municipality passed and approved Ordinances G103-06, which provided by their terms they
should be published in pamphlet form.
The pamphlet form of Ordinances No. G103-06, including the Ordinance and a
cover sheet thereof, was prepared, and a copy of such Ordinance was posted in the municipal
building, commencing on December 22, 2006, and continuing for at least ten days thereafter.
Copies of such Ordinances were also available for public inspection upon request in the office of
the municipal clerk.

AN ORDINANCE
AMENDING THE SCHEDULE OF FEES FOR CEMETERY LOT SALES
AND BURIAL SERVICES
Section 1. That Section 2.24.200 of Chapter 2 of the Elgin Municipal Code, 1976, as
amended, is hereby amended to read as follows:
"2.24.200 Lot or grave space--Purchase price.
A. The cost of lots is established at the rate of eight hundred fifty dollars
per grave space;of this amount seven hundred dollars shall be credited to the general
fund and one hundred fifty dollars to the perpetual care fund. However, if the
restricted asset fund is depleted below its required level, fifteen percent of each
amount shall be credited to the restricted asset fund.
B. The cost of infant grave spaces in the infant and child section is
established at one hundred eighty-five dollars for two foot by four foot grave sites
and three hundred forty dollars for grave sites larger than two foot by four foot; of
this amount,two hundred fifty dollars shall be credited to the general fund and ninety
dollars to the perpetual care fund. The cost of infant and child grave spaces in the
adult section is established at the same rate as an adult grave space in that section.
C. The cost of lots in Section 2-A is established at the rate of eight
hundred fifty dollars per grave space; of this amount seven hundred dollars shall be
credited to the general fund and one hundred fifty dollars to the perpetual care fund.
However, if the restricted asset fund is depleted below its required level, fifteen
percent of each amount shall be credited to the restricted asset fund.
D. The cost of lots in the memorial sections is established at the rate of
seven hundred dollars per grave space; of this amount five hundred ninety dollars
shall be credited to the general fund and one hundred ten dollars to the perpetual care
fund. However, if the restricted asset fund is depleted below its required level,
fifteen percent of each amount shall be credited to the restricted asset fund.
E. The cost of lots in Section 22 is established at the rate of eight
hundred fifty dollars per grave space; of this amount seven hundred dollars shall be
credited to the general fund and one hundred fifty dollars to the perpetual care fund.
However, if the restricted asset fund is depleted below its required level, fifteen
percent of each amount shall be credited to the restricted fund.
F. The cost of one cremation niche space in the Columbarium which can
be utilized for either one or two inurnments is established at the rate of one thousand
four hundred dollars, which includes the space and bronze nameplate. Of this
amount one thousand one hundred ninety dollars shall be credited to the general fund
and two hundred ten dollars to the perpetual care fund. The rate for a weekday
inurement performed before 2:30 pm is established at four hundred forty dollars and
may be included in the price of a pre-need sale.
G. The city council, by resolution, may provide that the city enter into
contracts for the sale of tracts of lots or graves for a price per grave space other than
as provided in this chapter where such agreements provide for the sale of not less
than 350 grave spaces to recognized nonprofit religious or fraternal organizations,in
accordance with terms and conditions established by the council."
Section 2. That Section 2.24.230 of Chapter 2 of the Elgin Municipal Code, 1976, as
amended, is hereby amended to read as follows:
"2.24.230 Fees for burial services.
The superintendent shall demand and shall receive the following fees in
advance. Fees charged to the account of local undertakers shall be paid within twenty
days after services furnished.

Surcharge: Anyone wishing to purchase perpetual care for
any grave space not currently covered by such care shall pay a
surcharge equal to five years seasonal care on the number of graves to be
covered. The surcharge shall be based on the then current fee for seasonal
care. Provided, however, that this surcharge shall bereducedbytheamount
equal to the then current seasonal care rate multiplied by the number of
years,if any,in the five(5)years prior that seasonal care was provided for
the grave or grave spaces to be marked. This surcharge is to be
deposited in the General Cemetery Fund."
Section 3. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance be and are hereby repealed.
Section 4. That this ordinance shall be in full force and effect from and after January 1,
2007.
