APPROVING CHANGE ORDER NO. 10 IN THE CONTRACT WITH
WIL-FREDS FOR THE SLADE AVENUE WATER FACILITY
WHEREAS, the City of Elgin has heretofore entered into a
contract with Wil-Freds for the Slade Avenue Water Facility;
and
WHEREAS, it is necessary and desirable to modify the
terms of the contract as is described in Change Order No. 10,
attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that Larry L. Rice, City Manager, be
and is hereby authorized and directed to execute Change Order
No. 10, a copy of which is attached hereto and made a part
hereof by reference.

By provisions of the Illinois Criminal Code, whenever there is a change in a
contract other than as specifically provided for in the contract which
authorizes or necessitates an increase or decrease in the cost of $10,000 or
more or in the time of completion by 30 days or more, a written
certification must be made that the circumstances said to necessitate the
change in performance were not reasonably foreseeable at the time the
contract was signed, were not within the contemplation of the contract as
signed or are in the best interest of the city. The certification should
recite the particular reasons for the determination made.

Additional time and material incurred for modification to existing Wells 1-6.
The original design and bid of this facility did not include complete demolition
and modification to the existing well sites. The City determined during shop
drawing review that it would be less costly to the City to have the Contractor
on site perform the necessary modifications. These modifications will also make
overall site landscaping, to be performed in 1992, easier due to the deteriorating
condition of the existing well houses. The overall site will also become more
asthetically pleasing at the completion of the project. These modifications will
also facilitate easier access for future repairs to the wells due to the elimination
of the well houses and more convenient layout for access to the electrical control
equipment. Therefore, it is in the best interest of the City to perform this
work as a part of this contract.

Per Drawings W-1 & W-2 showing well modifications for the above referenced
project we offer the following proposal:
All labor, materials, equipment, and supervision to perform all work as
shown. This includes additional demolition and fill, 13'-3"x13'-0" slabs
on grade with mesh and stone, expansion joints, fences and gates, CA-6
stone around perimeters with weed barrier, precast valve vaults as required
with stone base and concrete tops with frames and grates, warning signs,
and multiple mobilizations to complete required work.
All the above for the sum of $71,438.78 with the breakdown as follows:

We further request 60 additional calendar days to be added to our completion
time. This time assumes one day each to shutdown and change over from well to
well. Any further delay would have to be added on.
We trust this meets with your approval and await issuance of a change order.
This proposal may be withdrawn in 30 days if not accepted or an additional time
extension may be required.
