93-153 Resolution No. 93-153 RESOLUTION AUTHORIZING EXECUTION OF AN INTERGOVERNMENTAL AGREEMENT WITH THE COUNTY OF KANE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that George VanDeVoorde, Mayor, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute an Intergovernmental Agreement on behalf of the City of Elgin with the County of Kane for orthophoto topographic mapping services, a copy of which is attached hereto and made a part hereof by reference. s/ George VanDeVoorde George VanDeVoorde, Mayor Presented: May 26, 1993 Adopted: May 26, 1993 Omnibus Vote: Yeas 7 Nays 0 Recorded: Attest: s/ Dolonna Mecum Dolonna Mecum, City Clerk INTERGOVERNMENTAL AGREEMENT BY AND BETWEEN THE COUNTY OF KANE, STATE OF ILLINOIS AND THE CITY OF ELGIN, KANE COUNTY, ILLINOIS WHEREAS, the County of Kane (hereinafter called "County") , has contracted for the conversion of cadastral and topographic land data into an interactive computer graphics data base with the Sidwell Company, known as the Kane County Geographical Information System (hereinafter called "Kane County G.I.S. ") . WHEREAS, the City of Elgin (hereinafter called "City") , a home rule municipality located within the territorial boundaries of the County of Kane and County of Cook, wishes to use, and participate in the use of, the data base created under the Kane County G.I.S. for land areas within its corporate and planning jurisdiction; and WHEREAS, the County of Kane and City of Elgin find that it is in their respective best interests to enter into an Agreement for the purpose of allowing the City to utilize the data base and concurrent information generated from the Kane County G.I.S. project. WHEREAS, the County of Kane has been authorized to enter into an Intergovernmental Agreement with the City of Elgin for the above purpose in Resolution 93-159, passed unanimously by the Kane County Board on May 11, 1993 . NOW, THEREFORE, in consideration of the mutual promises hereinafter made, the recitals of fact hereinabove set forth, and other good and valuable consideration, the receipt of which is hereby acknowledged, the parties agree as follows: 1. The County of Kane agrees to permit, and cooperate with the City of Elgin in the use of the County's data base for the interactive computer graphics of cadastral and topographic land data for the geographic area within the City's corporate limits and planning jurisdiction, as such data base is provided and modified by the Sidwell Company under its contract with the County of Kane for the Kane County G.I.S. project. 2 . That in connection with this Agreement, the County shall provide to the City the following: A. Cadastral Data Base Kane County shall provide a digital copy of its cadastral data base to Elgin for the Kane County portion of the City's general and long range planning area. The cadastral data base is based on a precision ground control network and provides a more positional accurate data base than the City is presently using. 1 The area to be provided specifically includes: T42N R7E - Rutland Township - Sectiions 13-17, 19-36 T42N R8E - Dundee Township - Sections 17-36 T41N R7E - Plato Township - Sections 1-5, 8-17, 22-26 T41N R8E - Elgin Township - Sections 1-36 The data shall be provided in DXF or MicroStation format, which is the GIS software format that Kane County uses for its GIS system. Although the City of Elgin uses AutoCad software for their GIS system, both the County and City have verified that data from the two systems are compatible with one another. Kane County shall also provide: * One complete set of bound composite cadastral map prints covering the same area. * Customized third party GIS software for use of the cadastral data base (this software may not be of value to Elgin, as it works with MicroStation, not AutoCad) . * Cadastral data base documentation - schema. * Assessment attribute data pertaining to all parcels defined specifically for the Kane County portion of the Cadastral data base shall be made available to the City. The City agrees to provide the computer structure necessary for the joint exchange of data between Kane County and Elgin. The Supervisor of Assessments shall deliver ownerships, mailing addresses and addresses of property annually on an ascii file, on disk. B. Topographic Data Base Kane County shall provide a digital copy of its topographic mapping data base for the City's general and long range planning area. This topographic mapping data base contains two foot contour interval data with spot elevations. It was created to National Map Accuracy Standards. The area to be provided specifically includes: T42N R7E - Rutland Township - Sections 13-17, 19-36 T42N R8E - Dundee Township - Sections 17-36 T42N R9E - Barrington Township - Section 31 T41N R7E - Plato Township - Sections 1-5, 8-17, 22-26 T41N R8E - Elgin Township - Sections 1-36 T41N R9E - Hanover Township - Sections 5-8, 17-20, 29-32 2 The data shall also be provided in DXF or MicroStation format. Kane County shall also provide: * One complete set of bound composite topographic map prints at 1"=400' covering the area identified above that falls within Kane County. * One complete set of existing horizontal and vertical monument and benchmark recovery sheets covering the area identified above that falls within Kane County. The monuments referenced by these sheets were established in 1985 as part of Kane County's GIS program. Additional monumentation shall be provided and described later in this Agreement. C. Color Aerial Mosaic A color aerial mosaic shall be prepared from a new Spring of 1993 aerial flight. Photography shall be obtained at 1"=2, 000' negative scale and cover the entire area identified below. The mosaic shall be produced at a scale of 1"=600' with approximate dimensions of 6 feet by 6 feet. Overlapping image along with a white border and title block can be used to expand the width to fit into a 6 foot by 8 foot frame. The title block shall include the City's name, scale