BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that Larry L. Rice, City Manager, and Dolonna Mecum, City Clerk, be and are hereby authorized and directed to execute Supplement No. I to an agreement on behalf of the City of Elgin with Midwest Consulting Engineers, Inc. for the Wing Park bridges over Tyler Creek, a copy of which is attached hereto and made a part hereof by reference. George VanDeVoorde, Mayor Presented: June 13, 1990 Adopted: Vote: Yeas Nays Recorded: Attest: Dolonna Mecum, City Clerk (1.3) SUPPLEMENT NO. 1 TO AGREEMENT FOR CONSULTANT'S SERVICES BETWEEN THE CITY OF ELGIN AND MIDWEST CONSULTING ENGINEERS, INC. WHEREAS, an AGREEMENT FOR CONSULTANT SERVICES exists between the City of Elgin, the CITY, and Midwest Consulting Engineers, Inc. , the CONSULTANT, dated October 11, 1989 to furnish certain professional Phase II engineering services, described in Section 2 of the AGREEMENT and including the preparation of contract plans, special provisions, and cost estimates, in connection with the proposed improvement of Wing Park Bridges over Tyler Creek, the PROJECT; and, WHEREAS, coordination with the IDOT Division of Water Resources as specified under Article 6 Section 2 has required that an IDOT Division of Water Resources permit be obtained for this PROJECT; and, WHEREAS, the Illinois Statutes regarding waterway permits have undergone changes during the execution of the Phase II engineering services; and, WHEREAS, said changes of Illinois Statutes regarding waterway permits has caused the CONSULTANT to expend additional Phase II engineering services to comply with said changes in obtaining an IDOT Division of Water Resources permit; and, MCE001/13 -1- R. WHEREAS, the requirements for said additional services could not have been reasonably foreseen by the CITY or the CONSULTANT; and, WHEREAS, the CITY desires the CONSULTANT to complete the Phase II engineering of the AGREEMENT; NOW, THEREFORE, BE IT RESOLVED THAT: 1. Said additional services constitute EXTRA WORK for Phase II engineering, in accordance with Section 5.4 of said AGREEMENT; and, 2 . The Upper Limit of Compensation for said Phase II engineering shall be increased in accordance with Section 5.4 of said AGREEMENT; and, 3 . For said work the CITY agrees to pay the CONSULTANT reimbur- sement of his eligible costs in accordance with Section 2.45 of the STANDARD PROVISIONS, plus a Fixed Amount of $600. 00, subject to an Upper Limit of Compensation of $5, 300.00. The Upper Limit of Compensation and Fixed Amount are the result of the Cost Estimate of Consultant Services, Exhibit D, attached to and made part of this SUPPLEMENT NO. 1. The retainage provisions contained in Section 2 .42 of said STANDARD PROVI- SIONS shall not apply Direct Non-Salary Costs. Exhibits A, MCE001/13 -2- B, and C, which are attached to be used as set forth in Section 2 .42 of said STANDARD PROVISIONS. It is mutually agreed that, as a result of this SUPPLEMENT NO. 1, the total Upper Limit of Compensation for Phase II Engineering is $34,984. 00.
