86-0107 Bartlett Water Amendment AMENDMENT TO A CONTRACT
FOR SALE OF WATER BY THE CITY OF ELGIN
TO THE VILLAGE OF BARTLETT
DATED MAY 15, 1984
This contract made and entered into this 7thday of January
by and between the City of Elgin (hereinafter called "Elgin"), an Illinois Municipal Cor-
poration, and the Village of Bartlett(hereinafter called'Bartlett"),an Illinois Municipal
Corporation,
WITNESSETH
WHEREAS, on May 15, 1984 Elgin and Bartlett entered into an agreement
entitled "Contract for Sole of Water by the City of Elgin to the Village of Bartlett"
(Contract);and
WHEREAS,said contract provided for the construction of certain watermains
by Bartlett including a 16 inch watermain between metering point i{I and point A as
shown on Exhibit A of said contract;and
WHEREAS, after construction of said 16 inch watermoin, it was to be
dedicated to and thereafter owned and maintained by Elgin pursuant to Section 5A of the
contract;and
WHEREAS,the parties have now determined that it is necessary and desirable
that Bartlett be responsible for the maintenance, repair and replacement of that portion
of the 16 inch watermain which will pass under State Route 20.
NOW, THEREFORE, in consideration of the mutual promises and conditions
contained herein, the parties agree as follows:
I. Elgin hereby approves the proposed plan of Bartlett to locate a portion of
the 16 inch watermain between point A and metering point Il 1,as identified in the con-
tract,under U.S.Route 20 by enclosing it within a 48 inch casing.
2. Section 5A of the contract is amended by adding the following:
"Provided, however, Bartlett shall remain responsible for the
maintenance, repair and replacement of that portion of the 16 inch water-
main between metering point 0{I and point A which is constructed and
located under U.S.Route 20."
3. That,except as amended herein,all terms of the contract shall remain in
full force and effect.
WHEREFORE, the parties hereto acting under the authority of their respec-
tive governing bodies have caused this contract to be duly executed in several couner-
parts,each of which shall constitute an original.
