it is proposed that the Public Works/Water Department proceed with Phase 600, Supplementary Services. This initial phase of improvements to the Airlite Street Water Treatment Plant consists of the installation of a second power feed to the plant and the conversion of the existing high service pumping station into a dual level pumping facility serving both the high service level and the west booster district. These design and construction phase services as described in the attached amendment #4 are a result of previous assessments performed within Phase 450, Airlite water treatment plant evaluations. FINANCIAL IMPACT: Total cost for these services is $65,900, with $35,700 for design and $30,200 for the construction phase. The Public Works/Water Department's 1993 budget contains $325,000 under appropriation #420-0000-771.9200-409002 for the Airlite treatment plant upgrades. These costs shall not be exceeded without written authorization from the director of public works. This change order includes six items with a net decrease in the contract amount. The changes have been discussed with Black & Veatch and we are in agreement with the items as listed. The proposed change order represents a total decrease of $1 ,712.00 in the contract amount. Each item is described within the change order, including the reason for the changes. We are requesting that the City Council review this material at their next meeting. It is recommended that Change Order No.4 be approved by City Council action. For your information, the approval of Change Order No. 4 would decrease the total amount of Contract No.5 with Seagren/Shales, Inc. from $803,565 to $801 ,853. This Change Order No. 4 - FINAL covers additions and modifications to the above Contract as follows: Item 1. The failed bin vibrator for the lime storage hopper shall not be replaced under warranty. Item 2. A portion of the specified operator training to be furnished by the instrumentation supplier shall be deleted. Item 3. The amount of crack repair work stipulated in the Contract shall be adjusted to reflect the actual amount of repair work performed. Item 4. The estimated amount of .work performed under Item No. 5 of Change Order No. 1 shall be adjusted to reflect the actual amount of work performed. Item 5. The warranty period for the supervisory control panel shall run from July 1, 1984 to July 1, 1985. Item 6. The final completion date for the project shall be extended to May 16, 1985. REASONS FOR CHANGE. Item 1. The lime handling system operates satisfactorily without the vibrator. The Owner, therefore, agrees to accept a credit for the vibrator in lieu of replacement under warranty. Item 2. The operating staff is sufficiently familiar with the installed instrumentation equipment such that additional training is deemed unnecessary. Therefore, the Owner agrees to accept a credit in lieu of the remaining portion of the operator training specified to be furnished by the instrumen- tation supplier. Item 3. The amount of crack repair work was estimated and the amount to be included in the base bid was stipulated in the Contract. The stipulated amount is hereby adjusted to reflect the actual amount of crack repair found to be required as the work progressed. (ELGIN, ILLINOIS ) (WATER WORKS IMPR. ) (CONTRACT NO. 5 ) C04-1 •. J Item 4. Item No. 5 of Change Order No. 1 provided for additional basin repair work found necessary during an investigation conducted as required as a part of the Contract. The repair work was to be performed on a time and materials basis with a total cost not to exceed $20,000. The Change Order amount of $20,000 based upon estimated quantities of work shall be adjusted to reflect the actual quantities of work performed. Item 5. The warranty period for the supervisory control panel is to be in effect from July 1, 1984 to July 1, 1985. This time period was discussed with and agreed to by the Contractor in a meeting of March 5, 1985 between the Owner and the Contractor. Item 6. The Contract time shall be extended to allow for completion of additional remedial work. SUMMARY OF CHANGES IN CONTRACT AMOUNT. WITNESSETH: That the Owner employed the Engineer to perform engineering services related to evaluation, expansion, and improvements to the Owner's water treatment plants and distribution facilities. As supplementary services under Phase 600 of the Agreement the Owner has requested that the Engineer provide design and construction phase services for selected improvements to the existing Airlite water treatment plant. The specific improvements involved in this initial phase of plant improvements consist of the installation of a second power feed to the plant and the conversion of the existing high service pumping station into a dual level pumping facility serving both the High Service Level and the West Booster District within the City's distribution system. In response to these supplemental services, certain revisions must be made to the Agreement. In compliance, therefore, the terms and conditions of the Agreement are modified as specifically set out below. All other parts of the Agreement remain unchanged. ATTACHMENT A - SCOPE OF SERVICES Under Phase 600 - Supplemental Services, expand the referenced original phases and tasks by adding the following design and construction phase services relative to improvements to the existing Airlite water treatment plant. The design of the second power feed will consist of adding a new 2,000 KVA outdoor transformer and connecting