HomeMy WebLinkAboutG18-12 Ordinance No. G18-12 AN ORDINANCE GRANTING A CONDITIONAL USE FOR A PHYSICAL FITNESS FACILITY IN THE NB NEIGHBORHOOD BUSINESS DISTRICT (730 A West Chicago Street) WHEREAS, written application has been made requesting conditional use approval for a physical fitness facility in the NB Neighborhood Business District; and WHEREAS, the Planning and Zoning Commission conducted a public hearing after due notice by publication and has submitted its findings of fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs with the findings and recommendation of the Zoning and Subdivision Hearing Board. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council of the City of Elgin hereby adopts the Findings of Fact, dated February 15, 2012, made by the Zoning & Subdivision Hearing Board, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. r Section 2. Draft Conditional Use Ordinance (see attached) BACKGROUND An application has been filed by Mariana Delgado requesting a conditional use to permit the establishment of a physical fitness facility in the NB Neighborhood Business District. The subject property is located at 730 A West Chicago Street(reference Exhibits A,B, C, D, and E). The applicant is proposing to operate a physical fitness facility at the subject property. The proposed facility will occupy 2,100 square feet within a vacant tenant space in Oak Tree Plaza. The facility will operate Monday thru Friday from 8:30 a.m. to 10:30 a.m. and from 5:00 p.m. to 9:00 p.m. as well as Saturday's from 8:00 a.m. to 10:00 a.m. They will be conducting aerobic classes in the form of"Zumba"classes. There will be approximately 10 to 15 people per class. In addition, beauty presentations and wellness workshops will be held on Saturday mornings in order to purchase beauty products such as Avon, Mary Kay, and Jafra as well as health supplements such as Herbalife from product sales representatives. Staff will be hired to operate the fitness studio which includes a fitness instructor, a cleaning person and registration person. Physical fitness facilities are conditional uses in the NB Neighborhood Business District, and require a public hearing and City Council approval (reference Exhibits F, G, and H). 1111/ GENERAL FINDINGS After due notice, as required by law, the Zoning & Subdivision Hearing Board conducted a public hearing in consideration of Petition 03-12 on February 15, 2012. Testimony was presented at the public hearing in support of the application. No objectors were present. The Community Development Department submitted a Conditional Use Review dated February 15, 2012. The Planning and Zoning Commission has made the following general findings: A. Zoning History Standard. The suitability of the subject property for the intended conditional use with respect to the length of time the property has remained undeveloped or unused in its current zoning district. Findings. A commercial building was built in 1965. The subject property was rezoned to NB Neighborhood Business District as part of the comprehensive amendment to the zoning ordinance in 1992. B. Surrounding Land Use and Zoning Standard. The suitability of the subject property for the intended conditional use with respect to consistency and compatibility with surrounding land use and zoning. Findings. The subject property is suitable for the intended conditional use with respect to consistency and compatibility with surrounding land use and zoning. The area located to the north of the subject property is zoned PGI Planned General Industrial District and RC3 Residence Conservation District and is improved with single family residential homes, commercial uses and offices. rkilk The areas to the west, and east are zoned RC3 Residence Conservation District, and are improved single family residential homes. The area to the south is zoned NB Neighborhood Business District and is improved with commercial uses and fire station. C. Trend of Development Standard. The suitability of the subject property for the intended conditional use with respect to its consistency with an existing pattern of development or an identifiable trend of development in the area. Findings: The subject property is suitable for the intended conditional use with respect to the trend of development standard. The subject property is located within an area which is developed with a mix of residential homes, commercial uses, a school and fire station. D. Zoning District Standard. The suitability of the subject property for the intended conditional use with respect to conformance to the provisions for the purpose and intent, and location and size of the zoning district. Findings. The subject property is suitable for the intended conditional use with respect to conformance to the provisions for the purpose and intent, and location and size of the zoning district. rink 3 Findings of Fact Zoning& Subdivision Hearing Board Petition 03-12 February 15, 2012 al."11) The purpose of the NB Neighborhood Business District is to provide for commercial areas daily convenience commodities and services to a neighborhood population. The scale of development of an NB zoning district is limited by the applicable site design regulations due to its function and resulting close proximity to residences. A physical fitness facility is classified as a conditional use in this NB Neighborhood Business District. The proposed business is in keeping with the intent of the NB district. The proposed business will provide for a physical fitness facility to the surrounding area and will conduct aerobic classes, operating Monday thru Friday from 8:30 a.m. to 10:30 a.m. and from 5:00 p.m. to 9:00 p.m. Saturday's from 8:00 a.m. to 10:00 a.m. The average number of users of the