STATE OF ILLINOIS ) ) ss. COUNTY OF KANE ) CERTIFICATE I, Dolonna Mecum, certify that I am the duly appointed and acting municipal clerk of the City of Elgin, Cook and Kane Counties, Illinois. I further certify that on December 20, 2006, the Corporate Authorities of such municipality passed and approved Ordinances G101-06, which provided by their terms they should be published in pamphlet form. The pamphlet form of Ordinances No. G101-06, including the Ordinance and a cover sheet thereof, was prepared, and a copy of such Ordinance was posted in the municipal building, commencing on December 22, 2006, and continuing for at least ten days thereafter. Copies of such Ordinances were also available for public inspection upon request in the office of the municipal clerk. DATED at Elgin, Illinois, on December 22, 2006. Municipal Clerk Deput/ unicipal Clerk (SEAL) r Ordinance No. G101-06 AN ORDINANCE AMENDING THE FEE SCHEDULE FOR CERTAIN BUSINESS LICENSES BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That Title 9, Chapter 9.08.050 entitled "License; Annual Fee" of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended to read as follows: "9.08.050: LICENSE; ANNUAL FEE: A. Retail Food Stores: 1. Retail food stores; including sale of fresh meat and groceries: two hundred sixty dollars ($260.00). 2. Specialty retail food stores: one hundred seventy dollars ($170.00). Includes: a. Bakeries; b. Confectionery and/or ice cream stores; c. Meat markets; d. Grocery stores (no sale of fresh meats); e. Wholesale food distributors; f. Delicatessens. 3. Convenience food outlets: ninety dollars ($90.00). Includes: a. Milk depots, including prepackaged convenience foods; b. Produce stands. B. Food Service Establishments: 1. Restaurants with a customer capacity of twenty five (25) persons or more at one time: two hundred fifty dollars ($250.00). Includes: a. Hospitals; b. Bars, taverns, lounges with food preparation. 2. Restaurants with a customer capacity, including counter stool or seats, of less than twenty five (25) persons at one time: two hundred ten dollars ($210.00). Includes: a. Drive-throughs, no seating; b. Nursing homes; c. Retirement centers; d. Bars, taverns, lounges with food preparation. 3. Daycare centers with food preparation: one hundred fifty dollars ($150.00). 4. Bars, taverns, lounges with only prepackaged food and no food preparation: ninety dollars ($90.00) f C. Waiver of Fees: 1. No permit fee otherwise required by this Chapter shall be required of any unit of local government as defined by the constitution of Illinois, 1970, school district, or community college district. 2. The exemptions provided in this Section apply only to fees and shall not exempt or waive the requirement of any permits or inspections otherwise required. D. Late Payment Penalty Fee: All permit fees for the annual renewal of permits are due by December 31 of each year. Commencing February 1, 1996, establishments failing to submit the required fee by December 31 shall be assessed a late payment penalty fee of ten percent (10%) per month of the license fee. E. Reinspection Fee after Determination of Noncompliance: 1. First reinspection: No fee. 2. Second and subsequent reinspection fees: thirty one dollars($31.00)." r ((1".' Section 2. That Title 6,Chapter 6.65.050 entitled"License Fee;Exempt Facilities"of the Elgin Municipal Code, 1976, as amended, be and is hereby further amended by amending Section 6.65.050A to read as follows: "A. Annual Fee. The annual license fee of a swimming pool shall be one hundred fifty dollars ($150.00). Swimming pools operated by the City shall be exempt from the license fee requirement." Section 3. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and are hereby repealed. Section 4.
