AGREEMENT
This agreement made and entered into this 64A day of
, , w, , 1974 by and between the City of Elgin, a municipal
co /ration 'reinafter referred to as City, and Robert Skelly, Assistant
Superintendent of Schools, U-46 School District, Elgin, Illinois, herein-
after called School District.
WITNESSETI l
WHEREAS, City desires to use certain school property commonly
known as Abbott Field at Melrose and Carr Streets, Elgin, Illinois for
a public ice skating rink from January through March of 1974 approximately
100 feet by 100 feet in size; and
WHEREAS, School District has agreed to provide Abbott Field for
said usage.
NOW THEREFORE IN CONSIDERATION OF THE MUTUAL COVENANTS AND
PROMISES HEREIN SET FORTH IT IS MUTUALLY AGREED HEREIN BY AND BETWEEN
TUE PARTIES:
City agrees to indemnify and hold School District harmless
from and against all liabilities, judgments, costs, damages and expenses
which may accrue against, be charged to or recovered from School District
by reason or on account of damage to the property of School District or
the property of, injury to or death of any person, arising from City's use
of and operations at Abbott Field, including acts of its agents, except
when caused by School District's negligence or by the joint negligence of
School District and any person other than City or its agents;provided that
School District shall give City prompt and timely notice of any claim made
or suit instituted which in any way affects City or its insurer and City
or its insurer shall have the right to compromise and defend the same to
the extent of their own interests.
