Reference is made to the plans to construct barriers behind the curb
on Grove Avenue in front of the windowed portion of the Elgin Post
Office.
Following is a hold harmless clause for your review and acceptance.
As a condition for construction of barriers on the public
right-of-way (Grove Avenue) , the United States Postal Service hereby
agrees to save harmless and indemnify the City of Elgin from all
claims, loss, damage, actions, causes of action, expense, and/or
liability arising from the negligent or wrongful act or omission of
any employee of the United States Postal Service while acting within
the scope of his office or employment, under circumstances where the
United States Postal Service, if a private person, would be liable
in accordance with the laws of the State of Illinois.
