AN ORDINANCE
GRANTING A CONDITIONAL USE FOR A MASTER SIGNAGE PLAN
(127 SOUTH GROVE AVENUE)
WHEREAS, written application has been made for a conditional use for a master signage
plan in the CC1 Center City District at 127 South Grove Avenue; and
WHEREAS, the Zoning and Subdivision Hearing Board conducted a public hearing after
due notice by publication and has submitted its Findings of Fact and recommended approval; and
WHEREAS, the City Council of the City of Elgin concurs in the findings and
recommendation of the Zoning and Subdivision Hearing Board.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ELGIN, ILLINOIS:
Section 1. That the City Council of the City of Elgin hereby adopts the Findings of Fact
made by the Zoning and Subdivision Hearing Board, a copy of which is attached hereto and made a
part hereof by reference as Exhibit A.
Section 2. That a conditional use for a master signage plan in the CC1 Center City District
at 127 South Grove Avenue and legally described as follows:
PARCEL ONE:
LOT 10 AND THAT PART OF LOT 9 IN BLOCK 13 OF THE

Section 5. That this ordinance shall be in full force and effect immediately after its passage
in the manner provided by law.

BACKGROUND
An application has been filed by the Prairie Rock Brewing Company,requesting to repeal an existing
conditional use for a master signage plan(ordinance G23-03)and to grant a conditional use for a new
master signage plan. The subject property is located at 127 South Grove Avenue(see exhibits A,B,
C, D, and E).
Prairie Rock Brewing Company is currently undergoing a change in business identity to improve
several aspects of the existing restaurant. Prairie Rock Brewing Company is proposing to establish
additional wall signs on the Prairie Street and Grove Street elevations. These signage changes are
primarily requested so that the signs can accurately reflect the new identity of the business.
A total of 4 signs are proposed for the Grove Street elevation.The applicant is proposing to maintain
the existing 12.5 square foot projecting wall sign and to add a suspended sign, measuring
approximately 3.75 square feet, on the bottom of the projecting sign. Additionally,the applicant is
proposing a painted wall sign,measuring approximately 6 square feet,and a sign painted on a fence,
measuring approximately 4 square feet,in an entryway to the outdoor beer garden(see exhibit E-2).
On the Prairie Street elevation, the applicant is proposing to establish a total of 6 wall signs for a
total of 241 square feet (see exhibits F, G, and H).
Additionally, a conditional use for a master signage plan was granted in 2003 (Ordinance 23-03)to
allow the signs which currently exist on the building. The existing ordinance must be repealed if
signs are to be added to the Prairie Street elevation.
FINDINGS
After due notice, as required by law, the Zoning and Subdivision Hearing Board conducted public
hearings in consideration of Petition 11-04 on February 18, 2004. The applicant testified at the
public hearing and presented documentary evidence in support of the application. The Community
Development Group submitted a Conditional Use Review dated February 13, 2004.
The Zoning and Subdivision Hearing Board has made the following findings:
A. Zoning History Findings. The subject property was zoned as follows for the years listed:

A conditional use for a master signage plan was granted in 2003 (Ordinance G23-03), to
allow the signs which currently exist on the building.
B. Surrounding Land Use and Zoning Findings. The subject property is located within the
Center City and is zoned CC1 Center City District.
The properties located to the north, east, and west are zoned CC 1 and are developed with
commercial uses and a parking lot.
The property to the south is zoned CC2 Center City District and is developed with a public
parking lot and open space.
The properties to the west and south are the subject of the proposed River Park Place
residential/commercial development. The property to the southwest is the site for the
proposed Festival Park.
C. Trend of Development Findings. The subject property is located at the south end of the
commercial core of Elgin's center city. The trend of development for the downtown is the
continuation of revitalization. New residential uses and additional commercial and
recreational uses are envisioned for the immediate area.
D. Zoning District Findings. The purpose of the CC1 Center City District is to facilitate the
implementation of the official comprehensive plan for the center city, as focused on a
distinctive subarea of the city with a common urban fabric.The CC 1 zoning district provides
for a concentration of finance, service, retail, civic, office, and cultural uses in addition to
complementary uses such as hotels,entertainment,and housing.The development standards
are intended to encourage a mix of activity in the area while providing for quality
development that maintains a sense of history, human scale and pedestrian-oriented
character.
STANDARD FOR A CONDITIONAL USE FOR A MASTER SIGNAGE PLAN
Master Signage Plans may be established to provide an opportunity for a creative approach to
signage which may not conform to all of the provisions of other sections of the sign ordinance.
Findings. It is the opinion of the Zoning and Subdivision Hearing Board that the proposed master
signage plan meets the standards for a conditional use for a master signage plan.

