Route 426 State Section: (8R & 8R-1)RS-82 Cook and Kane Counties The Honorable Mr. Richard L. Verbic Mayor City of Elgin 150 Dexter Court Elgin, Illinois 60120 Dear Mayor Verbic: The State is desirous of improving approximately 34,194 lineal feet of U.S. Route 20 from Randall Road to Lovell Road in the City of Elgin, Kane and Cook Counties, Illinois [F.A.P. Route 426, U.S. Route 20, State Section: (8R & 8R-1)RS-82] by making the following improvements: A. U.S. Route 20 - from Randall Road to Lovell Road: Complete roadway resurfacing, widening and rehabilitation of various structures, installation of interchange lighting, modernization of traffic signals at the intersection of U.S. Route 20 Lovell Road, and by performing all other work necessary to complete the improvement in accordance with the approved plans and specifications; and In order that the State and City may benefit by this proposed improvement, we are requesting concurrence with the following: 1. The State will make all surveys, prepare plans and specifications, receive bids and award the contract, furnish engineering inspection during construction and cause the improvement to be built in accordance with the plans, specifications and contract. The State will pay for all surveys, construction and engineering costs. 2. Upon final field inspection of the improvement: The State will maintain along U.S. Route 20 within the limits of the improvement, the median, the through traffic lanes, the left-turn and/or right turn lanes and the curb and gutter or shoulders and ditches adjacent to the traffic lanes. The State will be responsible for maintenance of lane line and median line markings. • The Honorable Mr. Richard L. Verbic Page 2 The City will maintain along U.S. Route 20 within the limits of the improvement (within the City limits) those portions of the improvement not maintained by the State, including sidewalks, manholes, catch basins, parkways, storm sewers, utilities and appurtenances. 3. Upon acceptance by the State of the traffic signal modernization, the financial responsibility for the maintenance and electrical energy for the operation of the signals shall be proportioned as follows: Intersection Level of Maintenance Electrical Maintenance Energy U.S. Route 20 Lovell Road I or II STATE Share 100% 0% CITY Share 0% 100% It is agreed that the actual signal maintenance will be performed by the State either with its own forces or through an ongoing contractual agreement. It is further agreed that the signals shall be maintained to at least the Level of Maintenance shown above. It is further agreed that upon acceptance by the State of the traffic signal modernization included herein, the responsibility for maintenance and energy outlined above shall continue to be as outlined in the Master Agreement executed by the State and the City on March 3, 1982. 4. The State will cause private utilities to be relocated at no expense to the State or City. Where a municipal utility has been installed (1) on right of way acquired by the Illinois Department of Transportation or (2) within defined limits of a route the Illinois Department of Transportation has accepted for maintenance responsibilities, subsequent to the date of such acceptance the municipality will bear all utility relocation or adjustment costs made necessary by the construction of this improvement. 5. The City will adopt and put into effect the following ordinances: a. Encroachments will be prohibited. b. Plan approval (letter will be satisfactory). The Honorable Mr. Richard L. Verbic Page 3 This Letter of Understanding shall become null and void in the event the contract covering the construction is not awarded by July 1, 1989. Approval of this Letter of Understanding shall be considered as concurrence with and acceptance of the terms contained herein and shall be binding upon and inure to the benefit of the parties hereto, their successors and assigns. ADOPTED BY THE COUNCIL OF THE OF COUNTY OF , STATE OF ILLINOIS, this day of , 19 VOTE: AYES: NAPES: ABSENT: APPROVED BY ME THIS DAY OF , 19 Mayor ATTEST: City Clerk Exhibit A April 8, 1986 MEMORANDUM TO: Mayor and Members of the City Council FROM: City Manager SUBJECT: U.S. Route 20 Improvement (By-Pass) PURPOSE: This memorandum will provide the Mayor and Council with information to discuss the improvements that IDOT is proposing for U.S. Route 20 and the City's involvement. BACKGROUND: The improvements that IDOT is proposing for the U.S. Route 20 between Randall and Lovell Roads consists of resurfacing, shoulder work, widening and rehabilitation of various structures, traffic signal modernization at the inter- section of Lovell Road and U.S. Route 20, installation of interchange lighting and other necessary work in accordance with the plans and specifications. Attached is a copy of a Letter of Understanding which outlines the various responsibilities of IDOT and the City. The City's involvement with U.S. Route 20 does not change because of this letter. Our responsibilities remain the same in that we will continue to provide electrical energy for the traffic signals at Lovell and U.S. Route 20 and will maintain any of our sewers or watermains that cross the highway. The IDOT is requesting the City pass an ordinance prohibiting encroachments upon the U.S. Route 20 within the City Limits of Elgin. That can be done at a subsequent meeting of the City Council . We have not yet received a set of the plans so that we cannot recommend plan approval at this time. We have been advised by Paul Riddle of IDOT that we can do that at a later date by letter. FINANCIAL IMPACT: The cost of the electrical energy for the traffic signals at Lovell Road and U.S. Route 20 is $92.66 per month, or $1 ,112.00 annually. RECOMMENDATION: It is recommended that the City Council authorize Mayor Verbic to endorse the Letter of Understanding. City Manager MAD:do