of the mosaic, date of photography, scale of photography, north arrow and contractor's name and logo. Delivery to the City's municipal building is included. The specific coverage area for this mosaic includes: T42N R7E - Rutland Township - Sections 24, 25, 36 T42N R8E - Dundee Township - Sections 19-36 T42N R9E - Barrington Township - Section 19, 30, 31 T41N R8E - Elgin Township - Sections 1-36 T41N R9E - Hanover Township - Sections 5-8, 17-20, 29-32 D. Additional Orthophoto Topographic Mapping Services New aerial photography shall be taken in the Spring of 1993 to support compilation and updating of topographic mapping at a two foot contour interval. This photography shall be obtained at a negative scale of 1"=900' . All aerial negatives shall be labeled on the north edge and numbered west to east. The exposures shall be mechanically labelled to include from left-to-right, the date of the photography, the camera focal length, the City's name, negative scale, the Contractor's project number and the numerical sequence. One set of 60% overlap coverage contact prints of the 1"=900' photography shall be provided to the City. All horizontal and vertical control positions necessary to support the generation of two foot contours and an orthophoto base shall be established. In addition, placement and measurement of permanent monumentation shall be completed. A minimum of twenty (20) permanent control monuments shall be installed and measured. 3 The horizontal coordinates for the monuments shall meet or exceed 1/50,000 positional accuracy. The coordinates shall be established on these monuments through Global Positioning Surveys. Appropriate field locations or existing permanent concrete structures which are distributed evenly throughout the project area and lie within the public rights-of-way shall be selected. The monuments shall consist of a brass cap with a stem grouted into concrete or a cap set in the ground with 6 foot of rebar. Horizontal control, necessary to complete the mapping, shall be established to meet or exceed 1/50,000 positional accuracy. This horizontal control shall be established by Global Positioning System technology on post-flight photo-identifiable positions. The horizontal datum shall reference the 1927 North American Datum. Vertical control, necessary to compete and update the topographic mapping, shall be established to meet or exceed 3rd order accuracy. This control shall reference mean sea level vertical datum of 1929 and originate and terminate on U.S.G.S. control stations. A copy of all survey records and a set of new Monument Recovery Sheets shall be provided to the City. In addition to a digital copy of the topographic mapping data base, Kane County shall provide a set of reproducible orthophotos at a scale of 1"=100' with topographic data superimposed on the orthophoto base. These orthophoto topographic map sheets shall be produced on reproducible double matte finish mylar, 36" x 36" in size with an image area not to exceed 30" x 30" . Each sheet shall depict one USPLSS quarter section. Each sheet shall be framed and include a title block showing the scale, contour interval, date of photography, sheet index. , City name, Contractor name and other appropriate data. The image area for each map sheet shall have a minimum of 1" overlap to the adjacent sheets. All sheets shall be oriented with north at the top of the map. Marginal annotations shall be oriented to read from the bottom or the right side of the map sheets. The orthophoto topographic map sheets shall be referenced by the USPLSS township, range, section and quarter section identification number. The quarter section 1"=100' orthophoto topographic mapping coverage area shall include: T42N R7E - Rutland Township - Sections 24, 25, 36 T42N R8E - Dundee Township - Sections 19, W 1/2 20, W 1/2 29, 30-36 T42N R9E - Barrington Township - Section 31 T41N R8E - Elgin Township - Sections 1-33 T41N R9E - Hanover Township - Sections 5-8, 17-20, 29-32 4 Specific items that Kane County shall provide to the City of Elgin under this category include: * One set of 9" X 9" black and white contact prints of 1"=900' flight. * One set of new survey documentation. * One set (20) of new survey monument recovery sheets. * One set of 236 reproducible black and white quarter- sectional orthophoto composite map sheets at a scale of 1"=100' . 3 . In consideration of said use, the City of Elgin agrees to pay to the County the sum of Two Hundred Forty Six Thousand, Four Hundred Dollars ($246,400.00) . 4. Payment by the City to Kane County for said data base shall be as follows: One Hundred Thousand ($100, 000. 00) on June 1, 1993; Fifty Thousand ($50,000.00) on September 1, 1993, and Ninety Six Thousand, Four Hundred ($96,400.00) on March 1, 1994. 5. The City further agrees that it shall pay to Kane County, as and for an annual maintenance fee to the project, the sum of One Dollar ($1.00) for each tax parcel within Elgin Township. For said maintenance fee, the County shall provide an updated digital copy of the pre-defined area of the Kane County cadastral data base with the pre-defined attribute data annually. Said annual maintenance fee shall be payable within thirty (30) days of delivery of each updated cadastral map base. Said annual maintenance Agreement between the City and the County shall last for seven (7) years from 1994-2001. Said Agreement shall be renewable upon a mutual agreement of the parties. 6. The parties agree that the County of Kane shall have no responsibility to provide any computer hardware or software to the City of Elgin for the Kane County G.I.S. project. 7. The City agrees that Kane County GIS data or products shall be used for governmental purposes only and that it would not sell, transfer or otherwise publish said data or products obtained through this Agreement to any other agency or person. 8. This Agreement shall terminate at the end of seven years or upon mutual agreement of the parties.
