RESOLUTION NO. 27
APPROVING JOINT COUNTY-CITY OF ELGIN AGREEMENT
FOR THE IMPROVEMENT OF THE INTERSECTION OF
BIG TIMBER ROAD AND SLEEPY HOLLOW ROAD IN ELGIN, ILLINOIS
WHEREAS, the County Board of Kane County, Illinois, in order to facilitate the
free flow of traffic and insure safety to the motoring public, is desirous of
providing traffic signals and widening to four-lanes the intersection of Big Timber
Road (County Highway 21) and Sleepy Hollow Road in Elgin, Illinois, and
WHEREAS, the City of Elgin, Illinois is agreeable to cause the improvements to be
made and it will be necessary to enter into an agreement embodying such provisions.
NOW, THEREFORE BE IT RESOLVED that the Chairman of the County Board be, and he
hereby is, authorized to execute a joint agreement between the City of Elgin and the
County of Kane, embodying in substance the foregoing provisions.

referred to as the "COUNTY".
WITNESSETH
WHEREAS, the CITY, in order to facilitate the free flow of traffic and insure
safety to the motoring public is desirous of improving the intersection of Big Timber
Road (County Highway 21) and Sleepy Hollow Road by widening each leg of the inter-
section to four lanes including curb and gutter and complete traffic signalization
and by performing all other work necessary to complete the improvement in accordance
with the plans and specifications under City Section 94-CS, and County
Section 150 TL-MFT; and,
WHEREAS, the CITY and COUNTY are desirous of said improvements in that same
will be of immediate benefit to the residents of the CITY and COUNTY and permanent in
nature; and,
WHEREAS, the intersection of Big Timber Road and Sleepy Hollow Road lies within
the corporate limits of the CITY.
NOW THEREFORE, in consideration of the mutual covenants contained herein, the
parties hereto agrees as follows:
(1) The CITY agrees to prepare the plans, specifications and estimates, including
the traffic control signalization, for such construction and shall submit
same to the COUNTY and to the Department of Transportation, Division of Highways,
State of Illinois for review and approval.
(2) The CITY agrees to receive bids, and upon approval by the COUNTY and the STATE,
award the contract, furnish engineering inspection during construction, and
cause the improvement to be built in accordance with the plans, specifications,
and contract.
(3) The CITY and COUNTY agree to pass resolutions appropriating sufficient funds
from Motor Fuel Tax Funds or other local funds to pay their share of the cost
of this improvement.
The COUNTY will, from time to time, issue warrants payable to the CITY,
for amounts equal to the payment recommended on monthly payment estimates as
submitted by the City's Engineer to cover the COUNTY'S share of the cost of
construction and engineering services. Upon completion of the construction
engineering costs.
(5) Upon completion of this improvement, the CITY will be responsible for main-
taining, energizing, and controlling the sequence and timing of the traffic
signals.
(6) This agreement and the covenants contained herein shall be null and void in
the event the contract covering the construction work contemplated herein is
not awarded by January 1, 1977.
(7) This agreement shall be binding upon and inure to the benefits of the parties
hereto, their successors and assigns.
