Re: Woodruff & Edwards Storm Sewer Improvements Dear Mr. Dahl: We prepared this letter to serve as the agreement between the City of Elgin and our firm for engineering services requested relative to the installation of storm sewers across the property formerly owned by Woodruff and Edwards, Inc. The services we are to provide are as follows: 1. Construction observation services during installation of the various sewers . 2 . Construction staking, as necessary. 3 . Construction guidance services when neces- sary to assist our on-site employee. 4. Material testing by a subconsultant when required. For our services we will be compensated at the following hourly rates which will be considered payment in full to Hampton, Lenzini and Renwick, Inc. for actual employee time utilized to provide the required services , said rates include overhead and burden costs plus profit. Other out-of-pocket expenses will be reimbursed at our actual cost. Omitted services include, but are not limited to, shoring, scaffolding, underpinning, temporary retainment of excavation and any erection methods and temporary bracing. BACKGROUND: At your July 25th Committee of the Whole Meeting, Council authorized staff to proceed with a plan to remove the unsightly surface concrete from South Grove & Wellington Avenue and transport it to the Northerly half of the Woodruff & Edwards property where it will be used as base fill for the new City park site to be constructed as part of our agreement with Van Den Bergh Foods thereby benefitting both these redevelopment projects. Four contractors, including the two currently working at the Woodruff & Edwards site, were contacted last Wednesday request- ing proposals to perform this work. Harry W. Kuhn Inc. of West Chicago, the contractor bringing the fill to the W & E site, declined indicating their firm is not in the concrete removal business; however, they did indicate their willingness to accommodate the City' s plan to utilize South Grove' s surface concrete as a substitute for an estimated 15, 000 cubic yards of base fill. Following the removal of the surface concrete and should it be determined necessary, Kuhn further offered to bring fill materials to the South Grove site at their current W & E ""` contract prices. f Site Preparation of the former Woodruff & Edwards Property August 2 , 1990 411111 Page 2 The other three contractors that were contacted did submit proposals to do this work as detailed on the attached bid tabulation sheet. The low bidder, American Demolition Corp. , performed our last demolition contract on South Grove Ave. and was recently awarded the contract for the demolition of the Travis Medical Center property. Based upon Council' s authorization to proceed, American Demoli- tion was awarded this contract. It is noted that the pre-con- struction meeting has been held and assuming the foundry demoli- tion and tank removals are completed on schedule, this contract would begin Tuesday, August 7th; it is estimated that this project will accommodate approximately 1000 truckloads of material and will take 3 to 4 weeks to complete. FINANCIAL IMPACT: This unique contract will benefit these two (2) redevelopment projects as follows : 1 . Provides the opportunity to improve the unsightly condition on South Grove now while eliminating the expense of dispos- ing of these concrete materials at a landfill or some other acceptable location. 2 . Provides a cost savings to the joint City/Van Den Bergh Foods redevelopment project by reducing the total quantity of fill materials that would have to be purchased in order to bring the W & E site back to final grade. There are sufficient funds in the South Grove Redevelopment Fund for this project (Approp. #260-991-9914) . Rice , City Manager SUBJECT: Woodruff and Edwards Storm Sewer Improvements Construction Engineering Services PURPOSE: This memorandum will provide the Mayor and Council with information to consider a contract for the inspection of the subject construction project. BACKGROUND: The City Council awarded a contract to Harry W. Kuhn, Inc. , to construct the Woodruff and Edwards Storm Sewer at the July 11 , 1990 , City Council meeting. The work on that project commenced on July 23 , 1990 . In order to assure a project that is fillk in the manner shown on the plans it is necessary that inspections be made by qualified personnel. The firm of Hampton, Lenzini and Renwick, Inc . , designed this project and has performed this function on many projects in the past. FINANCIAL IMPACT: Hampton, Lenzini and Renwick has submitted a not to exceed cost of $13 , 950 . 00 to perform the inspection of the Woodruff and Edwards Storm Sewer Extension. There are sufficient funds available in the Sewer Fund to pay for this work. RECOMMENDATION: It is recommended that the City Council award the contract for the inspection of the Woodruff and Edwards Storm Sewer to Hampton, Lenzini and Renwick for the not to exceed amount of $13, 950 . 00 . General City funds will be used entirely or in part to finance engineering services as de- scribed under the AGREEMENT PROVISIONS. PROJECT DESCRIPTION Name Woodruff and Edwards Storm Sewer Extension Termini From the easterly side of Illinois Route 31 easterly to the Fox River Description: Extend the existing storm sewer under Illinois Route 31 easterly across the former Woodruff and Edwards property, under the Chicago-Milwaukee Road rail facility to the Fox River. In addi- tion, storm sewers will be extended north and south from the above extension to intercept current Illinois Route. 