Cogley Dolonna Mecum Corporation Counsel Elgin City Clerk City of Elgin 150 Dexter Court 150 Dexter Court Elgin, IL 60120 Elgin, IL 60120 Ordinance No. 522-04 AN ORDINANCE VACATING A PORTION OF A PUBLIC STREET (Wright Avenue) WHEREAS,the public interest will be served by vacating a portion of a public street in the City of Elgin, Cook County, Illinois, as shown in Exhibit"A" attached hereto; and WHEREAS, said property is not necessary to serve the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN,ILLINOIS: Section 1. That a portion of a public street in the City of Elgin, Cook County, Illinois, legally described as follows: That part of Wright Avenue in the East 1/2 of the Southwest 1/4 of Section 19, Township 41 North, Range 9, East of the Third Principal Meridian, in Cook County, Illinois, described as follows: Beginning at the intersection of the South right of way line of Lake Street (Rt. 20) and the Easterly right of way line of Wright Avenue;thence Southwesterly along said Easterly right of way line of Wright Avenue, 90.11 feet; thence Westerly along a line to the Southeast corner of Lot 3 in Elgin Heights Addition to Elgin, 81.40 feet, more or less; thence Northwesterly along the Easterly line of said Lot 3, being a curve concave to the West,having a radius of 150 feet,an arc length of 89.46 feet and a chord distance of 88.14 feet,more or less,to a point on the South right of way line of said Lake Street(Rt. 20); thence Easterly along said South right of way line, 139.56 feet,more or less,to the point of beginning,containing 8,910 square feet or 0.20 acre, more or less. be and the same is hereby vacated. Section 2. That the City of Elgin does hereby reserve for and to itself and for and to any public utility company owning any public utility or public service facilities in, upon or under said right of way vacated by this ordinance full right of access for the purpose of continuing or extending any public utility or public service facilities and to maintain, renew, extend or construct or reconstruct any such public utility or public service facilities. No buildings or other permanent structure shall be construed upon said right-of-way vacated by this ordinance. Section 3. That for and in consideration of the city vacating the portion of Wright Avenue as provided herein George Reich as the owner of a parcel of property abutting the portion of Wright Avenue vacated herein has paid to the city the sum of$2,670. A certified copy of this ordinance and a plat of said vacated right of way shall be filed with the Recorder of Deeds of Cook County,Illinois, T i , and thereupon George Reich as the owner of a parcel of property abutting the portion of Wright Avenue vacated herein shall pursuant to 65 ILCS 5/11-91-1 acquire title to the entire portion of Wright Avenue vacated by this ordinance. Section 4. That this ordinance shall be in full force and effect from and after its passage and recording in the manner provided by law.