the secondary (2,400 volts) to the existing 2,400 volt switch presently serving the engine-generator. The existing engine-generator will be disconnected and removed under the construction contract. The design will provide for replacing the existing power company 2,000 KVA, PCB contaminated, transformer with a new transformer. The design will provide for installation of a new 2,400-480 volt 1,000 KVA transformer inside the plant building located in a portion of the area vacated by the engine-generator. A new 480 volt motor control center (MCC) will be designed to replace the existing MCC with a minimum of plant down time. The new MCC will be located along the north wall of the current storage room adjacent to the electrical room. The new MCC will be tested and made operational prior to transferring the individual loads, one at a time, from the existing MCC. The design will take into account that some cables entering the existing MCC may be embedded in the concrete slab and will not be available for extension to the new W3RDR030393 1 MCC. For these cases a completely new run of cable/conduit will be required. Cables entering the existing MCC from the top should be available for extension to the new MCC by cutting the existing conduit at an appropriate location, installing a small splice box, and extending the new cable/conduit to the new MCC. After all the loads have been transferred to the new MCC, the existing 750 KVA transformer, existing MCC, and the existing south wall of the storage room will be removed. The design will provide for new cable/conduit to the new high service pump motors. The conversion of the existing high service pumping facilities to a dual pumping facility will involve the removal and replacement of existing pumps No. 1 , 3, and 5 with new higher head pumps. Two of the pumps will be replaced with 700 gpm and 1,400 gpm pumps rated at 230 feet of head. The third pump will be replaced with a 2,100 gpm pump rated at 230 feet of head. New pump motor starters will be provided in the new motor control center. The new pumps will be initially controlled from the Alft Lane elevated tank water level through a new leased telephone line provided by the Owner. The suitability of the existing Alft Lane level transmitter and telemetry system for use in controlling the new pumps will be reviewed and any necessary modifications will be included in the design. The existing pump control switches, lights, and relays in the existing Airlite plant control panel will be reused as much as is practical. Any necessary modifications to the existing controls at the Airlite plant will be included in the design. The scope of services for this extended phase of the water works improvement project is as follows. Work under any particular phase will not proceed until Owner has authorized Engineer in writing to proceed. PHASE 1 DESIGN, CONSTRUCTION DRAWINGS AND SPECIFICATIONS The design phase will consist of the design of modifications to convert the City's existing Airlite high service pumping facilities to a dual level pumping facility to supply water to the distribution system High Service Level and West Booster District and to install a second power feed to the Airlite plant. A. Preliminary and General Items 1. Consult with the Owner to clarify understanding of scope and parameters of the project and review pertinent available data. 2. Participate in an informal meeting with the Owner to review progress and exchange ideas and information and coordinate work to be performed by others. 3. Coordinate the design of the second power feed with the Owner and power company. Perform an economic analysis to determine W3RDR030393 2 if ownership of the primary transformers should be by the Owner or the power company. B. Design Memorandum 1. Prepare a design memorandum to establish agreement on scope, parameters, performance requirements, and project approach. Submit three copies to the Owner for review. 2. Secure Owner's comments and approval of the design memorandum. Resolve any questions, revise document if necessary, and resubmit three copies to the Owner. C. Construction Drawings and Specifications 1. Prepare detailed drawings and specifications for the proposed construction work and for all equipment required based on the approved design memorandum. The documents will be prepared for construction by private contractors on a competitive bid basis. 2. All construction work, including equipment purchase, will be performed under one contract. 3. Prepare an opinion of probable construction cost for the proposed work covered by the drawings and specifications. 4. Provide three (3) sets of drawings and specifications to the Owner for review. 5. Following the review of the completed documents, secure the Owner's comments and resolve any questions. 6. After conference with the Owner, make any necessary modifications and submit three sets of revised detail drawings and specifications to Illinois Environmental Protection Agency (IEPA) for review and two sets to the Owner for record. 7. After receipt of IEPA's review comments and Owners second review comments, revise if necessary and resubmit if necessary three sets to the IEPA and two sets to the Owner. 8. Upon completion of the review of the drawings and specifications, review the opinion of probable construction cost and revise and expand as required. W3RDR030393 3 PHASE 2 CONSTRUCTION PHASE SERVICES A. Preaward Services 1. Conduct, at a date and time selected and a place provided by Owner, a pre-bid conference for the project. 