Phase 1 Part 1 work includes the preparation of Bridge Inspection and Bridge Condition Report for incorporation into a project report for the subject area. The proposed improvements will consist of providing one lane in each direction with shoulders and sidewalks, an adequate drainage system, rehabilitating or replacing the bridge structure, and other related work. WITNESSETH: WHEREAS , the STATE, in order to facilitate the free flow of traffic and insure safety to the motoring public , is desirous of improving the intersection of Illinois Route 19 (FAU Route 1321) and Illinois Route 25 (FAU Route 2503) by modernizing the existing traffic control signals (to be known as STATE Section 1977-254-TS and as CITY Section 77-00101-00-TL) , and by performing all other work necessary to complete the improvement in accordance with the plans and sepcifications ; and, WHEREAS, the CITY is desirous of said improvement in that same will be of immediate benefit to the residents of the CITY, and permanent in nature; and, t WHEREAS, the intersection of Illinois Route 19 and Illinois Route 25 lies within the corporate limits of the CITY. NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows : 1. The STATE agrees to prepare plans and specifications , receive bids , award the contract, furnish engineering inspection during construction, and cause the improvement to be built in accordance with the plans , specifications , and contract. The STATE also agrees to pay all construction and engineering costs subject to reimbursement by the CITY as hereinafter stipulated. 2. The CITY agrees to approve the plans and specifications by letter or resolution prior to the STATE advertising for the work to be performed hereunder. 3. It is mutually agreed that the proportional participation for this improvement shall be as follows : INTERSECTION FEDERAL FUNDS STATE FUNDS CITY FUNDS Illinois 19 @ Illinois 25 70% 22. 57 7 . 5% • -2- 4. It is mutually agreed that the estimated cost of this improvement is as follows : Construction Costs $40 ,000.00 Preliminary Engineering Costs $ 2,000.00 Construction Engineering Costs $ 3, 000. 00 TOTAL $45,000 .00 5. It is mutually agreed that the CITY will reimburse the STATE in an amount equal to the CITY' S share of the actual cost as determined in accordance with Item 3 above. It is mutually agreed that upon award of the contract for this improvement, the CITY will pay to the Department of Transportation of the State of Illinois , in a lump sum from any funds allotted to the CITY, under the Motor Fuel Tax Law, an amount equal to 957 of its obligation incurred under this agreement, and will pay to the said Department the remainder of its obligation (including any non-participating costs for FA Projects) in a lump sum, upon completion of the project based upon final costs . 6. The CITY has passed a resolution appropriating sufficient funds to pay its share of the cost of this improvement, a copy of which is attached hereto as "Exhibit A" and made a part hereof. 7 . It is mutually agreed that the financial responsibility for the main- tenance of the modernized traffic signals shall be borne entirely by the STATE. 8 . It is mutually agreed that the financial responsibility for the energy charges for the operation of the traffic signals shall be borne entirely by the CITY. 9 . Upon the completion of this improvement , the STATE will be responsible for the maintenance of the traffic signals . 10. The STATE agrees to make arrangements with the local power company to furnish electrical energy for the operation of the traffic signals and to bill the CITY for the entire cost of the energy charges . 11. The STATE retains the right to control the sequence and timing of the traffic signals . 12. The CITY agrees to adopt and put into effect, prior to advertising for the work to be performed hereunder, an ordinance requiring that parking be prohibited adjacent to this improvement on the approaches lying within the corporate limits of the CITY, a copy of which is attached hereto as "Exhibit j" and will , in the future , prohibit parking at such locations on or immediately adjacent to this improvement as may be determined to be necessary by the STATE from traffic capacity studies . -3- 13. The CITY agrees to exercise its franchise right to cause private utilities to be relocated at no expense to the STATE. 14. The STATE agrees to comply with all applicable Executive Orders and Federal Highway Acts pursuant to the Equal Employment Opportunity and nondiscrimination regulations required by the U. S . Department of Transportation. 15. This agreement and the covenants contained herein shall be null and void in the event the contract covering the construction work contemplated herein is not awarded by June 30, 1981. 16. This agreement shall be binding upon and inure to the benefit of the parties hereto, their successors and assigns .