facility during peak hours is expected to be between 10- 15 people. STANDARDS FOR CONDITIONAL USES The Planning and Zoning Commission has made the following findings concerning the standards for conditional uses: A. Site Characteristics Standard. The suitability of the subject property for the intended conditional use with respect to its size, shape, significant features including topography, watercourses, vegetation, and existing improvements. Findings.The subject property is suitable for the intended conditional use with respect to the site characteristics standard. The subject property is comprised of a 1.45 acre commercial subdivision commonly known as Oak Tree Plaza. The shopping center was developed in 1965, with a 19,000 square feet commercial building, containing 12 tenant spaces, and off-street parking. The proposed 2,100 square foot physical fitness establishment will occupy one vacant tenant space within the existing commercial building. B. Sewer and Water Standard. The suitability of the subject property for the intended conditional use with respect to the availability of adequate municipal water, wastewater treatment, and storm water control facilities. Findings.The subject property is suitable for the intended conditional use with respect to the sewer and water standard. The subject property is served by municipal water, sanitary sewer. 4 i f Findings of Fact Zoning& Subdivision Hearing Board Petition 03-12 February 15, 2012 C. Traffic and Parking Standard. The availability of the subject property for the intended conditional use with respect to the provision of safe and efficient on-site and off-site vehicular circulation designed to minimize traffic congestion. Findings. The subject property is suitable for the intended conditional use with respect to the traffic and parking standard. The subject property is located at the northwest corner of West Chicago Street and Union Street. The site has an access drive off of West Chicago Street and an access drive off of Union Street. West Chicago Street is a collector street serving the west side of Elgin. Union Street is a local street serving the neighborhoods in the vicinity of the commercial center. Off street parking is provided in conformance with the off street parking ordinance. D. Comprehensive Plan Standard. The suitability of the subject property for the intended conditional use with respect to conformance to the goals, objectives, and policies of the official comprehensive plan. Findings. The subject property is suitable for the intended conditional use with respect to the Comprehensive Plan Standard. The subject property is designated as Neighborhood Mixed Use Center by the City's Comprehensive Plan and Design Guidelines dated 2005. Neighborhood Mixed Use Centers are designed to meet the daily "convenience" goods and service needs of residents in immediately adjacent neighborhoods. There size would not generally exceed 10 to 30 acres, and would include a mix of small scale retail/service uses, a neighborhood park, and possibly an institutional use such as a church or elementary school. Access is generally from local and collector streets. Too numerous to indicate on the Land Use Plan Map (except for existing locations), neighborhood mixed use centers should be specifically located and mapped in the course of more focused planning efforts and development review. E. Location, Design, and Operation Standard. The suitability of the subject property for the intended conditional use with respect to it being located, designed, and operated to promote the purpose and intent of this title and chapter. Findings.The subject property is suitable for the intended conditional use with respect to it being located, designed, and operated so as to promote the purpose and intent of the zoning ordinance. No evidence has been submitted or found that the proposed conditional use will be located, designed, or operated in a manner that will exercise undue detrimental influence 5 Findings of Fact Zoning& Subdivision Hearing Board Petition 03-12 February 15, 2012 on itself or surrounding property. F. Historic Preservation Standard. Where applicable, the conditional use shall make possible an efficient contemporary use of or a compatible improvement to a designated landmark or property located in a designated historic district while preserving those portions and features of the property which are significant to its historic, architectural, and cultural values to an historic preservation plan. Findings. The subject property is suitable for the intended conditional use with respect to the Historic Preservation standard. The subject property is not located within a designated historic district. SUMMARY OF FINDINGS, UNRESOLVED ISSUES,AND ALTERNATIVES The Zoning & Subdivision Hearing Board has developed or identified the following findings, unresolved issues, and alternatives: A. Summary of Findings. Positive Attributes: Approval of the requested conditional use to establish the proposed .41 physical fitness facility at 730 A West Chicago Street will allow the applicant to offer ") physical fitness services to the residents in the surrounding neighborhoods. B. Summary of Unresolved Issues. There are no unresolved issues. C. Summary of Alternatives. Other than an approval, a denial, or an approval with some combination of conditions, there are no substantive alternatives. DECISION The Zoning & Subdivision Hearing Board recommends the approval of Petition 03-12. On a motion to recommend approval of the conditional use, subject to the following conditions, the vote was four(4) yes and zero (0)no: 1. They will conduct aerobics classes in the form of"Zumba"which will fill classes that are not taught at the Gould Academy of Dance.
