75-0815 Spiess Co. AGREEMENT Agreement of lease made this 15 day of August, 1975 between the City of Elgin, Illinois, a home rule municipality, hereinafter called, Lessor, and Elgin Plaza Parking, Inc. , an Illinois corporation, having its principle office and place of business at 38-52 Fountain Square Plaza, Elgin, Kane County, Illinois, hereinafter called, Lessee. WHEREAS, pursuant to a certain joint construction contract dated May 3, 1974 City and the Joseph C. Spiess Company, an Illinois corporation, of which Lessee is a wholly owned subsidiary, have constructed a parking deck, ramps and appurtenant structures over and above Riverside Drive and the Riverside Muni- cipal Parking Deck; and WHEREAS, pursuant to said agreement City parking improvements have been constructed to the south end of Company parking improvements made by the Joseph C. Spiess many; and WHEREAS, Lessee is operating Company parking improvements for and on behalf of the Joseph C. Spiess Canpany; and WHEREAS, City desires that Lessee also operate City parking improvements upon the terms and conditions hereinafter set forth; and WHEREAS, Lessee desires to operate City parking improvements. Now, therefore, Lessor and Lessee, for and in consideration of the covenants and mutual agreements contained herein agree as follows: 1. That commencing August 18, 1975 Lessee shall operate Lessor's parking improvement consisting of 44 spaces located at the south end of the upper level of the Riverside Municipal Parking Deck. 2. That Lessee shall pay Lessor the sum of $2.50 per parking space on the tenth day of each month that this agreement is in effect. 3. Lessee, prior to commencing operations, shall provide Lessor with a certificate of insurance showing adequate garage keeper liability, public liabil- ity and property insurance, and naming Lessee as an additional insured under all such policies. 4. City shall provide all necessary maintenance services upon the leased premises including clean-up services upon notice frau Lessee. Additionally, Lessor shall provide the necessary snow plowing upon the leased premises following Page 1 of 2 the accumulation of two inches of snow. If practicable, all such maintenance services shall be performed during hours other than the normal business hours of the Joseph C. Spiess Company. 5. Lessee shall pay Lessor for all maintenance services performed under this agreement. Payments shall be made monthly and conputed according to the following schedule: RATE PER HOUR PER EACH WORK PERFORMED REGULAR TIME OVERTIME Pick up Debris and Waste Receptacles (1 truck with driver) $ 8.85 $ - Sweeping (1 sweeper with operator) - 18.00 Snow Plowing (1 truck with driver) 12.00 15.50 Snow Loading (1 endloader with operator) 19.00 23.00 Snow Hauling (1 truck with driver) 12.00 15.50 (additional trucks as needed up to a maximum of four) Maintain Lighting System 21.50 29.00 (high lift truck with 2 men) 6. We believe that this date would be the time that construction work had been completed to the extent that the facility could be opened for public use. The date on which the facility was publicly operable, and was in fact opened for public use, was July 18, 1975.
