AN ORDINANCE
AMENDING PORI PLANNED OFFICE RESEARCH INDUSTRIAL
DISTRICT ORDINANCE NO. G26-01
(Northwest Business Park)
(2700-2880 Galvin Drive and 2755-2794 Spectrum Drive)
WHEREAS, the subject property referred to herein has been previously classified in the
PORI Planned Office Research Industrial District pursuant to Ordinance No. G54-00; and
WHEREAS, the PORI Planned Office Research Industrial District established by
Ordinance No. G54-00 was amended in its entirety by Ordinance No. G26-01, the effect of
which was to adopt an amended PORI Planned Office Research Industrial District for the
property described below; and
WHEREAS, written application pursuant to petition 25-12 has been made to amend
certain provisions of Ordinance No. G26-01; and
WHEREAS, after due notice in the manner provided by law, the Planning & Zoning
Commission has conducted a public hearing concerning said application and has submitted its
written findings and recommendations; and
WHEREAS, the City Council of the City of Elgin concurs in the findings and
recommendation of the Planning & Zoning Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That the City Council of the City of Elgin hereby adopts the Findings of
Fact, dated July 2, 2012 made by the Planning & Zoning Commission, a copy of which is
attached hereto and made a part hereof by reference as Exhibit A.
Section 2. That Ordinance No. G26-01 entitled "An Ordinance Repealing Ordinance
G54-00 and Reclassifying Property in the PORI Planned Office Research Industrial District",
passed May 9, 2001, be, and is hereby amended only as set forth in this ordinance by amending
Section 3.F.5.b.(2) thereof entitled '`Interior Setback" as follows:
"(2) The minimum required vehicle use area setback from an interior lot line
shall be 6 linear feet, except for the vehicle use area located at 2760-2780
Spectrum Drive, for which the vehicle use area setback shall be a minimum of
3.80 feet, as identified in the ALTA/ACSM Land Title Survey of Northwest
Business Park III, Sheet 1 of 1, prepared by Cowhey Gudmundson Leder, Ltd.
dated March 9, 2011, and except for the vehicle use area located at 2784-2794
Spectrum Drive, for which the vehicle use area setback shall be a minimum of
5.54 feet, as identified in the ALTA/ACSM Land Title Survey of Northwest
• Business Park VI, Sheet 1 of 1, prepared by Cowhey Gudmundson Leder, Ltd.,
dated March 9, 2011."
Section 3. That except as specifically amended herein Ordinance G26-01 shall
remain in full force and effect.
Section 4. That this ordinance shall be in full force and effect immediately after its
passage in the manner provided by law.

• BACKGROUND
An application has been filed by Interstate Partners LLC, requesting a map amendment to the
PORI Planned, Office Research Industrial District Ordinance Number G26-01; the subject
property is located at 2700 — 2880 Galvin Drive and 275 — 2794 Spectrum Drive (reference
Exhibits A; B, C, D, and E).
The property was annexed, granted preliminary plat approval; and zoned PORI Planned Office
Research Industrial District and PCF Planned Community Facility District in September of 2000.
The. property encompasses approximately 88 acres of land area and is improved with seven
office/research/industrial buildings, and related off street parking.
The applicant is requesting a map amendment to allow for a departure from the provisions of the
Zoning Ordinance with respect to interior vehicle use area setback.
FINDINGS
After due notice, as required by law, the Planning & Zoning Commission held a public hearing
in consideration of Petition 25-12 on July 2, 2012. The applicant testified at the public hearing
and presented documentary evidence in support of the application. The Community
Development Department submitted a Planned Development Review, dated June 27, 2012.
• The Planning &Zoning Commission has made the following general findings:
The applicant is requesting a map amendment to allow fora departure from the provisions of the
Zoning Ordinance with respect to interior vehicle use area setback
Per the approved ordinance, the interior vehicle use area setback is six feet. Two established
buildings in the Northwest Business Park 2760-2780 Spectrum Drive (Northwest Business Park
III) built in 2002 and 2784-2794 Spectrum Drive (Northwest Business Park VI) built in 2005,
have several encroachments, ran ging from 3.80 feet to 5.54 feet from an interior lot line
(reference Exhibits F).
The granting of the requested departures can only be provided through a planned development
approval that requires a public hearing and City Council approval.
PLANNED DEVELOPMENT DEPARTURES AND EXCEPTIONS
A planned development may be granted certain departures from the normal standards;
regulations; requirements; and procedures of the zoning ordinance. For the purposes of this
section; the most similar zon*M' district is the ORI Office Research Industrial District. The
applicant is requesting the following departure from the standard requirements of the ORI Office
Research Industrial District:

The applicant is requesting the following departure from the requirements of Ordinance G26-01
entitled "An Ordinance Repealing Ordinance No. G54-00 and Reclassifying Property in the
PORI Planned Office Research Industrial District (Northwest Business Park)":
A. Section 19.40.135: E.2.b. Vehicle Use Area Interior Setback. The ORI District
requires a minimum vehicle use area setback of 6 feet from an interior lot line. The
existing vehicle use area encroachment from an interior lot line for both-buildings ranges
from 3.80 feet to 5.54 feet.
RECOMMENDATION
The Planning & Zoning Commission recommends approval of Petition 25-12. On a motion to
recommend approval, subject to the following conditions, the vote was six (6) yes and zero (0)
no.
1. Substantial conformance to the Petitioner's Statement of Purpose and Conformance,
submitted with the development submitted by prepared by Interstate Partners LLC, dated
received June 1, 2012.
2. Substantial conformance to the legal description prepared by Interstate Partners, as
applicant and owner, dated received June 1, 2012.
�• 3. Substantial conformance to the Consent and Disclosure, dated received June 1, 2012.
4. Substantial conformance to the ALTAJACSM Land Title Survey of Northwest Business
Park III, Sheet 1 of 1, prepared by Cowhey Gudmundson Leder, Ltd. dated March 9,
2011 and dated received June 1, 2012.
5. Submittal conformance to the ALTA/ACSM Land Title Survey of Northwest Business
Park VI, Sheet 1 of 1, prepared by Cowhey Gudmundson Leder, Ltd., dated March 9,
2011 and dated received June 1, 2012.
6. Compliance with all other applicable codes and ordinances.
Therefore, the motion to recommend approval of Petition 25-12 was adopted.
