"; .nd WHEREAS, Elgin and Rockford are permitted, pursuant to the provisions of Illinois Revised Statute , Chapter 127 , Paragraph 741 et seg. , to enter into agree ents to perform any intergovernmental service, activity, or un•erstanding which either of them entering into this agreement is a thorized by law to per- form, and to exercise jointly any powers, privileges, or authority which either of them is authorized to perfo m; and WHEREAS, Elgin is licensed by th- FCC to use 956 . 35625 MHz (call sign WNTJ 201) frequency; and WHEREAS, Rockford desires to use said frequency as part of a multiple address system for traffic sinal communications; and WHEREAS, THIS Agreement is intend-d to meet the require- ments of FCC regulation 94 . 63. NOW, THEREFORE, in consideration of the mutual covenants and provisions contained herein the parties agree as follows: I . DUTIES OF ELGIN: 1. Elgin hereby agrees to a low Rockford to use the frequency 956 . 35625 MH for its multiple ad- dress system for traffic signa communications. II . DUTIES OF ROCKFORD: 1. Rockford agrees to use frequency 956. 35625 MHz only as part of a mul iple address system for traffic- signal communisations using a two (2) watt transmitter with : master station at the intersection of Alpine Road and Harrison Avenue (42° 14 ' 18" latitude & :9° 01 ' 16" longitude. ) 2. Rockford hereby agrees t at in the event of any interference between Rock ord's use of said fre- quency and Elgin's use t ereof, Rockford agrees to take all steps necessa y to correct the inter- ference and to cease use if interference is not eliminated within reasonable period of time. 3. Rockford agrees to abide by all state & federal laws & regulations, incl ding but not limited to all FCC regulations in t e establishment, use & maintenance of said fre•uency for its multiple address system for traffi• signal communications. III. TERM: The term of this Agreement sh. 11 be one ( 1) year from the date of execution, and shall automatically be renewed for a like term, excep' either party may termi- nate this Agreement upon th' rty (30) days written notice to the other. In no event shall the term of this Agreement be more than tw:-nty (20) years. IV. BACKGROUND: The City has been operating 2 signalized intersections with radio interconnection for two years under a license from the Federal Communications Commission (F.C.C. ) . For your information, three new radio controlled signal locations are being constructed as part of the Big Timber Road Reconstruction project. The City of Rockford is interested in radio controlled traffic signals and have applied to the F.C.C. for their own frequency but has found that the City of Elgin received one of the last frequencies (956 . 35625 MHz) . Based on their desire to install radio controlled signals they have submitted a request to share the frequency. A copy of a letter and proposed Intergovernmental Cooperation Agreement requesting the sharing of the frequency are attached for your consideration. The usual separation of this type of telemetry devices without interference is approximately 10 miles. The nearest signal location to the City of Elgin from Rockford is more than 40 miles. The staff and the personnel at Bell and Gustus (the supplier of the radio equipment) feel that there will be no problems with this agreement. The agreement contains language to protect the City of Elgin if there is any problem with our system because of the Rockford operation. A copy of the agreement has been forwarded to Corporation Counsel for their review and comment. Mayor and Members of the City Council August 21, 1992 Page 2 FINANCIAL IMPACT: None.
