91-1218 Kovilic Construction RESOLUTION
APPROVING CHANGE ORDER NO. 1B IN THE CONTRACT WITH
KOVILIC CONSTRUCTION FOR THE LYLE AVENUE BOOSTER STATION
WHEREAS, the City of Elgin has heretofore entered into a
contract with Kovilic Construction for the Lyle Avenue Booster
Station; and
WHEREAS, it is necessary and desirable to modify the
terms of the contract as is described in Change Order No. 1B,
attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELGIN, ILLINOIS, that Larry L. Rice, City Manager, be
and is hereby authorized and directed to execute Change Order
No. 1B, a copy of which is attached hereto and made a part
hereof by reference.

contract other than as specifically provided for in the contract which
authorizes or necessitates an increase or decrease in the cost of $10,000 or
more or in the time of completion by 30 days or more, a written
certification must be made that the circumstances said to necessitate the
change in performance were not reasonably foreseeable at the time the
contract was signed, were not within the contemplation of the contract as
signed or are in the best interest of the city. The certification should
recite the particular reasons for the determination made.
Identify circumstances, etc. , as required above:
Item #1 - PVC sanitary pipin0 was specified under the building slab and foundation
as bid. This did not meet compliance with Cit., building code and was not reasonably
foreseeable at the time the contract was signed.
Item #2 - After bid acceptance, an independent distribution study by Black & Veatch
indicated that a water main is required connecting to the pipin„ installed by this
contract. This is accomplished more e=ficiently and soundly during initial
installation of the station „iping than cuttin,-, in at a later date. This item was
not within the contemplation of the contract as signed and is in the best interest
of the City.
Item #3 - After bid acceptance a flaw in the design of the roof required chan,es,
which incorporate additional time and material, for the long-term benefit of the
buildin0. This item was not reasonably foreseeable at the time the contract was
signed and is in the best interest of the City.
Item #4 - During construction of the roof, it was discovered that facia was not
specified ror the two skylights in the roof. This was not reasonably foreseeable
at the time the contract was signed.

Items #5 & 7 - The „roject as specified did not account for a control relay panel

These were not reasonably foreseeable at the time the contract was signed.
Item #6 - The specifications, as bid, did not meet compliance with the City building
code, which requires a spare electrical conduit from the transformer pad to electric
meter. This was not reasonably foreseeable at the time the contract was signed.

SUBJECT: LYLE AVENUE BOOSTER STATION CHANGE ORDERS
PURPOSE:
This memorandum will provide the Mayor and Council with
information to discuss and consider for authorizing change
orders to the existing contract for construction of the Lyle
Avenue booster station.
BACKGROUND:
A contract was awarded to Kovilic Construction on December 19,
1989, for construction of the Lyle Avenue booster station. This
addition to the water distribution system is required for the
establishment of the west pressure zone with its higher ground
elevations.
During construction several items required changes due to
differences between the specifications and City code, water main
expansion, and design deficiencies.
The first item is a change in sanitary piping below the
building, from PVC to cast iron, to conform to City code.
The second item is an addition of a 16" valve, vault, and
appurtenances determined to be required for system expansion
after the contract was executed.
The third item, the roof design, was determined inadequate
during construction and required structural modifications
incorporating improved details and components for the long-term
benefit of the building.
The fourth item is the addition of aluminum fascia at each of
the skylights to reduce maintenance.

Dear Dennis:
Per your request of August 20, 1991, the following breakdown is submitted for
your reference:
The modifications to the roof design entailed a total construction cost of
$10,424.00. Donohue accepted responsibility for $4,547.00 of this cost in our
filik memorandum of May 21, 1990.
A relay panel was required in the valve separation vault in order to transmit
the required signals to the booster station. Donohue accepted responsibility
for 100% of the cost, or $1,387.00.

The combined total of Donohue's liability is $5,934.00. This corresponds with
the amount outlined in our letter of April 3, 1991.
