RESOLUTION
AUTHORIZING EXECUTION OF RELEASE FROM
STAR DELIVERY & TRANSFER, INC.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that George VanDeVoorde, Mayor, and Dolonna Mecum,
City Clerk, be and are hereby authorized and directed to
execute a release on behalf of the City of Elgin with Star
Delivery & Transfer, Inc. for all clean-up expenses associated
with fuel spill of February 17, 1993, a copy of which is
attached hereto and made a part hereof by reference.

THREE CENTS
COMES NOW the undersigned . CITY .OF ELGIN and for
full and adequate consideration, receipt and sufficiency of which is hereby
acknowledged, does hereby release and forever discharge STAR DELIVERY AND
TRANSFER, INC. AND ART MADDOX from any and
all liability whatsoever, including all claims, demands and causes of action
of every nature, which the undersigned, his heirs, assigns and successors may
have or ever claim to have, known or unknown, resulting from or related to a
certain accident on or about the 17 day of FEBRUARY 19 93 , as
follows: ALL.CLEAN- UP EXPENSES ASSOCIATED WITH FUEE SILL / A release only for
City of Elgin cleaup expenses at the spill site incurred on February 17, 1993. Star
Delivery and Transfer, INc. to provide for proper disposal of materials.
FURTHER, the undersigned hereby agrees:
14 That the above-stated consideration is all the consideration that
will be received by the undersigned for this Release and no promise for any
further or other consideration has been made by anyone.
2: That this Release does not constitute an admission of liability on
the part of any person or entity.
3. That this Release is being executed solely in reliance upon the
knowledge, belief and judgement of the undersigned and not upon any repre-
sentation made by any party.

Subject: Release Authorizations on behalf of the City of Elgin

Purpose:
Signature of the Mayor and City Clerk on a Resolution
authorizing execution of release from Star Delivery and
Transfer, Inc. and signatures affixed to the release itself.
Background:
On or about February 17, 1993 the City of Elgin Fire Department
responded to a fuel spill within the confines of the City of
Elgin. The spiller was billed for services amounting to Three
hundred sixty-five dollars and three cents (;365.03) .
Star Delivery and Transfer, Inc. has submitted a release form
which requires the signatures of the appropriate City Officials.
According to the City Legal department, the Mayor and City Clerk
are the appropriate parties.
The release is included with this memorandum.
Before the release can be signed a resolution must be adopted.
The resolution, in brief, releases Star Transfer and Delivery,
Inc. for clean-up expenses associated with the above mentioned
spill. The Resolution is included with this memorandum.
Financial Impact:
The $365.03 will not be released from Star Delivery without a
release.
Recommendation:
That the Mayor and City Council adopt the Resolution and upon
doing so, the Mayor and City Clerk sign and witness the release
elk form for Star delivery and Transfer, Inc.

MEMORANDUM
TO: Gerald Knust, Deputy Chief
FROM: William A. Cogley, Assistant Corporation Counsel
SUBJECT: Hazardous Materials Expense Recovery
Pursuant to your request, attached find a Resolution
authorizing execution of a release from Star Delivery and
Transfer, Inc. regarding expenses recovered for a hazardous
materials clean-up. Please note that I have revised the
release by deleting the reference to the Elgin Fire Department
in the second paragraph and inserting in lieu thereof the City
of Elgin.
The Fire Department should prepare an appropriate memorandum
for the Council regarding this matter.
