The contractor for this project is Ainley Tank Test- ing & repair Inc. , Algonquin, IL. These invoices and waivers will need to be processed by September 27. envl,unmental Safely into the gist Century A Elva5unt Agenda Item No. D ( Q0) or-L7'p ft \r!D September 20, 1991 MEMORANDUM TO: Mayor and Members of City Council FROM: City Manager SUBJECT: Change Order No. 1 - Underground Storage Tank Removal PURPOSE: The purpose of this memorandum is to provide Council with information to consider Change Order No. 1 to the subject contract. r* BACKGROUND: At your July 11th meeting, Council awarded a contract for the removal of underground storage tanks at various locations throughout the City to Ainley Tank Testing & Repair Inc. , of Algonquin. The required permits and registrations necessary to proceed with the removal of these tanks were obtained from the Office of the Illinois State Fire Marshal . Work began in the South Grove Redevelopment District on September 3rd and, unfortunately, a number of the tanks were found to be leaking and the soil contam- ination was found to be considerable. The magnitude of the problems on South Grove were presented to Council at your Septem- ber 11th Committee of the Whole Meeting in a memorandum from Steve Bone, Ass 't. Supt. BIS. The staff then met with Ainley to determine some cost estimates and, hopefully, negotiate some savings to the contract unit prices (please refer to the attached letter from Ainley dated September 16th for details) . Following that meeting, the attached Change Order #1 was devel- oped for Council ' s consideration and work on South Grove has been suspended pending the submittal and approval of the Correc- tive Action Plan to the IEPA. It should be noted that the removal work at the Farm Colony and the Lord' s Park Pavilion sites proceeded with much greater suc- cess; only a minimal amount of soil contamination was found and these sites should be completed shortly. Also, staff is looking 4 Memo to Mayor and Members of City Council Page 2 September 20, 1991 41/ into various options regarding replacement and possibly reloca- tion of the underground tank in the southwest corner of City Hall prior to beginning work. FINANCIAL IMPACT: The City has begun the application process with the IEPA in order to access the State' s Leaking Underground Storage Tank (LUST) fund; however, there are deductibles in- volved. In addition staff is investigating the liability of former owners and tenants as well as our own insurance coverages . The LUST application process is on a reimbursement basis and is expected to take several months. In the interim, the contractor needs to be paid for the work completed to date and funds estab- lished to complete the clean-up on South Grove pending the IEPA' s approval of the Corrective Action Plan. An analysis of the General Fund has found the following: Monies could be made available for these costs before State LUST funds or other possible recovery sources are received. At this late point in the year, there have been no other major unforeseen expenses that have im- pacted the General Fund' s contingencies, and there is approximately $700,000 unexpended between Non- departmental 's Special Projects Account (Approp. 47) #190-959 ) and Non-departmental 's Capital Accounts (Approp. #190-978 & #190-991) . RECOMMENDATION: The recommendation is that the City Council approve Change Order No. 1 for the removal of underground tanks in the amount of $604,794 .50. f-40-NA City a1nager 4141 ♦ 4„ Page 2 September 16, 1991 City of Elgin RE: Scope of Work Regarding Underground Storage Tanks .� .. ilk There is however some bad news for all this, the price for M11I`MT the closure documentation will increase from $150.00 to $2,850.00 TANK TESTING&REPAIR INC for Grove Street properties but will remain the same for all other 1308 S. Main Street sites. The reason for the increase is the complicated nature of AlgonquiniL all the report writing, Professional Engineering and E.P.A. 60102-2740 correspondence. 708/658-2799 Fax 708/658-3730 In summary, I am offering you a total savings of $42,000.00. This is in addition to the $40,000.00 you have saved by retaining my company as the low bidder. This brings me to my next topic, the continuing remedial problem of a groundwater study, groundwater corrective action plan and clean-up. As you can see from the above discounts and flexibility of my firm, I believe that we would represent the City of Elgin's best interest in the further remedial efforts. We have proven to not only be the lowest bidder on a large scale clean-up but have also given you additional price breaks on a contract that was already agreed to. This should prove that we are looking out for your best interests along with providing you quality professional service. Not only that but it will save you money and an awful lot of headaches down the road if you have to change environmental contractors in the middle of a clean-up. We are qualified in the area of groundwater remediation and have several sites working now. You are welcome to come and look at one of these sites and to judge for yourself just how the process works. In addition, like most of our other work, we are generally low bidders on every job we decide to take on. Therefore I can assure you that our costs and prices are on the low end of the scale industry wide and extremely competitive as you have already found out. Tank Installation at 150 Dexter Court: The Office of the State Fire Marshal has informed me that they will not allow us to put a single wall tank and single wall piping system in at your 150 Dexter Court site. The reason for this is that it is too close to the sewer system. Therefore they give us two options. Option #1: Relocate the installation. However, Steve Bone has informed me that this would probably not be the best option. Option #2: Install a double wall tank and all double wall piping. The cost for installing an STI-P3 double wall 2,000 gallon tank and piping will be an additional $14,990.00. The cost for installing an Owens Corning double wall tank and piping will be an additional $17,165.00. Once you decide to go with a double wall tank system, you also have the need to install an interstitial space monitor on the tank to detect leaks from the primary tank to the secondary tank. This is already built into options 1 & 2. r Environmental Safety into the 21st Century September 16, 1991 City of Elgin RE: Scope of Work Regarding Underground Storage Tanks - -- al L= H11ILMT I have looked over the entire bid documentation and have done TANK TESTING&REPAIR INC my own tabulation based on 5,000 cubic yards of contaminated soil 1308 S. Main Street hauled away and 5,000 cubic yards of new soil brought back in. Algonquin, IL Also, I figured 20,000 gallons of contaminated water and product to 60102-2740 be pumped. All other figures that were tabulated were based on given 708/658-2799 unit prices. I have found that our closest competitor was Sullivan Fax: 708/658-3730 Construction. Based on my above tabulation, they would still be approximately $40,000.00 more expensive at our present point in time. I believe that out of all the nine bids received, we would still be the lowest bidder by quite a bit no matter how much contamination was being removed. Therefore here is what I have to offer: Base prices for tank removals were determined by the overall contract price and divided by the number of tanks. This price came out to be $1,230.00 per tank regardless of their size. Concerning Grove Street, I will not charge you any additional monies for extra tanks found. This is a savings of approximately $3,700.00 for an extra three tanks found. However, if any other tanks are found on any of the rest of the sites, then the $1,230.00 will be the additional rate per tank. As for the per cubic yard charge for hauling contaminated soil, my price is $56.50 per cubic yard. I will lower this price by $2.50 per cubic yard. This represents a savings of more than $17,000.00 lower than our agreed to contract price. The contract price for new backfill will remain the same. I have come up with a way not to have to spend any more on extra granular fill. We will take virgin sand from the adjacent land and fill up the excavation to the top of the water table. Then I will fill the virgin excavation with the same fill as I originally figured in the contract. The reason for the sand is to compliment the necessity for easy groundwater flow for future groundwater studies and remediation. This will represent an additional savings of approximately $20,000.00 for the City of Elgin. The contract price for removal of contaminated water or product is $.55 per gallon. I worked out a decrease of $.08 per gallon to bring the per gallon price down to $.47. This represents a savings of $1,600.00 to the City of Elgin. The price for all sampling will stay the same because I am substantially lower than anyone else with the exception of ASI (whose base bid was $60,000.00 more than mine) . We also included a Geophysical Survey of the Grove Street properties at no additional cost to you. This was a savings of almost $2,000.00.
