75-1216 Ryerson Avenue AGREEMENT WITNESSETH WHEREAS, City of Elgin is the owner of a certain public street commonly known as Ryerson Avenue which has been closed to through traffic at Walnut Avenue; and WHEREAS, Robert C. Juby is the owner and operator of a pharmacy located on the corner of Ryerson Avenue and Walnut Avenue; and WHEREAS, other commercial establishments are also located in the vicinity of Ryerson and Walnut Avenues; and j WHEREAS, said commercial establishments are in need of parking facilities for customers; and WHEREAS, it is in the best interest of the City of Elgin to provide parking facilities at such location upon the terms and conditions hereinafter set forth. NOW, THEREFORE, for and in consideration of the mutual covenants contained herein, the City of Elgin, hereinafter referred to as "City" and Robert C. Juby, hereinafter referred to as "Juby" agree as follows: 1. That the City of Elgin shall cause a parking lot to be con- structed on the west side of Ryerson Avenue south of Walnut Avenue in accordance with the plan prepared by the Department of Public Works, Engineering Division, of the City of Elgin, dated October 31, 1975, a copy of which is attached hereto and made a part hereof by reference. 2. That the estimated cost of said improvement is $7,707.96, of which Juby shall pay the sum till $4,827.96 within thirty (30) days of comple /' OPP tion of the improvement. , Is Lass T14140 .----) 3. That in the event that the cost of the improvement . ds thg sum of $7,707.96, Juby shall pay to the City of Elgin sixty (60) percent of the actual cost of said improvement within thirty (30) days after completion of the improvement. 4. That the improvement described herein shall be constructed as soon as practicable.