2. Coordinate bid letting date, time, and place with the Owner and prepare final Invitation to Bid. 3. Provide 30 sets of construction contract drawings and specifications for bidding purposes. 4. Interpret construction contract drawings and specifications, and provide written responses to questions from bidders requiring clarification during the bidding period. Prepare and issue addenda to the construction contract documents when required. 5. Prepare and distribute five conforming copies of the construction contract documents. These services will include review of Contractor's bonds, furnishing the Contractor unsigned construction contract documents, and transmitting the construction contract documents to the Owner for signature and distribution. 6. Distribute five sets of the bid issue construction contract drawings and specifications with any addenda to the successful bidder. B. Project Administration The Engineer will provide selective project administration services during the construction phase of the project to assist the Owner in administering the project during construction. By performing these services, the Engineer shall not have authority or responsibility to supervise, direct, or control the Contractor's work or the Contractor's means, methods, techniques, sequences or procedures of construction. Engineer shall , however, inform Owner of any construction deficiencies performed by Contractor which are observed by Engineer. The Engineer shall not have authority or responsibility for safety precautions and programs incident to the Contractor's work or for any failure of the Contractor to comply with laws, regulations, rules, ordinances, codes or orders applicable to the Contractor furnishing and performing the work. Specific services to be performed by the Engineer are as follows: 1. Review the Contractor's insurance certificates and forward the certificates to the Owner for acceptance by the Owner's legal counsel . The Engineer's review of the insurance certificates is only for the purpose of determining if the W3RDR030393 4 Contractor maintains the general types and amounts of insurance required by the specifications, and is not a legal review to determine if the Contractor's insurance coverage complies with all applicable requirements. 2. Evaluate bids and make written recommendations to Owner concerning contract award. 3. At a date and time selected by the Owner and at a facility provided by the Owner, attend a preconstruction conference and assist the Owner during the conference. The Owner shall prepare an agenda for the conference and prepare and distribute minutes. The preconstruction conference will include a discussion of the Contractor's tentative schedules, procedures for transmittal and review of the Contractor's submittals, processing payment applications, critical work sequencing, change orders, record documents, and the Contractor's responsibilities for safety and first aid. 4. Make periodic visits to the construction site to observe progress of the work and consult with the Owner and Contractor concerning problems and/or progress of the work. A total of three one day site visits is anticipated. 5. Review drawings and other data submitted by the Contractor as required by the construction contract documents. The Engineer's review shall be for general conformity to the construction contract drawings and specifications for the project and shall not relieve the Contractor of any of his contractual responsibilities. Such reviews shall not extend to means, methods, techniques, sequences, or procedures of construction or to safety precautions and programs incident thereto. 6. Receive and review guarantees, bonds, and certificates of inspection, tests, and approvals which are to be assembled by the Contractor(s) in accordance with the construction contract documents, and transmit them to the Owner. 7. Interpret construction contract drawings when requested by the Owner or Contractor. If authorized by the Owner and the Contractor, the Engineer may interpret construction contract drawings and specifications upon request by subcontractors and suppliers. 8. Assist Owner in the processing of change orders, including applications for extensions of construction time. 9. Upon completion of the project, revise the construction contract drawings to conform to the construction records. Submit a copy of the mylars to the Owner. W3RDR030393 5 10. Act as initial arbiter on all claims of the Owner and the Contractor relating to the acceptability of the work or the interpretation of the requirements of the construction contract documents pertaining to the execution and progress of the work. 11. Upon substantial completion, inspect the construction work and prepare a listing of those items to be completed or corrected before final completion of the project. Submit results of the inspection to the Owner and Contractor. 12. Make revisions to drawings and specifications occasioned by the acceptance of substitutions proposed by the Contractor; and after the award of the contract in evaluating and determining the acceptability of substitutions proposed by the Contractor. PHASE 3 SUPPLEMENTAL SERVICES A. Any work requested by the Owner that is not included in one of the items listed in any other phase will be classified as supplemental services. B. Supplemental services shall include but are not limited to: 1. Additional meetings with local , State, or Federal agencies to discuss the project. 