to
SPONSORSHIP AGREEMENT
between the
CITY OF ELGIN, ILLINOIS
and the
STATE OF ILLINOIS/DEPARTMENT OF TRANSPORTATION
for the
TYLER CREEK DETENTION RESERVOIR
dated
August 12, 1986
WHEREAS, the Department of Transportation, acting for and on behalf of the State of
Illinois (hereinafter the "DEPARTMENT") , and the City of Elgin, Illinois (hereinafter the
"CITY"), entered into an Agreement dated August 12, 1986 covering the construction of the
Tyler Creek Detention Reservoir (hereinafter "IMPROVEMENT") , and
WHEREAS, the CITY has encountered problems which have caused the delay in the
construction of the IMPROVEMENT and an extension to the August 12, 1986 Sponsorship Agreement
is desired.
NOW THEREFORE, for and in consideration of this premise, the parties hereto, being the
same parties as to the August 12, 1986 Agreement, agree to the following modification therein.
I. Paragraph 3 under Item A on page 2 of the August 12, 1986 Sponsorship Agreement
is hereby deleted. The new paragraph A-3 will read as follows:
"3. The DEPARTMENT's funding obligation under this Agreement will terminate
upon completion of the IMPROVEMENT, when the total $500,000 is expended,
or June 30, 1989, subject to reappropriation of funds, whichever comes
first, allowing to September 15, 1989 to pay for expenses already
obli gated."
II . All other covenants under the August 12, 1986 Agreement remain unchanged and in
full force and effect.
IN WITNESS WHEREOF, the DEPARTMENT and the CITY have executed this Amendment Number One
the day and year written; that the Mayor of the CITY hereby affirms that he has the authority
to execute this amendment on behalf of the CITY; that the effective date of this amendment is
the date approved and executed by the Secretary of the DEPARTMENT.
