HomeMy WebLinkAboutG43-16 Ordinance No. G43-16 AN ORDINANCE AMENDING THE ROUTE 19/EAST CHICAGO STREET AREA OF SPECIAL CHARACTER AND THE ASSOCIATED SPECIAL REGULATIONS FOR STREET GRAPHICS WHEREAS, Section 19.50.105 of the Elgin Municipal Code, 1976, as amended,provides that the City Council may designate specific locations within the City as areas of special character to provide appropriate flexibility in the regulation of street graphics and may adopt special regulations for these areas that can vary from the regulations contained within the City's Street Graphics Ordinance; and WHEREAS, the City Council, in its Ordinance No. G25-08, has designated the Route 19/East Chicago Street Area of Special Character, defined as all zoning lots of four (4) acres or more, fronting Route 19/East Chicago Street between Willard Avenue on the west and Shales Parkway on the east, and which zoning lots are occupied by motor vehicle dealers (the "Route 19/East Chicago Street Area of Special Character")pursuant to Section 19.50.105; and WHEREAS, the City Council, in its Ordinance No. G22-09, has adopted special regulations for the street graphics within the Route 19/East Chicago Street Area of Special Character pursuant to Section 19.50.105; and WHEREAS, written application has been made to add the Elgin High School campus, commonly referred to as 1200 Maroon Drive and legally described herein (the "Subject Property"), to the Route 19/East Chicago Street Area of Special Character and to adopt special regulations for street graphics specific to the Subject Property within the Route 19/East Chicago Street Area of Special Character; and WHEREAS, the Planning and Zoning Commission conducted a public hearing on September 6, 2016 following due notice by publication; and WHEREAS, the Community Development Department and the Planning and Zoning Commission have submitted their written findings of fact and recommendations concerning said application; and WHEREAS, the Community Development Department and the Planning and Zoning Commission recommend approval of said application, subject to the conditions articulated below; and WHEREAS, the City Council of the City of Elgin, Illinois has reviewed the findings and recommendations of the Community Development Department and the Planning and Zoning Commission; and WHEREAS, the City of Elgin is a home rule unit and as a home rule unit may exercise any power and preform any function pertaining to its government and affairs; and WHEREAS, zoning, including but not limited to, this ordinance approving the expansion of an existing area of special character and establishing special regulations for street graphics that otherwise depart from the Elgin Zoning Ordinance, pertain to the government and affairs of the city. NOW,THEREFORE, be it ordained by the City Council of the City of Elgin, Illinois: Section 1. That the City Council of the City of Elgin hereby adopts the Findings of Fact, dated September 6, 2016, made by the Community Development Department and the Planning and Zoning Commission, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That Section 19.50.105 of the Elgin Municipal Code, 1976, as amended, entitled "Areas of Special Character", be hereby amended by replacing only Section A.3. in its entirety with the following : 3. The Route 19/East Chicago Street area defined as all zoning lots of four (4) acres or more, fronting on Route 19/East Chicago Street between Willard Avenue on the west and Shales Parkway on the east, and which such zoning lots are occupied by motor vehicle dealers or Elgin High School. Section 4. That the special regulations for street graphics for the Route 19/East Chicago Street Area of Special Character, adopted by Ordinance G22-09, be and are hereby amended by replacing Section 1, Subsection 1 "Area Defined" in its entirety with the following : 1. Area Defined: The Route 19/East Chicago Street Area of Special Character shall encompass all zoning lots of four acres or more, fronting on Route 19/East Chicago Street between Willard Avenue on the west and Shales Parkway on the east, and which zoning lots are occupied by motor vehicle dealers or Elgin High School. Section 5. That the special regulations for street graphics for the Route 19/East Chicago Street Area of Special Character, adopted by Ordinance G22-09, be and are hereby amended by adding a new Section 1, Subsection 5 "Elgin High School" to read as provided below, and by renumbering Section 1, Subsections 5 and 6 accordingly: "5. Elgin High School: A. Monument Graphics: 1. Number. Elgin High School is permitted to have two (2) monument graphics; one located along Maroon Drive and the second along East Chicago Street. 2. Maximum Surface Area. The maximum surface area of the Maroon Drive monument graphic shall not exceed forty (40) square feet. The - 3 - maximum surface area of the East Chicago Street monument graphic shall not exceed one hundred and twenty four(124) square feet. 3. Maximum Height. The maximum height of the Maroon Drive monument graphic shall not exceed five (5) feet. The maximum height of the East Chicago Street monument graphic shall not exceed fifteen (15) feet. 4. Electronic/LED Changeable Copy. The East Chicago Street monument graphic may include an electronic/LED changeable copy panel not to exceed 26 square feet. 5. Design. The East Chicago Street monument graphic shall be constructed in substantial conformance with the one-page illustration of the monument graphic,prepared by Signet Sign Company and dated March 23, 2015 (attached hereto as Exhibit B), and the one-page plan which shows the location of the proposed monument graphic with dimensions, prepared by Signet Sign Company but undated (attached hereto as Exhibit C). The East Chicago Street monument graphic shall include landscaping as required by Section 19.50.070 E. of the Elgin Municipal Code, 1976, as amended, as generally depicted upon the one-page "Landscape Plan", prepared by Joseph E. Creadon, Elgin School District U46, and dated August 30, 2016. 