HomeMy WebLinkAboutG50-04 Ordinance No. G50-04 AN ORDINANCE GRANTING A CONDITIONAL USE FOR A COCKTAIL LOUNGE IN THE CC1 CENTER CITY DISTRICT AND THE ARC ARTERIAL ROAD CORRIDOR OVERLAY DISTRICT (161 East Chicago Street) WHEREAS, written application has been made requesting conditional use approval for a cocktail lounge in the CC 1 Center City District and the ARC Arterial Road Corridor Overlay District; and WHEREAS, the Zoning and Subdivision Hearing Board conducted a public hearing after due notice by publication and has submitted its Findings of Fact and recommended approval; and WHEREAS, the City Council of the City of Elgin concurs in the Findings of Fact of the Zoning and Subdivision Hearing Board. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS: Section 1. That the City Council of the City of Elgin hereby adopts the Findings of Fact, dated April 7, 2004, made by the Zoning and Subdivision Hearing Board, a copy of which is attached hereto and made a part hereof by reference as Exhibit A. Section 2. That a conditional use to permit the establishment of a cocktail lounge in the CC1 Center City District and the ARC Arterial Road Corridor Overlay District at 161 East Chicago Street and legally described as follows: The east one third of lot 4 (except the southerly 10 feet) in block 15 of the original town of Elgin, on the east side of the Fox River, in the City of Elgin, Kane County, Illinois (property commonly known as 161 East Chicago Street). be and is hereby granted subject to the following conditions: 1. Substantial conformance with the Statement of Purpose and Conformance, prepared by Leng Prathammanon, dated March 17, 2004. 2. Substantial conformance to the Floor Plan, submitted by Leng Prathammanon, dated March 17, 2004. 3. Substantial conformance to the Sign Plan, submitted by Leng Prathammanon, dated March 17, 2004. The sign surface area for all wall signs shall conform to the requirements of EMC 19.50 Signs. 4. Any additional wall signs placed on the building shall not advertise a specific manufacturer's product. 5. Compliance with all applicable codes and ordinances. Section 3. That the conditional use granted herein shall expire if not established within one year from the date of passage of this ordinance. Section 4. That this ordinance shall be in full force and effect immediately after its passage in the manner provided by law.