2. Appearances at public hearings or before special boards. 3. Supplemental engineering work required to meet the requirements of regulatory or funding agencies that become effective subsequent to the date of this agreement. 4. Special consultants or independent professional associates requested or authorized by the Owner. 5. Assistance with bid protests and rebidding, preparation for litigation, arbitration or other legal or administrative proceedings, and appearances in court or at arbitration sessions. 6. Provision, through a subcontract, of laboratory and field testing required during design, during construction and any special reports or studies on materials and equipment requested by the Owner. 7. Visits to the construction site and to the Owner's location in addition to the number of one day trips set out in other phases of the contract scopes. W3RDR030393 6 8. Services resulting from significant delays, changes or price increases occurring as a direct or indirect result of material , equipment or energy shortages. 9. Additional or extended services during construction made necessary by (1) work damaged by fire or other cause during construction, (2) a significant amount of defective or neglected work by any Contractor, (3) acceleration of the process schedule involving service beyond normal working hours, (4) default by any Contractor and (5) failure of the Contractor to complete the work within the construction contract time. 11. Evaluation of unusually complex claims or an unreasonable or extensive number of claims submitted by the Contractor or others in connection with the work. 12. Changes in the general scope, extent of character of the project or its design including, but not limited to, changes in size, complexity, the Owner's schedule, character of construction or method of financing; and revising previously accepted studies, reports, design documents or construction contract documents when such revisions are required by changes in laws, rules, regulations, ordinances, codes or orders enacted subsequent to the preparation of such studies, reports or documents designs or are due to any other causes beyond the Engineer's control. 13. Services resulting from the Contractor's failure to complete shop drawing and engineering data submittal requirements with no more than one resubmittal on any specific submittal requirement. In the event that more than one resubmittal is required, the Owner shall pay the Engineer for the review of the additional resubmittals as supplemental services. The Owner shall then recover these charges from the Contractor as stipulated in the construction contract documents. ATTACHMENT 8 - COMPENSATION Under Subparagraph C of the Agreement, the following establishes the compensation for the additional work. For these supplemental services, as identified hereinbefore, the Owner agrees to pay an amount equal to the Engineer's salary costs times 2.83 plus reimbursable expenses at cost and plus subcontract billings times 1.05. The maximum amount to be invoiced for the supplemental services under Phase 1 of Attachment A, Design, shall not exceed $35,700 without further authorization from the Owner. The maximum amount to be invoiced for the supplemental services under Phase 2 of Attachment A, Construction Phase Services, shall not exceed $30,200 without further authorization from the Owner. For expanded supplemental services as described under Phase 3 of Attachment A, Supplemental Services, an amount equal to the Engineer's salary costs W3RDR030393 7 times 2.83 plus reimbursable expenses at cost and plus subcontract billings times 1.05. Each item of supplemental services shall be specifically authorized by the Owner, and a maximum billing limit shall be established before the work is started. The amount billed for each item of supplemental services shall not exceed the amount established for it without further authorization. Additional amounts for supplemental services may be authorized, if necessary, as the work progresses. Under Subparagraph D, Item 2 of the Agreement, the reimbursable expense for motor vehicles on a milage basis shall be changed from 26 cents per mile to 28 cents per mile. Under Subparagraph I of the Agreement, submittal of the design documents for review shall be 45 days following notice to proceed. Construction phase services are based on a construction period of not more than 12 months. ATTACHMENT C - OWNER'S RESPONSIBILITIES The Owner will be responsible for the administration and management of the construction phase of the project and will be assisted by the Engineer as indicated hereinbefore. In association with the additional supplemental services as identified hereinbefore, the Owner will furnish, as required by the work and not at the expense of the Engineer, the following items in addition to applicable items listed under the Agreement: 21. Legal advertisement of project letting or bid date and such other publications of the "Invitation To Bid" as desired by the Owner. 22. Identify potential contractors and suppliers, and distribute copies of Invitation to Bid. Maintain a record of prospective bidders and suppliers to whom drawings or specifications have been issued. 23. Distribute plan holders' lists to recipients of drawings and specifications prior to bid opening. 24. Receive deposits for construction contract drawings and specifications. Process refunds, if applicable, to unsuccessful bidders. 