77-0209 Fraternal Order of Eagles Tyler Creek Bridge AGREEMENT
This agreement, made and entered into this 9th day of
February , 1977, by and between the City of Elgin, a
municipal corporation, hereinafter called "City" , and the
Fraternal Order of Eagles , a non-profit corporation, hereinafter
called "Eagles" .
WITNESSETH
WHEREAS , City desires to have a gaging station in
Tyler Creek; and
WHEREAS, Eagles have located on their property a bridge
which crosses Tyler Creek.
NOW, THEREFORE, in consideration of the promises and
mutual covenants and agreements herein contained, the parties
hereto agree as follows :
1. City shall install on the northeast wing wall of a
bridge owned by Eagles over Tyler Creek a gaging station in
accordance with Elgin' s project specifications , the terms of
which are incorporated herein by reference and made a part of
this agreement.
2. This agreement shall be in full force and effect
from the date of this agreement for a period of twelve (12)
months .
3. City agrees to repair all damage to the Eagles
bridge caused by operation of the gaging station, including
but not limited to filling of holes securing the gaging station
to the wall upon its removal .