The Prairie Rock Brewing Company is currently used as a bar with an outdoor beer garden in the
western portion of the building and a restaurant/banquet area in the eastern portion of the building.
The applicant is proposing to improve the image of the restaurant. In doing so, the applicant is
requesting that additional signage be allowed on the building to better identify the new image of the
restaurant. Staff believes that the proposed signage represents a creative approach to the use of signs.
Grove Street Elevation:
The sign ordinance allows a maximum of 2 wall signs on the Grove Street elevation, with a total
allowable surface area of 80 square feet. The ordinance prohibits painted wall signs.
The applicant is requesting a total of 4 signs (a 100% departure) with a total of approximately 26
square feet in surface area. The applicant is proposing to maintain the existing 12.5 square foot
projecting wall sign and to add a suspended sign,measuring approximately 3.75 square feet,on the
bottom of the projecting sign.Additionally,the applicant is proposing a painted wall sign,measuring
approximately 6 square feet,and a sign painted on a fence,measuring approximately 4 square feet,in
an entryway to the outdoor beer garden.
Prairie Street Elevation:
41)The sign ordinance allows a maximum of 2 wall signs on the Prairie Street elevation, with a total
allowable surface area of 80 square feet. The sign ordinance prohibits a sign from covering the
outside of an architectural feature, such as a window.
The applicant is proposing a total of 6 wall signs(a 300%departure)with a total of 241 square feet
(a 301% departure).
MITIGATION STANDARD
The approval of a conditional use for a master signage plan is subject to the condition that the
requested departures are mitigated by an equivalent and more restrictive application of other
regulations of the ordinance.
Findings. It is the opinion of the Zoning and Subdivision Hearing Board that mitigation has been
proposed which is sufficient for the requested conditional use for a master signage plan.
The applicant is proposing to remove an existing 75 square foot wall sign from the Prairie Street
elevation.

SUMMARY OF FINDINGS,UNRESOLVED ISSUES,AND ALTERNATIVES
The Zoning and Subdivision hearing Board has developed or identified the following findings,
unresolved issues, and alternatives:
A. Summary of Findings.

currently used as a bar with an outdoor beer garden in the western portion of the
building and a restaurant/banquet area in the eastern portion of the building. The

The Zoning and Subdivision Hearing Board hereby recommends the approval of Petition 11-04. On
a motion to recommend approval of Petition 11-04,subject to the following conditions,the vote was
five (5) yes and zero (0) no:
1. Substantial conformance to the Signage Plan,including the painted wall signs and suspended
sign as shown on Exhibit E-2.
2. Maintain a minimum 8 feet clearance under the suspended sign.
3. Conformance with all applicable codes and ordinances.