6. Restrictions. The electronic/LED changeable copy panel shall be operated in compliance with the standards provided in Section 19.50.090I 5a-e of the Elgin Municipal Code, as amended. B. Wall Graphics: 1. Number. Elgin High School is permitted to have three (3) wall graphics along those facades generally facing and otherwise oriented toward Maroon Drive. 2. Maximum Surface Area. The maximum surface area of all wall graphics shall not exceed one hundred and eight(180) square feet. 3. Maximum Height. No wall graphic shall project higher than the parapet wall to which the graphic is attached. C. All Other Street Graphics: All other street graphics shall comply with the provisions of Chapter 19.50 of the Elgin Municipal Code, 1976, as amended, entitled"Street Graphics"." - 4 - Section 6. The Planning&Zoning Commission and the Community Development Department recommend approval of the application,subject to the standard conditions provided at the end of this report. Site Photos BACKGROUND Elgin High School is requesting a text amendment to the zoning ordinance, specifically Chapter 19.50, "Street Graphics," to add the school to the Route 19/East Chicago Street Area of Special Character as well as a map amendment to establish the special regulations for the street graphics at the school. Elgin High School proposes to replace the existing free-standing street graphic (sign) along East Chicago Street with a monument-style sign containing an electronic/LED panel.The existing sign is 21 feet tall, and the new sign will be 15 feet tall. The existing sign is 130 square feet, and the new sign is 124 square feet(recall that the base of monument signs is included within the overall size of the sign).The portion of the existing sign dedicated to copy is 130 square feet,and the portion of the new sign dedicated to copy is a fraction more than 46 square feet—a 65 percent reduction. Drilling down further,the portion of the existing sign dedicated to changeable copy is 78 square feet,and the portion of the new sign dedicated to changeable copy is under 26 square feet — a 66 percent reduction. The changeable copy on the current sign is a reader board changed by hand. The proposed electronic/LED panel can only be approved by designating the property within an area of special character and by establishing special regulations for the location,design,and operation of the associated graphics.Approval of such graphics must be approved by 2/3 affirmative vote of the Elgin City Council, following a public hearing conducted by, and recommendation from, the Planning&Zoning Commission. The existing free-standing sign was established by a grant of variation in 1983. That variation allowed a 22-foot tall, 144-square foot sign whereas the code at that time only allowed an 8-foot tall, 80-square foot sign. In 1998, a second variation allowed Elgin High School to continue to use the free-standing pole,but replace the 144-square foot sign on top thereof with the current 130-square foot sign. Today, the street graphics ordinance only allows one monument sign on this 70-acre campus (one already exists along Maroon Drive), and a monument sign along East Chicago Street could only be 10 feet tall and 60 square feet. The Route 19/East Chicago Street Area of Special Character was established in 2009 to accommodate the unique signage and advertising needs of the concentration of auto dealerships along this arterial street.However,the provisions of the zoning ordinance allow for the inclusion of special regulations for one, some, or all of the properties located within each area of special 2 Recommendation & Finding of Fact Petitions 23-16 &24-16 September 6, 2016 character,and the special regulations associated with this application would apply only to Elgin High School. The high school is requesting special regulations to accommodate the proposed monument graphic along East Chicago Street and to render conforming the existing modest wall signs and monument sign along Maroon Drive.The special regulations would not alter any other street graphic allowances otherwise afforded the high school by the street graphic ordinance and the CF Community Facility District. The current street graphic ordinance only allows one wall sign per street frontage and 240 square feet area total.The current building signage includes three wall signs facing Maroon Drive.Those signs total approximately 180 square feet. The wall sign along the west side of the building,visible from Varsity Drive,is exempt as Varsity Drive is not a public right of way.The monument sign at Maroon Drive is approximately 5 feet tall and approximately 40 square feet,which make it a conforming sign by size but not by number(recall this zoning lot may only have one monument sign).Any additional deviation or departure to the street graphics ordinance would require an amendment to these special regulations, reviewed and approved in the same fashion as a map amendment. In general, electronic changeable copy is only permitted at gas stations to display the price of gasoline, on zoning lots with frontage along Randall Road or along the northerly end of Rt 31, or within areas of special character established for the purpose of providing appropriate flexibility for the construction of graphics that would not otherwise be allowed by the ordinance. Areas of special character were first provided for in 2007 when properties around the intersection of Randall Road and I-90 were given the ability to display information about their businesses on electronic changeable copy graphics containing electronic display(LED)panels. The city has since established five areas of special character as follows: 1. The Randall/90 Auto Mall, located at the northwest corner of Randall Road and I-90. 