88-0727 Sanitary District of Elgin - Abbott Drive Pumpstation 1988 1• RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH THE SANITARY DISTRICT OF ELGIN BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS, that James J. Cook, City Manager, and Marie Yearman, City Clerk, be and are hereby authorized and directed to execute an agreement on behalf of the City of Elgin with the Sanitary District of Elgin for the Abbott Drive Pumpstation, a copy of which is attached hereto and made a part hereof by reference. The City of Elgin (hereinafter referred to as the City) and the Sanitary District of Elgin (hereinafter referred to as the SDE) desire to provide sanitary sewer service to properties in the drainage area served by the Abbott Drive Pumpstation: and WHEREAS. the City will be constructing 1277 feet of 15* diameter sewer paralleling the existing sewer tributary to the Abbott Drive Pumpstation: and WHEREAS. The City will be using Build Illinois Funds. which are allocated to the City to pay 70% of the Total Project Cost of the sewer: and WHEREAS. the remaining 30% of the Total Project Cost still has to be funded: and • WHEREAS. units of government are authorized by law to cooperate in the performance of their responsibilities by contracts and other agreements. NOW THEREFORE. in consideration of the premises and mutual agreements of the parties hereto one to the other. it is hereby agreed between the City. a municipal corporation. and the SDE, a municipal corporation. as follows: 1). The City agrees to construct 1277 feet of a 15" diameter sewer paralleling the Abbott Drive Influent sewer. 21. The City and the SDE each agree to pay 15% of the Total Project Cost of constructing the 1277 feet of the 15" diameter sewer. 31. The SOE's share of the bid price shall be paid within 21 days after written notification from the City that it has entered into a contract for constructing the sewer. 41. The SDE realizes that some additional cost may be incurred during construction and the SDE agrees that it will pay its share of the Total Project Cost 21 days after the project has been accepted by the City. Illinois 80120-5555 Re: Highland Heights Development Dear Roger: In consideration of recent discussions regarding the expansion capabilities of sewer service West of Randall Road, the Sanitary District has reviewed the design limitations of the Tyler Creek Intercepting Sewer System. As I had reported in an October 5, 1985 internal memorandum, a copy of which has been previously provided to your office, the potential to serve areas beyond the Interceptor Sewer's design service area is possible depending upon the actual development of various projects as compared to the design population projections. In a related matter, I had also evaluated the Interceptors capabilities based on the construction record conditions of the installation. Utilizing a less conservative peaking factor of 250% which was the regulation for design during the 1970's and earlier, it appears that additional P.E. can be accomodated with minor surcharging in one section of sewer during peak rate conditions. For example: I had determined that 1000 PE extra load could be served with a peak rate surcharge measured in inches. This matter was discussed at the Board of Trustees meeting on March 14, 1988 and it was decided that the above described condition could be tolerated TRUSTEES Harold C.Westphal, Jr. due to its relatively minor impact. Also. I should mention that this projected President condition could be eliminated if deemed necessary by constructing parallel Edwin G. Haas sewers. Vice President Ernest R. A Pipe Line Agreement dated October 8 , 1982 and recorded January 26 , 1983 as Document No . 1628007 with the Chicago, Milwaukee, St . Paul and Pacific Railroad Company; 2 . A License Agreement dated February 9 , 1981 and recorded March 12 , 1981 as Document No . 1570907 with the Chicago and North Western Transportation Company; 3 . An Easement for Sanitary Sewer dated March 28 , 1983 and recorded February 6 , 1984 as Document No . 1668950 with Earl H. Gromer ; and 4 . An Easement Grant dated June 17 , 1981 and recorded July 15 , 1981 as Document No . 1582700 with Georgia-Pacific Corporation . AND WHEREAS, Assignee has heretofore agreed to install a sanitary sewer within the area heretofore granted to Assignor . -1- NOW, THEREFORE, Assignor hereby transfers and assigns to Assignee, such rights as Assignor may have and Assignee may require to install the sanitary sewer line ( interceptor) reserving to Assignor the right to use such area for subsequent lines or work areas, as such may be permitted under the terms of the various recorded documents as hereinabove set forth. In the performance of any work hereunder Assignor and Assignee, as the case may be, shall be bound by the terms and conditions contained in the various recorded documents as hereinabove set forth. Where required, Assignor shall furnish to Assignee the written permission and/or approval that may be required by the terms of the various recorded documents , and Assignee shall comply with the terms and conditions of all such documents .