Dear Mr. Wyatt,
Prairie Rock Brewing Company, at 127 S. Grove, is requesting a conditional use permit
to amend the master signage plan. Within the existing building Prairie Rock has
rexperienced growth over the past few years in two of the three areas that are currently in
operation. The group sales division has increased 15% over the past two years,
anticipating and reacting to the needs of the area. The bar&grill area has increased 18%
over the past two years. Both venues continue to grow and we anticipate double-digit
growth this upcoming year.
The one area that has not seen growth is the main dining room. We feel that a new
identity is necessary for the restaurant to reach its growth potential. The new concept will
be named Prairie Street Chop House. Our intension is to create a cook your own steak
house that offers the finest cuts of meat; fresh fish; kabobs and marinated chicken breast.
Guests will have the option of grilling their own steaks; seafood and chicken or upon
request, one of our Chefs will grill their food at no charge. In the Chop House, each guest
ordering will be offered (at no additional charge)a"wedge" salad and side dishes that
will include but not limited to au gratin potatoes, baked potatoes, vegetables, baked beans
and home made soups.
We will have a full time grilling expert available to assist our guests with grilling
instructions and techniques while they grill their steaks. The cook your own steak area
will be located in the rear of the restaurant (behind the fireplace). The Chop House area
will include a full bar next to the grilling area where guests can walk up and order drinks
while they grill. The idea is to create a social environment where our guests can interact
tillw with each other while grilling.

WHEREAS, written application has been made for a conditional
use for a master signage plan in the CC1 Center City District at
127 South Grove Avenue; and
WHEREAS, the Zoning and Subdivision Hearing Board conducted a
public hearing after due notice by publication and has submitted
its Findings of Fact and recommended approval ; and

1 Prairie Rock has been around nine
2 years . We have a restaurant within the
3 facility. There' s a bar, and we have
4 banquets and we also have an outdoor beer
5 garden vending or a venue. And I 've been
6 here for one sign and the beer garden, and I
7 am back again to ask for -- it ' s some
8 additional signage.
9 What we want to do, my letter that I
10 sent to Todd stating the situation at Prairie
11 Rock, we 've seen marginal -- or we 've seen
12 tremendous growth in the bar and grill
13 segment of our business. We've seen a lot of
14 growth in the banquet business, 15 to 18
15 percent between the two. The beer garden
16 started off had a great summer last year, so
17 we anticipate more great things this year.
18 We have a lot of plans for out there as far
19 as that venue is concerned.
20 So the growth -- the problem with the
21 growth area and the restaurant now is the
22 restaurant as far as creating the energy and
23 excitement . And it has been the same for
24 nine years . I 've been on board for three,

1 and I think we 've made some changes . I think
2 we've made progress in a lot of areas
3 consisting of the food, service, quality.
4 Those of you that have been there know it ' s a
5 quality operation. It ' s clean, it ' s well
6 maintained, and I think it ' s well run. I am
7 one of the partners. I oversee that
8 location. I spend the majority of my time in
9 this restaurant. I have an Elgin residence.
10 I also oversee our Schaumburg location, but I
11 spend probably 70 percent of my time here.
12 And what we 'd like to do is retool the
13 restaurant portion of the business, leave the
14 bar and grill the way it is. We ' re proposing
15 that we change the sign over the bar and
16 grill from "brewing company" to "bar and
17 grill . " There is currently an entrance
18 there, a door that is used to facilitate an
19 outdoor patio that we 've removed the fence
20 from that, which has really cleaned up the
21 front of the restaurant, in my opinion.
22 We would like to create that as an
23 entrance to the bar and grill as a separate
24 entity. The barrel rolled roof portion of

1 the building is what houses the restaurant
2 and the banquet space that we have available.
3 The main dining room we would like to create
4 a cook your own steak grill concept where you
5 can have the option of cooking your own steak
6 if you'd like to or we can cook it for you.
7 We ' ll have steaks, chops, seafood,
8 chickens, kabobs, different variety things so
9 you have the option of either or. This is a
10 concept that is effective and successful in
11 Wisconsin as well as southern Illinois.
12 We've done some research on it, and we feel
13 as though that would be nice addition to
14 Elgin. But we'd like to identify that by
15 some additional signage on the building.
16 The side that we put on the side of the
17 building reads "bar and grill, " and the
18 reason for that was to capture traffic to
19 identify that as the bar and grill . Now we
20 would like to have additional signage to
21 identify the restaurant as a separate entity
22 for East Town Chophouse.
23 CHAIRMAN LANGLOIS: So the sign
24 that you just added on Grove stays?

13 building, which is a back lit sign.

