HomeMy WebLinkAboutG75-07 { Ordinance No. G75-07 AN ORDINANCE ESTABLISHING FEES AND CHARGES FOR THE USE OF THE CENTRE WHEREAS, the City Council has determined that it is necessary and proper to establish an amended fee schedule and other policies relative to the operation of The Centre. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. A minimum of one adult and a maximum of two adults all residing in the same household is required. (Note: No more that 2 adults per membership) • The additional member rate only applies to youth residing in the same household being added to a couple membership to make up a family unit. • An adult is defined as a person 18 years of age or older. • A youth is defined as a person three years of age or older but less than 18 years of age or a person between 18 and 23 years of age currently enrolled as a full-time student. • A child is defined as a person less than three years of age. Children are free. • A senior is defined as a person 62 years of age or older. • Youths less than 14 years of age may not use the health fitness center. Youths,ages 14 to 17, may use the health fitness center but must first submit a waiver executed by a parent or legal guardian. • Youths may not use the health fitness center locker room. • Youths under the age of nine must be accompanied by adults at all times when using the aquatic center. • Youths 10 years of age and younger must be accompanied by an adult or legal guardian at all times when using the racquetball facilities. 5 • • 501C3 Organizations must have a principal place of business in the corporate city limits of the City of Elgin to receive the 501 C3 Organization room rental rates. • The Centre Manager with the approval of the City Manager or his or her designee shall have the authority to implement periodic promotional programs or discounts as an incentive to generate additional or renewed memberships. • The Manager of The Centre shall have the authority to reduce the room rental rates for the Banquet Room,Gymnasium,Kitchen,Meeting/Conference Room,Party Room and Program Room subject to the following conditions: A. A potential customer has presented a written proposal from a bona fide competitor that is quoting a price for the rental of a competing room facility at a rate that is less than the rate established by the city for a similar product; B. The Manager of The Centre reasonably believes that the potential customer will contract for services with the competing facility unless the applicable room rental rate is reduced in an amount that makes the city facility competitive with the rival written proposal; C. The Manager of The Centre reduces the applicable room rental rate in the smallest amount necessary to secure a contract with the potential customer; and D. Except as otherwise provided in this paragraph, the fee reduction will not exceed twenty-five percent (25%) of the applicable room rental rate established by this ordinance unless the rental includes food or bar packages. The Manager of The Centre may reduce the room rental rates in excess of twenty-five percent(25%)of the applicable room rental established by this ordinance provided the proposed fee reduction is reviewed and approved by the city manager or his or her designee. Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. That this ordinance shall be in full force and effect from and after January 1, 2008.
