86-67R Bartlett Water RESOLUTION 86 - 67R WHEREAS, the Village of Bartlett ("Bartlett") has heretofore entered into an agreement with the City of Elgin ("Elgin") pursuant to which Elgin has agreed to provide Bartlett with water and Bartlett has agreed to construct certain water mains and appurtenant structures to connect the Bartlett water distribution system to the Elgin water distribution system, and upon completion of such water distribution system improvements, to transfer to Elgin title to certain of those water distribution system improvements; and WHEREAS, the Village has caused construction of such water distribution system improvements to be completed; NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees of the Village of Bartlett, Cook and DuPage Counties, Illinois, as follows: SECTION ONE: That the Village of Bartlett shall transfer to the City of Elgin title to the water distribution system improvements described on the Bill of Sale appended hereto as Exhibit A expressly made part of this Resolution. SECTION TWO: That the Village President and Village Clerk be and they are hereby authorized and empowered to sign and attest, respectively, the Bill of Sale transferring title to such water distribution system improvements to the City of Elgin. SECTION THREE: SEVERABILITY. The various provisions of this Resolution are to be considered as severable and if any part or portion of this Resolution shall be held invalid by any Court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Resolution. - 1 - SECTION FOUR: REPEAL OF PRIOR RESOLUTIONS. All prior Ordinances and Resolutions in conflict or inconsistent herewith are hereby expressly repealed only to the extent of such conflict or inconsistency. SECTION FIVE: EFFECTIVE DATE. This Resolution shall be in full force and effect upon its passage and approval. Notary Public My Commission Expires: Dk3CRIFTICEI OF WATER MAIN liCATICH The following description, identifies the location of 12-inch and 16-inch water mains installed by the Village of Bartlett, which are to be dedicated to the City of Elgin. 12-Inch Water Main Beginning at a point, said point being the conne+on of the new 12-inch water main installed by the Village of Bartlett and the existing 12-inch water main located on the south side of Bluff City Boulevard approximately 355 feet west of the centerline of Gifford Road, continuing easterly and northerly along the south side of Bluff City Boulevard extended and frontage road to the intersection of Lake Street, an approximate distance of 3,320 feet, thence continuing easterly along the south side frontage road of Lake Street to a point on the west R.O.W. line of the Elgin, Joliet and Eastern Railway Company, an approximate distance of 1,178 feet, said point being a tee, where the water main increases in size from 12-inCh to 16-inch. Also extending northerly from said tee along the aforementioned west R.O.W. line, an approximate length of 163 feet to a point where a connection was made to an existing 12-inch water main located along the north side of Lake Street. The total length of the 12-inch water main pipe installed is approximately 4,661 lineal feet. • 71- WENTW/WM LOCATE . , 16-Inch Water Main Beginning at the tee where the 12-inch water mains connect and increase in size to 16-inch, located on the west side of the Elgin, Joliet and Eastern Railway tracks, thence easterly from said tee under the E‘n, Joliet and Eastern tracks continuing easterly along the south side of Lake Street an approximate distance of 2,045 feet to a quarter bend, continuing north from the quarter bend under Lake Street to the Village of Bartlett Booster Station, an approximate distance of 133 feet.
