AN ORDINANCE
AMENDING ORDINANCE G37-04 CLASSIFYING TERRITORY IN THE
PSFR2 PLANNED SINGLE FAMILY RESIDENCE DISTRICT
(Copper Springs Subdivision Water Road)
WHEREAS, the territory commonly known as the Copper Springs Subdivision has
previously been annexed to the City of Elgin and zoned in the PSFR2 Planned Single Family
Residence District pursuant to Ordinance No. G37-04; and
WHEREAS, written application has been made by the owner of the Copper Springs
Subdivision to amend Ordinance No. G37-04 to allow for specified balconies to be permitted
obstruction in their required rear yards of certain lots within the Copper Springs Subdivision; and
WHEREAS, after due notice in the matter provided by law the planning and development
commission conducted a public hearing concerning said application has submitted its written
findings and recommendation; and
WHEREAS, the city council of the City of Elgin has reviewed and findings and
recommendations of the planning and development commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ELGIN, ILLINOIS:
Section 1. That Section 2G7 of Ordinance No. G37-04 be and is hereby amended to
read as follows:
"7. Yards. In this PSFR2 zoning district, a"strict yard [SR], a side yard" [SR], or a
"rear yard" [SR] established by a required building setback or by the actual location of a building
shall be subject to the provisions of Section 19.12.600, Obstructions in Yards, of the Elgin
Zoning Ordinance, except as follows:
1. Front porches and porticos not open to the sky may encroach nor more than six
(6) linear feet into the minimum required building setback from a"street lot line"
[SR]. Porticos shall be defined as a covered entryway which protrudes from the
main façade of the dwelling, but which is not as wide as the façade itself.
2. Balconies (open decks exceeding 48 inches in structure height) located on the rear
of a dwelling unit located on lots 80-82, 86-98 and 118-127, as identified on the
Final Plat of Subdivision for Copper Springs, prepared by V3 Consultants and
dated February 7, 2005, with revisions dated June 13, 2005, may encroach into
the required rear yard building setback as follows:
a Alcott Model #2406: maximum allowable encroachment of 10 feet.
""' b Emerson Model #2496: maximum allowable encroachment of 3.17 feet.
c Hemingway Model #2727: maximum allowable encroachment of 4.5 feet;
d Fitzgerald Model#2854: maximum allowable encroachment of 5.17 feet;
e Longfellow Model #3115: maximum allowable encroachment of 4.17 feet;
f Whitman Model#3350: maximum allowable encroachment of 0.5 feet;
g Steinbeck Model#3674: maximum allowable encroachment of 0.5 feet.
Approval of any encroachment of a balcony into a required rear yard building
setback shall also be in full conformance with the statement of purpose submitted
by John Nevenhoven, Land Entitlement Manager, Centex Homes, dated
November 23, 2005, and with the Copper Springs deck exhibit prepared by V3
Consultants and dated April 8, 2005."
Section 2. That this ordinance shall be in full force and effect immediately after its
passage in the manner provided by law.
