AN ORDINANCE
REPEALING THE AMENDATORY PROVISIONS OF ORDINANCE NO. G57-14
REGARDING THE DEFINITION AND SUPPLEMENTARY REGULATIONS
FOR MEDICAL CANNABIS DISPENSING ORGANIZATIONS
WHEREAS,on February 12,2014,the city council of the City of Elgin adopted Ordinance
No. G9-14 amending Title 19 of the Elgin Municipal Code, 1976, as amended, entitled "Zoning"
to provide for regulations relating to medical cannabis; and
WHEREAS, on October 8, 2014, the city council adopted Ordinance No. G57-14
amending Section 19.90.015 of the Elgin Municipal Code, 1976,as amended,entitled"Definitions
and Regulations" regarding the definition and supplementary regulations for Medical Cannabis
Dispensing Organizations; and
WHEREAS,the City is a defendant in Case No. 14 MR 1227 pending in the Circuit Court
of Kane County, under which the provisions of Ordinance No. G57-14 amending Section
19.90.015 of the Elgin Municipal Code, 1976, as amended, regarding the definition and
supplementary regulations for Medical Cannabis Dispensing Organizations are at issue; and
WHEREAS, because there is no pending application for a Medical Cannabis Dispensing
Organization in the City, and because the city council desires to minimize the cost of unnecessary
litigation,the city council has determined that it is appropriate to repeal the amendatory provisions
of Ordinance No. G57-14, so as to return to the definition and regulations for medical cannabis
dispensing organizations as originally provided in Ordinance G9-14.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That the amendatory provisions of Ordinance No. G57-14 be and are hereby
repealed, it being the intent of this ordinance that the definition and regulations for a Medical
Cannabis Dispensing Organization [SR] shall be as originally provided in Ordinance No. G9-14.
Section 2. That all ordinances are parts of ordinance in conflict with the provisions of
this ordinance be and are hereby repealed to the extent of any such conflict.
Section 3. This ordinance shall be in full force and effect upon its passage and
publication in the manner provided by law.
