AUTHORIZING EXECUTION OF AN ADDENDUM TO MEMORANDUM OF AGREEMENT
BETWEEN DEPARTMENT OF TRANSPORTATION
FEDERAL AVIATION ADMINISTRATION AND CITY OF ELGIN
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Larry L. Rice, City Manager, be and is hereby
authorized and directed to execute an Addendum to Memorandum
of Agreement Between Department of Transportation Federal
Aviation Administration and City of Elgin for roadway and
utility improvements at the Farm Colony property, a copy of
which is attached hereto and made a part hereof by reference.

ADDENDUM
to
MEMORANDUM OF AGREEMENT
between
DEPARTMENT OF TRANSPORTATION
FEDERAL AVIATION ADMINISTRATION
and
CITY OF ELGIN
This document will constitute an addendum to and be a part of the
Memorandum of Agreement as identified above. This Addendum is
executed in order to clarify the principal document by the removal
of certain language contained in that principal document.
Item 1 -
By this document, the language contained in ARTICLE VII --
Revocation in the principal document is deleted and the words
"Section Not Used" are to be considered substituted for the
deleted language. The substitution is being made to avoid any
misunderstanding that the fact that Article VII is intentionally
to be considered blank. The article will be considered to appear
as -
ARTICLE VII - (This Section Not Used)
Item 2 -
By this document, the language contained in ARTICLE III A of the
principal document is altered by the deletion of the following
words, " . . . ; PROVIDED HOWEVER, that upon revocation or termination
of the agreement for any cause, FAA will reimburse the CITY for
all cost incurred up to the time of revocation or termination. "
The alteration is being made to reflect the removal of revocation
and termination language from Article VII (as reflected earlier in
this document) and also since the responsibility of reimbursement
is clearly set in the balance of the document. The article will
be considered to appear as -
ARTICLE III -- Reimbursement, Performance and Accounting
Arrangements
A. FAA will reimburse the CITY on a quarterly basis
upon receipt of billing for the project costs incurred
by the CITY in furnishing design, engineering,
construction, and supervision for the utilities and
roadwork required under this Agreement.
The FAA and the CITY agree to the provisions of this Addendum and
its incorporation into the principal document, as indicated by the
signatures of their duly authorized officers.

DEPARTMENT OF TRANSPORTATION FEDERAL AVIATION ADMINISTRATION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN,
ILLINOIS, that Larry L. Rice, City Manager, be and is hereby

on behalf of the City of Elgin with the Department of
Transportation Federal Aviation Administration for roadway and
utility improvements at the Farm Colony property, a copy of