25. Review and evaluate the qualifications of the apparent successful bidder and the proposed major or specialty subcontractors. 26. Prepare and distribute formal bid tabulation sheets, evaluate bids and make written recommendations concerning contract award. W3RDR030393 8 27. Hall or auditorium space for preconstruction conference and the equipment required for such conference. 28. Review and process the Contractor's monthly payment requests. 29. Royalties and fees for patented processes used in the work, except those required to be paid by construction contractors as part of the construction contract. 30. Shop, mill , or laboratory inspection of materials, laboratory and field testing, field sampling services. 31. Review the Contractor's construction schedule, activity sequence, and construction procedures as applicable to the Owner's ability to keep existing facilities in operation. 32. Administer the processing of change orders, including applications for extensions of construction time. Evaluate the cost and scheduling aspects of all change orders and, where necessary, negotiate with the Contractor to obtain a fair price for the work. 33. Upon completion or correction of the items of work on the punch list, conduct final inspection to determine if the work is completed. Provide written recommendations regarding final payment, including a list of items, if any, to be completed prior to the making of such payment. 34. Furnish a Resident Project Representative to observe and review the Contractor's work and perform the services listed below. a. Conduct onsite observations of the general progress of the work and determine if the work is proceeding in accordance with the construction contract documents. b. Serve as the Owner's liaison with the Contractor, working principally through the Contractor's superintendent. Transmit the Engineer's clarifications and interpretations of the construction contract documents to the Contractor. c. Assist the Engineer in serving as the Owner's liaison with the Contractor when the Contractor's operations affect the Owner's onsite operation. d. As requested by the Engineer or Contractor, assist in obtaining from the Owner additional details or information when required at the jobsite for proper execution of the work. W3RDR030393 9 e. Consult with the Contractor, giving opinions and suggestions based on his (Resident Project Representative's) observations regarding defects or deficiencies in the Contractor's work and relating to compliance with drawings, specifications, and design concepts. f. Advise the Engineer and the Contractor or his superintendent immediately of the commencement of any work requiring a shop drawing or sample submission if the submission has not been accepted by the Engineer. g. Assist and offer guidance to the Contractor in establishing the necessary base lines and control points which will be used as datum for the work. Actual construction staking will be done by the Contractor. i . Visually inspect materials, equipment, and supplies delivered to the worksite. Reject materials, equipment, and supplies which do not conform to the construction contract documents. j. Coordinate onsite materials testing services during construction. Copies of testing results will be forwarded to the Owner and Engineer for review and information. k. Observe field tests of equipment, structures and piping, and review the resulting reports, commenting to the Owner as appropriate. 1 . Attend the preconstruction conference, and assist the Engineer in explaining administrative procedures which will be followed during construction. m. Attend progress meetings, and other meetings when deemed necessary, with the Owner and the Contractor to review and discuss construction procedures and progress scheduling, engineering management procedures, and other matters concerning the project. n. Submit to the Engineer weekly construction progress reports containing a summary of the Contractor's progress, general conditions of the work, problems, and resolutions or proposed resolutions of problems. q. Report to the Engineer whenever work is known to be defective or does not meet the requirements of any inspections, tests or approval required to be made or has been damaged prior to final payment, and advise the Engineer when the work should be corrected or rejected W3RDR030393 10 or should be uncovered for observation, or requires special testing, inspection, or approval. r. Review applications for payment with the Contractor for compliance with the established procedure for their submission and forward them with recommendations to the Owner, noting particularly their relation to the schedule of values, work completed, and materials and equipment delivered to the site but not incorporated into the work. u. Maintain a marked set of record drawings and specifications at the jobsite based on data provided by the Contractor. This information will be combined with information maintained by the Contractor and a master set of record documents produced by the Engineer. v. Maintain a diary or log book of events occurring at the jobsite. w. Before the Owner issues a Certificate of Substantial Completion, submit to the Contractor a list of observed items requiring completion or correction. x. Assist the Owner in conducting final inspection in the company of the Owner and the Contractor, and prepare a final list of items to be completed or corrected. y. Verify that all items on the final list have been completed or corrected and make recommendations concerning acceptance.