2. The Randall Road/I-90 area consisting of properties with frontage along I-90 and/or Randall Road, including: a. Randall Point Executive Center Subdivision; b. Randall Point Executive Center II Subdivision; c. 1707 North Randall Road occupied by John B. Sanfilippo and Son, Inc. (Fisher Corporate Center); d. Randall Point West Subdivision; e. The Grove Subdivision; f. 2000 Fox Lane occupied by Rieke Office Interiors; and g. Capital Corporate Center Subdivision. 3. Route 19/East Chicago Street, comprising the auto dealers on zoning lots greater than four (4) acres and located between Willard Avenue and Shales Parkway. 3 Recommendation & Finding of Fact Petitions 23-16& 24-16 September 6, 2016 4. Elgin Community College, for its 179 acre campus located at 1700 Spartan Drive. 5. The Elgin Sports Complex at 709 Sports Way. FINDINGS FOR AN AREA OF SPECIAL CHARACTER After due notice as required by law,the Planning&Zoning Commission conducted a public hearing in consideration of Petitions 23-16 and 24-16 on September 6,2016.Testimony was presented at the public hearing in support of the application.The Community Development Department submitted a Text and Map Amendment Review and Written Findings & Recommendation to the Planning & Zoning Commission dated September 6, 2016. Section 19.50.105 D. of the Zoning Ordinance requires that an Application for an Area of Special Character be evaluated against the standards for map and text amendments set forth in§ 19.55.030 as well as the three additional standards set forth in § 19.55.105 D. The Planning&Zoning Commission and the Community Development Department have made the following findings regarding this application against the standards for a map amendment: A. Site Characteristics Standard. The suitability of the subject property for the intended zoning district with respect to its size, shape, significant natural features (including topography, watercourse and vegetation), and existing improvements. Findings. The subject property is suitable for the intended area of special character with respect to its size,shape,significant natural features(including topography,watercourse and vegetation), and existing improvements. The subject property is approximately 70 acres, irregularly shaped, and is improved with a high school, athletic fields, and accessory off- street parking.The property slopes downward significantly from the grade established along East Chicago Street. B. Sewer and Water Standard. The suitability of the subject property for the intended zoning district with respect to the availability of adequate municipal water, wastewater treatment, and storm water control facilities. Findings. The subject property is suitable for the intended area of special character with respect to the sewer and water standard. While municipal sanitary sewer and water systems are readily available,the change to the street graphic along East Chicago Street that would be permitted by this area of special character does not affect existing sewer, water, or stormwater control facilities. 4 Recommendation & Finding of Fact Petitions 23-16 &24-16 September 6, 2016 C. Traffic and Parking Standard. The suitability of the subject property for the intended zoning district with respect to the provision of safe and efficient on-site and off-site vehicular circulation designed to minimize traffic congestion. Findings. The subject property is suitable for the intended area of special character with respect to the traffic and parking standard. The change to the street graphic along East Chicago Street that would be permitted by this area of special character does not affect existing curb cuts,access drives,or parking spaces,and the street graphic would be well out of the 20-foot line of sight control area required by the zoning ordinance. D. Zoning History Standard. The suitability of the subject property for the intended zoning district with respect to the length of time the property has remained undeveloped or unused in its current zoning district. Findings. The subject property is suitable for the intended area of special character with respect to the length of time the property has remained undeveloped or unused in its current zoning district. City records show that, in the years listed below, the subject property was zoned as follows: 1927 Out of the City 1950 Out of the City 1962 R-2 Single Family Residence District 1992 R-2 Single Family Residence District Current CF Community Facility District. The free-standing sign was established by a grant of variation in 1983.That variation allowed a 22-foot tall, 144-square foot sign whereas the code only allowed an 8-foot tall, 80-square foot sign. In 1998,a second variation allowed Elgin High School to continue to use the free- standing pole, but replace the 144-square foot sign on top thereof with the 130-square foot sign that exists today. The proposed street graphic continues to bring the sign closer to compliance with the zoning ordinance. E. Surrounding Land Use and Zoning Standard. The suitability of the subject property for the intended zoning district with respect to consistency and compatibility with surrounding land use and zoning. Findings. The subject property is suitable for the intended area of special character with respect to consistency and compatibility with surrounding land use and zoning. The properties to the west, south, and east contain various densities of residential land use,well away