CONTRACT
1 . This agreement, made and concluded the 25th day of
October , 1990 between the City of Elgin acting by and
through its Mayor and City Council known as the party of the
first part, and Gluth Brothers Construction, Inc.
his/their executors, administrators, successors or assigns, known
as the party of the second part.
2 . WITNESSETH: That for and in consideration of the payments
and agreements mentioned in the Letter of Proposal hereto
attached, to be made and performed by the party of the first
part.
3 . And it is also understood and agreed that the Letter of
Proposal and the Plans for the E.C.C. Storm Sewer Improvements
approved by the City of Elgin, Illinois, Engineering Division
October 10, 1990, are all essentially documents of this contract
and are a part hereof .
4 . IN WITNESS WHEREOF, The said parties have executed these
presents on the date above mentioned.

Contracts
You will find attached five (5) copies of the subject contract
which have been executed by the contractor. The City Council
authorized this contract at their last meeting. Please execute
the contracts along with the Mayor, keep one copy and return the
rest to me for distribution to the correct parties .

SUBJECT: E.C.C. Storm Sewer Improvements
PURPOSE: This memorandum will provide the Mayor and Council
with information to consider the award of a contract for the
subject project.
BACKGROUND: The City Council authorized the staff to solicit
proposals to complete the installation of a separate outfall
system for the E.C.C. Fountain Square Plaza storm water system.
Proposals were solicited from three firms.
Only two of the firms returned a proposal, Illinois Hydraulic,
Inc. , and Gluth Brothers, Inc. Gluth Brothers and Illinois
Hydraulic has completed many projects for the City and private
developers in a satisfactory manner.
FINANCIAL IMPACT: The Engineer's Estimate for this project was
$10,000 . The proposal price submitted by Gluth Brothers was in
the amount of $8,932 .00 and Illinois Hydraulic was $16,800.00.
There are sufficient funds available in the Sewer Fund to pay
for this work.
RECOMMENDATION: It is recommended that the City Council award a
contract to Gluth Brothers, Inc. , for the E.C.C. Fountain Square
Storm Sewer in the not exceed amount of $8,932.00. A copy of
the proposals from Gluth Brothers, Inc. and Illinois Hydraulic,
Inc. , and the contract are attached for your consideration.