15 it ' s that existing sign on the bottom right

5 actually on the recycled plastic materials
6 that we used to build that . And on this wall
7 here, our intention was to -- again, to
8 bring, you know, identity to that so people
9 notice that it was there. And all it says is
10 "Rock Garden, " but it ' s very faint and it ' s
11 not very well -- that ' s why we added the one
12 on the gate just so people would know that it
13 was there.
14 But we -- all of the access to that bar
15 -- or the outdoor beer garden is through the
16 bar and grill in the bar area. There' s an
17 entrance by the back bar area. And that' s
18 just for our security. We can monitor. We
19 card. We can make sure that underage people
20 aren' t out there.

3 as Scott described, there are many distinct
4 and different components within Prairie Rock
5 Brewery. And staff feels that it is a
6 reasonable request to add the additional
7 signage to the building. Staff has found
8 that the proposed plan meets the standards
9 for a conditional use for a master signage
10 plan and is recommending approval of the
11 petition subject to the three conditions on
rink 12 Page 5 of the staff report . Thank you.
13 CHAIRMAN LANGLOIS: Okay. Scott,
14 these three conditions are acceptable to you?
15 MR. LAGER: Yes.
16 MR. WYATT: Let me read off those
17 conditions real quick. Substantial
18 conformance to the signage plan, including
19 the painted wall sign and the suspended sign
20 as shown on Exhibit E2 . No. 2, maintain a
21 minimum eight foot clearance under the
22 suspended sign. No. 3, conformance with all
23 applicable codes and ordinance.

7 Segel . Address is 40 North Gifford in Elgin. .
8 I have been a resident of Elgin for the past
9 three and a quarter years and have by reason
10 of the location of my house, it ' s close to
11 downtown, and I really joined and became
12 involved with Downtown Neighborhood 07)
13 Association.
14 For the first two years of that time,
15 my efforts were spent on the economic
16 development committee. So I want to assure
17 you, I 'm coming at this from a standpoint of
18 being concerned about encouraging development
19 of our businesses in downtown. I also found
20 myself after about a year of being placed on
21 the comprehensive plan advisory committee for
22 just about two and a half years to come forth
23 with its report. We have been spending a
24 great deal of time on the downtown and the

1 business areas of the City as a part of the
2 comprehensive plan. So I wanted to make that
3 clear.
4 And I also am looking forward to
5 enjoying some of the great food that Scott is
6 talking about. I enjoy the restaurant and
7 the banquet hall . I go to meetings there.
8 But you've -- you 've seen there ' s an
9 enormous amount of signs on that building.
10 And my comments tonight are not going to be
11 focused on the signs over the grill or the
few
12 new "banquet" signs or the signs on the
13 garden wall or the other signs . It ' s going
14 to be focused on the sign that sits up, the
15 large sign that sits up over one of the most
16 prominent features of that building, which is
17 the large window.
18 When I 'm in the building at the banquet
19 and having a banquet with an organization,
20 that ' s -- that ' s the most prominent . And it
21 is also the most prominent from the outside.
22 We ' re not objecting to a sign to
23 identify encouraging the restaurant to gain
24 more business. But I think we need to be

1 cautious and careful here about looking at
2 this from a short range and the intermediate
3 and the long range standpoint with regard to
4 the impact of -- of this sign where it ' s
5 mounted on the window and, also, the -- the
6 internally illuminated sign with its plastic
7 sign face.
8 Over the next years, there' s going to
9 have to be an enormous effort to bring more
10 businesses into downtown to make it viable
11 for the City and to make it more viable for
12 Scott and Prairie Rock as well. And of this 47)
13 -- this becomes an important issue. This
14 particular sign is not permitted by the sign
15 ordinance. And I just want to encourage you
16 to spend some time and be reflective here and
17 perhaps give the DNA and Scott a very brief
18 segment of time to take a look at some other
19 alternatives leaving him the sign and -- and
20 in the end doing a better impression coming
21 into the City from the building.
22 You know, I don' t know if anybody has
23 contacted the town house and the condo
24 association. I mean, this sign is -- is