from the proposed street graphic.Approximately 800 feet to the west,Oakwood Hills townhouses are zoned PMFR Planned Multiple Family Residence District and PRC Planned Residence Conservation District.To the south,on the other side of the approximately 70-acre campus, single-family homes are also zoned PRC. And approximately 500 feet to the east, 5 Recommendation & Finding of Fact Petitions 23-16 &24-16 September 6, 2016 properties are zoned TFR Two Family Residence District and developed with two-family dwellings. The land located immediately north of the subject property, across East Chicago Street, is zoned PAB Planned Area Business and improved with the Elgin Hyundai auto dealership. Also north of the subject property and west of Elgin Hyundai, Squire Village apartments are located along Poplar Creek Drive. Squire Village is zoned PRC Planned Residence Conservation District. The proposed street graphic does not conflict with the surrounding land use and zoning. F. Trend of Development Standard. The suitability of the subject property for the intended zoning district with respect to consistency with an existing pattern of development or an identifiable trend of development in the area. Findings. The subject property is suitable for the intended area of special character with respect to consistency with the existing pattern of development.Elgin High School is a large institutional land use surrounded by residential development of varying densities. The high school was built in/around 1972.The high school has frontage along Chicago Street,which is home to a concentration of auto dealerships, and Elgin Hyundai is immediately across Chicago Street.The proposed street graphic does not conflict with this land use pattern or in any other way interrupt the trend of development. G. Zoning Districts Standard. The suitability of the subject property for the intended zoning district with respect to conformance to the provisions for the purpose and intent, and the location and size of a zoning district. The applicant seeks to add the subject property to an existing area of special character. The purpose of an area of special character is to provide appropriate flexibility in the regulation of street graphics at unique locations in the city. The auto dealerships along East Chicago Street,between Willard Avenue and Shales Parkway,are already an area of special character, established in 2009, and the application would add Elgin High School to this unique area. The 70-acre high school campus is certainly unique; the city has only one other public high school within its municipal boundary. The provisions for an area of special character allow for the adoption of special regulations for all or a portion of the delineated area therein and, in this case, allow for the adoption of special regulations to accommodate a 70-acre high school campus with more than 1,300 feet of frontage on Chicago Street and varying densities of residential land use abutting on three sides. H. Comprehensive Plan Standard. The suitability of the subject property for the intended zoning district with respect to conformance to the goals, objectives, and policies of the official comprehensive plan. 6 Recommendation & Finding of Fact Petitions 23-16 &24-16 September 6, 2016 Findings. The subject property is suitable for the intended area of special character with respect to the Comprehensive Plan Standard. The subject property is designated as"Civic, Schools (Secondary& Higher) & Hospitals" by the City's 2005 Comprehensive Plan and Design Guidelines. This institutional land use designation includes a wide range of public and quasi-public uses, including public and private schools, colleges and universities, government offices, transportation facilities,public utilities,hospitals, community centers, museums, and public libraries. To the extent possible, this land use designation should be clustered in activity centers to support other similar uses and benefit from access to various modes of transportation. Next,the Planning&Zoning Commission and the Community Development Department have made the following findings regarding this application against the standards for an area of special character: A. Area Characteristics: The suitability of the subject property for the intended area of special character with regard to the unique and particular characteristics of the area including its location,size,shape,significant natural features, including topography, water courses and vegetation, the nature of adjoining public rights of way, and architectural, historic or scenic features. Findings. The subject property is located within an area that possesses unique and particular characteristics of location, size, shape,and significant natural features.The city has already determined that the concentration of auto dealerships along East Chicago Street constitute a unique character by the 2009 establishment of an area of special character.This application would add a 70-acre,public high school campus—one of only two in the city—and establish special regulations for just that campus. Elgin High School has more than 1,300 feet of frontage along East Chicago Street, is across the street from a new auto dealership (Elgin Hyundai), and yet is surrounded on three other sides by residential land uses of varying densities.Along East Chicago Street,the grade of the property drops down significantly from the grade at East Chicago Street. B. Use Characteristics: The suitability of the subject property for the intended area of special character with regard to the existing or proposed use of the area along with specified unique challenges and demands such that the street graphics ordinance cannot adequately regulate street graphics for