82-0818 822 Summit Street Parking Lot AGREEMENT WHEREAS, Summit & Patton Properties, Inc. , a Delaware corporation, owns and operates a store within the corporate limits of the City of Elgin, Illinois; and WHEREAS, said store has a parking lot accessory to the store building; and WHEREAS, Summit & Patton Properties, Inc. desires to empower the City of Elgin to regulate the parking of automobiles and the traffic at such parking area in a certain manner; and WHEREAS, Section 11-209 of Chapter 95 2 of the Illinois Revised Statutes, 1979, authorizes the corporate authorities of any municipality to enter into such a contract for such purposes. WITNESSETH: THAT FOR AND IN CONSIDERATION of the mutual promises and covenants herein contained and by authority of the applicable state statutes, Summit & Patton Properties, Inc. , owner of the following described property (hereafter Store) located within the City of Elgin, County of Cook: That part of the South West quarter of Section 7, Township 41 North, Range 9 East of the Third Principal Meridian, described as follows: Beginning at the intersection of the North line of Route 58 as dedicated by document 11045054, and the East line of property conveyed in deed filed for record June 28, 1950 as document 14837621 in Cook County, Illinois; thence North 1° 14' East along the East line thereof 400.07 feet; thence North 89° 15' 30" West, a distance of 424.50 feet to a line 101.0 feet East of and parallel with the West line of property conveyed in deed recorded as document 14837621, aforesaid; thence South 0° 37' West along said parallel line a distance of 100.0 feet; thence North 89° 15' 30" West, a distance of 101.0 feet to the West line of property conveyed in deed recorded as document 14837621, aforesaid; thence South 0° 37' West along said West line a distance of 125.0 feet to a point 175.0 feet North of the North line of Route 58 hereinbefore mentioned; thence South 89° 15' 30" East a distance of 116.0 feet; thence South 0° 37' West a distance of 176.24 feet to the North line of Route 58 aforementioned; thence Easterly along the north line of Route 58 aforesaid, being a curve convex Southerly having a radius of 19048.6 feet, for a distance of 393.20 feet to a point of tangent; thence continuing East along said tangent, a distance of 12.0 feet to the point of beginning, in Cook County, Illinois. commonly known as 822 Summit Street, Elgin, Illinois, and the City of Elgin, a municipal corporation, agree as follows: 1. That the following area located within the parking lot of the Store shall be designated as a fire lane: A strip of pavement immediately adjoining and abutting the Store building and spanning the customer entrances. Said strip shall be 10 feet wide and shall extend the entire length of said sidewalk. 2. That no standing or parking of any motor vehicle shall be permitted within the above described fire lanes at any time. Notwithstanding the location of said fire lane so designated, however, Owner hereby reserves the right to establish (at its sole cost and expense) loading zones in front of the exit from or entrance to the store and shall also have the right to relocate any fire lanes in the event of any expansion or alteration of its building. 3. That appropriate signs shall be erected designating said fire lanes and reading "No Parking Fire Lane". 4. That sign described in paragraph 3 shall be furnished, installed and maintained by Store. 5. That the City of Elgin shall have the power to issue citations for any unattended motor vehicles parked or abandoned in the designated fire lanes. 6. That the City of Elgin agrees to adopt necessary ordinances to prohibit standing or parking in designated fire lanes and making violations punishable by a fine not to exceed $200.00. 7. That this Agreement may be terminated upon thirty days written notice by either party. 8. Notices required to be given hereunder shall be given by registered or certified mail and shall be addressed to the City Clerk, City of Elgin, 150 Dexter Court, Elgin, Illinois, and to Owner, c/o Jewel Companies, Inc. , Real Estate Department, 3030 Cullerton Drive, Franklin Park, Illinois 60131. Notices shall be deemed to have been given when mailed. 9. That this agreement shall be recorded in the Office of the Recorder of Deeds of Cook County, Illinois in accordance with the statute made and provided.
