RESOLUTION
AUTHORIZING AN AGREEMENT WITH JOSH DUNSON FOR A PERFORMANCE
BY KATHERINE DAVIS AND SIDNEY JAMES WINGFIELD
FOR THE FINE ARTS FESTIVAL
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that it hereby authorizes Larry L. Rice, City
Manager, and Dolonna Mecum, City Clerk, to execute an
agreement with Josh Dunson for a performance by Katherine
Davis and Sidney James Wingfield for the Elgin Fine Arts
Festival, a copy of which is attached hereto and made a part
hereof by reference.

PERFORMANCE AGREEMENT
This agreement is entered into this 24d�
day of
1993, by and between the City of Elgin, Illinois,
a municipal, corporation (hereinafter referred to as "city") ,
and Josh Dunson, an agent (hereinafter referred to as Agent) ,
acting on behalf of Katherine Davis and Sidney James
Wingfield, performers .
Now therefore, in consideration of the mutual prom-
ises and covenants contained herein, the sufficiency of which
is hereby acknowledged, the parties hereto agree as follows;
I . Agent shall provide for a performance of Kathe-
rine Davis and Sidney James Wingfield at the Elgin Fine Arts
Festival, Civic Centex plaza in Elgin, Illinois on August 28,
1993, beginning at 2 : 00 p.m. including a twenty minute inter-
mission.
2 . Agent will assume all costs for the transporta-
tiOn of the musicians, including air fare and ground transpor-
tation, to and from Elgin.

3 . City shall pay to the sum of $650 on or
before August 28, 1993. Such sum of shall constitute full
payment.
4 . This Agreement shall not constitute nor be
construed as an employment, joint venture or partnership
agreement between the parties hereto.

5 . Agent shall not conduct any marketing, promo-
tional or other activities related to the event without prior
agreement from the Hemmens Program Coordinator.
6 . Additional Terms : The artists shall be allowed
to sell recordings at no charge to them. A professional sound
system of high quality for music presentation complete with
two speakers, one monitor speaker facing Ms. Davis (so she can
hear herself on stage) , one vocal microphone with cord, one
vocal microphone with boom, two instrumental microphones for
the piano, and a monitor, as we use an in-tune piano (see
piano specs attached) shall be provided.
7 . In the event of sickness or of accident to
artist, or if a performance is prevented, rendered impossible
or infeasible by any act or regulation of any public authority
or bureau, civil tumult, strike, epidemic, interruption in or
delay of transportation services, war conditions or emergen-
cies or any cause beyond the control of artist, it is under-
stood and agreed that there shall be no claim for damages by
performer against city.
8 . Each provision of this agreement shall be con-
sidered severable, and if any of the provisions contained
herein are determined to be void, illegal or otherwise unen-
forceable for any reason, the remainder of this agreement
shall be valid and enforceable, and shall remain in full force
and effect.
9 . This agreement shall be subject to and governed
by the laws of the State of Illinois .

SUBJECT: Parking for the Arts Festival
PURPOSE
To request approval from the City Council to allow for
free parking in all City-operated pay parking facilities
during the Elgin Fine Arts Festival.
BACKGROUND
The Elgin Fine Arts Festival is scheduled to be held
August 27, 28 and 29 . On August 27, the kick-off event will
be an evening concert by the Elgin Symphony Orchestra. Activ-
ities on August 28 and 29 will take place all day. The festi-
val will provide entertainment and activities to acquaint the
public with different art forms and encourage future partici-
pation in the arts. Except for performance of the Elgin
Symphony Orchestra in Hemmens, all events and activities will
be free. Last year the festival drew an estimated 5,000
people over the two days.
In order to accommodate the parking needs of festival-go-
ers, downtown parking lots will be promoted for festival
parking. In order to provide an additional incentive to
attend the event, festival planners see an advantage to offer-
ing free parking. This would include those lots and facili-
ties which are normally attended on Saturday and for which
there is a charge for parking.
FINANCIAL IMPACT
The City would lose the revenue for the parking on Satur-
day, August 28. Using April, 1993 as a sample, average reve-
nue from Saturday parking at attended parking facilities
(Civic Center parking lot and Spring Street parking deck) was
$896 .75.

RECOMMENDATION
Staff recommends that no fee be charged at attended lots
on Saturday, August 28, 1993.

Elgin Fine Arts Festival
Councilman Gilliam made a motion, seconded by Councilman
Walters, to endorse the Arts Festival and to contribute the sum
of $25, 000 as budgeted. Yeas : Councilmembers Fox, Gilliam,
Moylan, Walters, Yearman, and Mayor VanDeVoorde. Nays : None.
Funding Procedure for the Elgin Symphony Orchestra
Councilwoman Moylan made a motion, seconded by Councilwoman
Yearman, that funding for the Elgin Symphony Orchestra be
allocated and earmarked through the Elgin Cultural Arts
Council . Yeas : Councilmembers Fox, Gilliam, Moylan, Walters,
Yearman, and Mayor VanDeVoorde. Nays : None.
Limestone mining at the Sports Complex
Councilman Gilliam made a motion, seconded by Councilwoman
Yearman, to file an application with the Land Use Committee for
mining limestone at the Sports Complex site in place of gravel,
which has almost run out. Yeas : Councilmembers Fox, Gilliam,
Moylan, Walters, Yearman, and Mayor VanDeVoorde. Nays : None.
Discussion on the vacation of a portion of Frazier Street
Councilman Walters made a motion, seconded by Councilwoman
Moylan, to file an application for special use and right-of-way
vacation at no expense to the Fox River Walter Reclamation
District. Yeas : Councilmembers Fox, Moylan, Walters, and Mayor
VanDeVoorde. Nays : Councilmembers Gilliam and Yearman.
Use of asset forfeiture funds for the development/presentation
of a seminar on gangs and drugs
Councilman Gilliam made a motion, seconded by Councilman
Walters, to table this matter to the next meeting. Yeas :
Councilmembers Fox, Gilliam, Moylan, Walters, Yearman, and Mayor
VanDeVoorde. Nays : None.
Adjournment
Councilman Walters made a motion, seconded by Councilwoman
Yearman, to adjourn the meeting and go into the regular Council
meeting. Yeas : Councilmembers Fox, Gilliam, Moylan, Walters,

ties which are normally attended on Saturday and for which
there is a charge for parking.