31 drains connected to the Woodruff and Edwards raceway. AGREEMENT PROVISIONS THE ENGINEER AGREES, 1 . To perform or be responsible for the performance of the following engineer- ing services for the LA in connection with the proposed improvement herein- before described: a. Make such detailed surveys as are necessary for the preparation of detailed storm sewer plans. • -1- b. Prepare Army Corps of Engineers Permit and Division of Water Resources Permit, if necessary. c. Make complete general and detailed plans, special provisions, pro- posals and estimates of cost and furnish the LA with five (5) copies of the plans, special provisions, proposals and estimates. Additional copies of any or all documents, if required, shall be furnished to the LA by the ENGINEER at his actual cost for repro- duction. d. Assist the LA in the tabulation and interpretation of the Contrac- tor's proposals. 2. That all reports, plans and special provisions to be furnished by the ENGI- NEER pursuant to this AGREEMENT will be in accordance with current standard specifications and policies of the LA. It is being understood that all such reports, plats, plans and drafts shall, before being finally accepted, be subject to approval by the LA. 3. To attend conferences at any reasonable time when requested to do so by representatives of the LA. 4. In the event plans or surveys are found to be in error during construction of the PROJECT and revisions of the plans or survey corrections are neces- sary, the ENGINEER agrees that he will perform such work without expense to the LA, even though final payment has been received by him. He shall give immediate attention to these changes so there will be a minimum delay to the Contractor. 5. That basic survey notes and sketches, charts, computations and other data prepared or obtained by the ENGINEER pursuant to this AGREEMENT will be made available, upon request, to the LA without cost and without restric- tion or limitations as to their use. 6. That all plans and other documents furnished by the ENGINEER pursuant to this AGREEMENT will be endorsed by him and will show his professional seal where such is required by law. 7. That the fee for the above required services shall not exceed $13,850.00 except in those instances where services required under Paragraph 4 of THE LA AGREES applies. THE LA AGREES, 1 . To pay the ENGINEER as compensation for all services performed as stipulat- ed in paragraphs 1 , 2, 3, 5 and 6 at the following hourly rates which will be considered payment in full for actual employee time utilized to provide the required services, said rates include overhead and burden costs plus profit. That payments due the ENGINEER for services rendered in accordance with this AGREEMENT will be made as soon as practicable after the services have been performed, in accordance with the following schedule: a. Partial payments, not to exceed 90 percent of the amount earned, shall be made on a monthly basis as services are provided. b. Upon completion of detailed plans, special provisions. proposals and estimates of cost - being the work required by paragraphs la through lc under THE ENGINEER AGREES - to the satisfaction of the LA, 90 percent of the total fee due under this AGREEMENT. c. Upon award of the contract for the improvement by the LA. 100 per- cent of the total fee due under the AGREEMENT. Less any amounts paid under "a" and "b" above. 3. That, should the improvement be abandoned at any time after the ENGINEER has performed any part of the services provided for in paragraphs is through lc and prior to the completion of such services. the LA shall reim- burse the ENGINEER for his services up to the time he is notified in writ- ing of such abandonment at the hourly rates set forth in paragraph 1 above. 4. That, should the LA require changes in any of the detailed plans, specifi- cations or estimates, except for those required pursuant to paragraph 4 of THE ENGINEER AGREES, after they have been approved by the LA. the LA will -3- pay the ENGINEER for such changes at the hourly rates set forth in para- graph 1 above. It is understood that "changes" as used in this paragraph shall in no way relieve the ENGINEER of his responsibility to prepare a complete and adequate set of plans and specifications. IT IS MUTUALLY AGREED, 1 . That any difference between the ENGINEER and the LA concerning the inter- pretation of the provisions of this AGREEMENT shall be referred to a com- mittee of disinterested parties consisting of one member appointed by the ENGINEER, one member appointed by the LA and a third member appointed by the two other members for disposition and that the committee's decision shall be final. 2. This AGREEMENT may be terminated by the LA upon giving notice in writing to the ENGINEER at his last known post office address. Upon such termination, the ENGINEER shall cause to be delivered to the LA all surveys, permits, agreements, drawings, specifications, partial and completed estimates and data, if any, from soil survey and subsurface investigations with the un- derstanding that all such material becomes the property of the LA. The EN- GINEER shaft be paid for any services completed and any services partially completed in accordance with Section 3 of THE LA AGREES. 3. That if the contract for construction has not been awarded one year after the acceptance of the plans by the LA, the LA will pay the ENGINEER the balance of the engineering fees due to make 100 percent of the total fees due under this AGREEMENT. 4. That the ENGINEER warrants that he has not employed or retained any company or person, other than a bona fide employee working sotety for the ENGINEER, to solicit or secure this contract, and that he has not paid or agreed to pay any company or person, other than a bona fide employee working sotety for the ENGINEER, any fee, commission, percentage, brokerage fee, gifts or any other consideration, contingent upon or resulting from the award or making of this contract. For breach or violation of this warranty, the LA shalt have the right to annul this contract without liability. -4- IN WITNESS WHEREOF, the parties have caused this AGREEMENT to be executed in triplicate counterparts, each of which shaft be considered as an original by their duty authorized officers.
