AN ORDINANCE
AMENDING CHAPTER 14.04 OF THE ELGIN MUNICIPAL CODE, 1976,
AS AMENDED, ENTITLED "WATER REGULATIONS"
WHEREAS, the City of Elgin is a home rule unit and may exercise any power and
perform any function pertaining to its government and affairs; and
WHEREAS, the City of Elgin maintains a public water supply system; and
WHEREAS, regulations pertaining to water conservation with respect to the city's public
water supply system is a matter pertaining to the city's government and affairs.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That Chapter 14.04 of the Elgin Municipal Code, 1976, as amended,
entitled "Water Regulations" be and is hereby further amended by adding a new
section 14.04.390 thereto entitled "Water Conservation" to read as follows:
"14.04.390: WATER CONSERVATION

A. The provisions of this section shall apply to all persons using water provided by
the city. It shall be unlawful for any person to use city water contrary to the provisions of this
section.
B. When the city manager determines that the capacity of the water system of the
city to serve the public health needs of the city is threatened by the use of water for nonessential
purposes, the city manager shall have the authority to issue one or more of the following water
conservation restrictions:
1. Level 1. All use of city water for the irrigation of outdoor vegetation is prohibited
between the hours of 10:00 a.m. and 6:00 p.m. For the purposes of this section,
"outdoor vegetation" means that portion of any property under cultivation with
grass, trees, shrubs,bushes, gardens or other similar vegetation.
2. Level 2. All properties with even numbered street addresses may use city water
for the irrigation of outdoor vegetation on even numbered days of the month only
and all properties with odd numbered street addresses may use city water for the
irrigation of outdoor vegetation on odd numbered days of the month only,
provided however, all use of city water for the irrigation of outdoor vegetation is
prohibited between the hours of 10:00 a.m. and 6:00 p.m.
3. Level 3. All properties with even numbered street addresses may use city water
•.. for the irrigation of outdoor vegetation on even numbered days of the month only
and only with a hand-held hose, and all properties with odd numbered street
addresses may use water for irrigation of outdoor vegetation on odd numbered
days of the month only and only with a hand-held hose, provided however, all use
of city water for the irrigation of outdoor vegetation is prohibited between the
hours of 10:00 a.m. and 6:00 p.m.
4. Level 4. All use of city water for the irrigation of outdoor vegetation is
prohibited.
5. Level 5. All outdoor use of city water is prohibited including, but not limited to,
irrigation of outdoor vegetation, cleaning of outdoor surfaces, ornamental
fountains not employing a recirculating system, swimming pools with a capacity
greater than fifty (50) gallons and not employing a filter and recirculating system,
and washing of cars.
C. The following circumstances shall be exempt from the above-listed water
conservation restrictions:
1. The use of water which is required for the control of dust or the compaction of
soil.
2. Water that is used for street sweeping, sewer maintenance or other established
utility and public works practices.
3. Water that is used by the fire department.
4. Water that is used for vegetable gardens or lawn newly seeded or sodded within
the previous three(3)weeks.
D. Upon the issuance of any of the above water conversation restrictions, the city
manager shall cause notice to be given by press release to radio, newspaper and other media
outlets.
E. It shall be the further duty of the city manager to determine when an adequate
water supply has been restored as to permit the use of city water for non-essential purposes and
the lifting of any water conservation restrictions. Upon making such a determination, the water
conservation restrictions shall be lifted. The city manager shall also give notice of such
determination and the lifting of the water conservation restrictions as provided in this section.
Section 2. That Chapter 19.52 of the Elgin Municipal Code, 1976, as amended,
entitled "Lawn Sprinkling" be and is hereby repealed.
Section 3. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and are hereby repealed.
Section 4. That this ordinance shall be in full force and effect upon its passage and
publication in the manner provided by law.
