89-1012 IDOT Tyler Creek Detention BUILD ILLINOIS AMENDMENT NUMBER TWO to SPONSORSHIP AGREEMENT between the CITY OF ELGIN, ILLINOIS and the STATE OF ILLINOIS/DEPARTMENT OF TRANSPORTATION for the TYLER CREEK DETENTION RESERVOIR dated August 12, 1986 WHEREAS, the Department of Transportation, acting for and on behalf of the State of Illinois (hereinafter the "DEPARTMENT") , and the City of Elgin, Illinois (hereinafter the "CITY") entered into a Sponsorship Agreement dated August 12, 1986, as amended (hereinafter "Sponsorship Agreement"), covering the construction of the Tyler Creek Detention Reservoir (hereinafter "IMPROVEMENT") ; and WHEREAS, the VILLAGE has encountered problems which have caused delay in the construction of the IMPROVEMENT and an extension to the Sponsorship Agreement is warranted. NOW THEREFORE, for and in consideration of this premise, the parties hereto, being the same parties as to the Sponsorship Agreement, agree to the following modification therein. I. Paragraph 3 under Item A on page 2 of the Sponsorship Agreement is hereby deleted. The new paragraph A-3 will read as follows: "3. The DEPARTMENT's funding obligation under this Agreement will terminate upon completion of the IMPROVEMENT, when the total $500,000 is expended, or June 30, 1991 , subject to reappropriation of funds, whichever comes first, allowing to September 15, 1991 to pay for expenses already obligated." II. All other covenants under the Sponsorship Agreement remain unchanged and in full force and effect. IN WITNESS WHEREOF, the DEPARTMENT and the CITY have executed this Amendment Number Two the day and year written; that the Mayor of the CITY hereby affirms that he has the authority to execute this amendment on behalf of the CITY; that the effective date of this amendment is the date approved and executed by the Secretary of the DEPARTMENT. BACKGROUND: The City was able to have included in the Build Illinois Program a partial funding of the subject detention facility. The Build Illinois funds for this project are admin- istered by the Division of Water Resources (DOWR) . The City Council authorized the execution of a Sponsorship Agreement dated August 12 , 1986 , and subsequently extended to June 30 , 1989 , between the City of Elgin and DOWR. The DOWR has prepared Amendment Number Two to the Sponsorship Agreement. Attached for your consideration is a copy each of Mr. Vonnahme' s transmittal letter and the amendment. FINANCIAL IMPACT: None. RECOMMENDATIONS: It is recommended that the City Council authorize the execution of the Amendment Number Two by the Mayor and City Clerk and direct the staff to prepare the necessary resolution for action at the next City Council meeting.