1 going to be -- it ' s going to be a very
2 prominent one for people in those town
3 houses, and I think that it really would be
4 wise to be very cautious about coming forward
5 with a sign that is a major variance and a
6 very large sign as well.
7 I understand why he wants the size. I
8 mean, obviously, you know, you could see it
9 for a longer distance. But that even makes
10 it more important that the quality of the
11 sign and its appearance fit our future here.
12 Hopefully with those town houses and
13 the condos, some of the area adjacent to
14 Prairie Rock are going to fill in with
15 businesses. And I think over time, there ' s
16 going to be more attention probably paid to
17 sign ordinances to have a -- have an
18 appearance, an image of what Elgin is and
19 wants to be.
20 So we ' re not -- we ' re not objecting to
21 the signs, we ' re not objecting even to the
22 large sign at this stage. We wonder whether
23 it has to be placed over the window and it
24 can' t be placed somewhere else. But we also

1 are, as I say, concerned about the -- the
2 illumination internally and also the type of
3 sign that -- that ' s there and simply ask the
4 body to, you know, encourage a dialogue for,
5 you know, probably your next meeting a few
6 weeks from now. So thank you for your time

9 have to ask that, Scott, would you be willing
10 to -- if we approve this, could we approve
11 this with the understanding that you would at
12 least consider listening to the neighborhood

18 to Mr. Segel, you know, I 've made contact

23 any objections to the sign, and there ' s been

2 We have gone to a lot of time and
3 effort to come up with what I think is a good
4 looking image for the front of our building,
5 and I really don' t think -- you know, we're
6 adding some more signage, but I think it ' s --
7 we do things pretty classy. We try to be
8 upscale about it .
9 And I disagree. I think that -- you
10 know, that we have been in discussion with
11 the City for quite some time on this . And,
em,
12 you know, now the objection comes up, and we
13 have to wait another three or four weeks for
14 another meeting? I 'd rather not .
15 CHAIRMAN LANGLOIS: I wasn' t -- I
16 mean, my suggestion was not to delay a vote,
17 but to go ahead and vote approval . That ' s my
18 suggestion. My fellow commissioners still
19 have to agree or vote to agree. My only
20 suggestion was my impression that this
21 dialogue might not have taken place and this
22 might allow more dialogue to take place, but
23 what you 've just said is that this is not
24 new.

17 the impression that they were okay with it.

2 control how bright or how --
3 MR. LAGER: Well, we don' t want
4 it to be -- we' re not looking for an
5 obnoxious bright, you know, streetlight. We
6 want it to be tasteful and not overpowering.
7 We can work with the sign company on that as
8 far as how bright it ' s going to be. It needs
9 to just be, you know, visible signage. We' re
10 not looking for anything really bright . And
11 I think one of the questions they came up
12 with the sign was -- one of the
13 recommendations was to have incandescent
14 lighting light the sign up, and we wanted
15 internally lit, because we thought that was
16 going to give us much more illumination and
17 much more visibility. And that ' s what I
18 remember from the conversation that we 'd have
19 with the DNA.
20 MR. WEILER: Then the other
21 question I have about that sign over the main
22 entrance is if you are in the banquet area,
23 what are you going to see? What would you
24 see? What would be the backside of that

2 MR. LAGER: We have blinds. It
3 wouldn' t be lit from the backside. You' ll
4 never see any light from the back, but we
5 have wood blinds on the second floor. And
6 the sign proportion was -- the sign would be
7 high enough for the sight line anybody 6 ' or
8 6 ' 5" or below would not see anything but the
9 outside of the building. If we wanted the
10 blinds open for a party, we would close the
11 wooden blind down to that portion so you
12 wouldn' t see the back of the sign.
13 MR. WEILER: So it would be above
14 you?
15 MR. LAGER: Yes.
16 MR. WEILER: You would not --
17 MR. LAGER: If you're standing
18 there, if you' re 7 ' tall, right, it would be
19 at least -- and it ' s really proportional to
20 what the actual -- we don' t want to have
