. AUTHORIZING EXECUTION OF AMENDMENT #2 TO AN AGREEMENT WITH
ELGIN WAYNE DISPOSAL
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Larry L. Rice, City Manager, and Dolonna Mecum,
City Clerk, be and are hereby authorized and directed to
execute Amendment #2 to an Agreement for Solid Waste
Collection Services on behalf of the City of Elgin with Elgin
Wayne Disposal for appliance disposal, a copy of which is
attached hereto and made a part hereof by reference.

Contract Amendment #2
City of Elgin
Collection and Disposal of Garbage and Refuse
The CONTRACT AMENDMENT #2, made as of the , day of
c, ,„( L_of 1992, by and between the City of Elgin, Illinois
( ereinafter called the CITY) and Elgin Wayne Disposal, Elgin,
Illinois (hereinafter called EWD) .
WITNESSETH, THAT WHEREAS, the CITY and EWD have previously
entered into a Solid Waste Collection Services Contract dated
the 14th day of February, 1990 for Collection and Disposal of
Garbage and Refuse and Curbside Recycling Collection Program.
Whereas, the Solid Waste Collection Contract includes a section
covering appliance disposal by EWD and EWD' s responsibilities
and whereas EWD has identified the following additional servic-
es and associated costs:
Additional Scope of Services
A. The present contract with Elgin Wayne Disposal (EWD)
requires the collection of up to two (2) large appli-
ances (white goods) per Stop per week. The City pays
EWD $7 .52 per Stop per month to collect household
garbage, including a maximum of two (2) large appli-
ances, each week.
B. The contract is hereby amended such that appliances
including refrigerators, freezers, air-conditioners
and de-humidifiers are deleted from the list of large
items EWD can haul to the landfill due to recently
enacted legislation. These four heretofore mentioned
appliances will be collected from those residents
covered by the City garbage collection policy sepa-
rately by EWD to remove refrigerant gases from same.
The City shall pay EWD $25 . 00 for each appliance so
collected.
The circumstances making this change necessary were not reason-
ably foreseeable at the time the contract was signed.
Therefore, the City of Elgin and Elgin Wayne Disposal mutually
agree to modify the appliance collection program as outlined
herein at a cost of $25.00 per appliance to the City of Elgin.
In witness whereof, the parties hereto have caused this AMEND-
MENT to be executed as of the day and year hereinabove set
forth.