such use in such area. Findings:Elgin High School has been at this location since 1972,and it would benefit from the accommodations allowed by an area of special character due to the unique challenges and demands that the street graphics ordinance cannot adequately address. This 70-acre high school campus only has one principal building. As such, and with the existing CF Community Facility District and a 40-mph speed limit on East Chicago Street, the street graphics ordinance would only allow one monument sign on the property.More so, 7 Recommendation & Finding of Fact Petitions 23-16 & 24-16 September 6, 2016 that sign could not be more than 10 feet tall or 60 square feet. The campus already has an existing monument sign along Maroon Drive, and the proposed monument sign along East Chicago Street is 15 feet tall and 124 square feet. C. Special Regulations: The suitability of the subject property for the intended area of special character with regard to special regulations that are consistent with the unique character and unique use of the area, and for which departures from the street graphics ordinance, if any, are specifically limited to address the unique and particular characteristics and use of the proposed area. Findings:The special regulations associated with this application are for Elgin High School only and are consistent with the unique nature of Elgin High School.The departures from the street graphics ordinance are specifically limited to address the unique and particular characteristics and use of the high school. First, the street graphics ordinance limits the use of electronic changeable copy only to the display the price of gasoline at gas stations and to properties with frontage along Randall Road and the northerly portion of State Route 31. An area of special character provides for the use of these special graphics in other areas of the community. Elgin High School has been changing sign copy by hand at this location since 1983. This sign may only display messages pertaining to Elgin High School,its amenities,and programs.The images,displays, or messages of any type will be static,without any movement or motion,and those images, displays, or messages must be displayed for a time interval of at least ten seconds. Second, the monument sign will be 15 feet high and 124 square feet whereas a monument sign at this location may only be 10 feet high and 60 square feet. At the location of the proposed sign, near the vehicular access point at East Chicago Street, the elevation of the property drops off significantly from East Chicago Street,making the additional height and area necessary for visibility. Third, Elgin High School already has a monument sign along Maroon Drive. This sign conforms to the size requirement of the zoning ordinance,but the ordinance only permits one monument sign per principal building,and the only principal building on this 70-acre zoning lot is the high school. The proposed second monument sign would be more than 2,000 feet from the Maroon Drive monument sign. Finally, the high school has three wall signs visible from Maroon Drive. The zoning ordinance only allows one wall sign,and that sign cannot exceed 240 square feet.The size of all three existing wall signs is 180 square feet total. While Section 19.55.030 has no specific standards against which a text amendment is to be reviewed,the Planning&Zoning Commission and the Community Development Department find that the proposed revisions to the text of the Zoning Ordinance: 8 Recommendation & Finding of Fact Petitions 23-16 &24-16 September 6, 2016 1. Promote the free flow of traffic and protect pedestrians and motorists from injury and property damage caused by, or which may be fully or partially attributable to cluttered, distracting, or illegible signage; 2. Promote the use of graphics which are aesthetically pleasing, of appropriate scale, and integrated with surrounding buildings and landscape, in order to meet the community's expressed desire for quality development; 3. Provide functional flexibility,encourage variety, and create an incentive to relate signing to basic principles of good design; 4. Assure that public benefits derived from expenditures of public funds for the improvement and beautification of streets, and other public structures and spaces, are protected by exercising reasonable controls over the character and design of graphic structures; and 5. Provide an improved visual environment and protect prominent view sheds within the community by authorizing the use of street graphics that are: a. Compatible with their surroundings; b. Appropriate to the activity that displays them; c. Expressive of the identity of individual activities and the community as a whole;and d. Legible in the circumstances in which they are seen. The above items are derived from Section 19.50.010,the statement of purpose for the street graphics ordinance. DEPARTURES AND EXCEPTIONS The approval of this application would include the following departures from the requirements of the Zoning Ordinance: 1. A one-page photograph of the existing sign to be removed with dimensions, prepared by Signet Sign Company but undated; c. A one-page illustration of the proposed sign to be installed with dimensions, prepared by Signet Sign Company and dated March 23, 2015; d. A one-page illustration showing the proposed sign overlaid against the existing sign all with dimensions, prepared by Signet Sign Company and dated March 23, 2015; e. A one-page "Landscape Plan"with dimensions,prepared by Joseph E. Creadon, Elgin School District U46, and dated August 30, 2016; and f. A one-page plan which shows the location of the proposed sign with dimensions, prepared by Signet Sign Company but undated. 2.
